The Councill nominates and Appointes his Grace The Duke of Queensberrie, The Earles of Morton Lauderdae Leven and Annandale, Lords Thesaurer Deput and Crosrigg, Sir Robert Sinclair of Stevensone and the present Lord provost of Edinburgh To be a Committee to meet and take into Consideration such occurrences or affairs as may fall out in this time of Closs Vaccance now Ensueing, And declares any five of the forsaid Committee to be a Sufficient quorum, with power to the Said Committee or their quorum, To write if they see a necessity for calling a Councill To the Lord high Chancellor, That he may call the same or if it be necessary Remitts to the Committee to call the Same And to acquaint The Lord high Chancellor and their other members of the time of its meeting.

The Lords of his majesties privy Councill, Doe heirby give order and warrant to Collonell Archbald Row Commander in cheiff for the tyme of his majesties forces within this Kingdom, To detach the number of Fourty Five able men of his Majesties foot souldiers, And to cause march and quarter the said men at the places or posts following viz Fifteen of the said number at or about the Kirktoune of Castle-Town of Bremarr and fifteen of them at Blair Findie, and the other Fifteen and Curgaff with officers suitable for security of the peace of these places of the highlands, and to prevent Sorneing and Theiveing.

Committee Anent a Letter from the Commissioners of Justiciary for the peace of the Highlands

A Letter from the Commissioners of Justiciary for the peace of the highlands mett at Inch subscribed by the Lord Forbes direct to the Lord high Chancellor dated the Twenty Third of march last, Anent The Troublesome caice of that Countrey by some of the Mcdonalds And other Louse persones, with a Bond sent with the said Letter, To be subscrived by the heretors in the Highlands being both read, The Councill nominates and appoints his Majesties Advocate, The Lords Aberuchill, Crosrigg and Phesdoe To be a Committee to Consider the said Letter and Band of Cautionrie, And to Compare the Coppie of the Bond now sent with former Bands granted be the haretors in the Highlands, And To Draw up a Band to be Subscrived be the saids Haretors in the precise terms of Law, And to Return a Draught of the Band, so to be prepared be the Committee, so soon as it is Ready, with ane Answer to my Lord Chancellors Letter to the saids Commissioners mett at Inch.

Act Prohibiteing The Exporting of Meall

The Lords of his Majesties privy Councill Doe heirby prohibite and discharge all Tacksmen, Collectors, Surveyors, Waiters, directors, and Clerks of Coakets and other publict servants of his majesties Forraign Excyse To Suffer or permitt any Quantities of meal Lesser or Greater To be Exported furth of this Kingdom, to any forraign Kingdom untill The Twenty day of May next to come Inclusive and appoints them To take Bond and find sufficient Caution of such persons as transport meall from the north to any other place within this Kingdom, That they shall not Export the same furth thereof, But shall report Certificats of their unloading the same att some port within the Kingdome To the clerks of privy Councill and appoints The saids Bands to be transmitted by the saids tacksmen, Collectors, Surveyors watiers Directors and Clerks of Coakets and other publict servants to the Clerks of privy Councill so soon as the samen shall be taken by them as said is and in the mean Tyme Recommends to Sir Archibald Muire of Thorntoun Lord provost of Edinburgh one of their own number, and one of the principall Tacks-men to make Intimation of this present order of Councill to the severall Collectors surveyors or waiters directors and Clerks of Coaketts and other publict servants att their respective ports and Bounds.

Act

Reprive In favours of Malcolme Moire

Anent The Petition given in to the Lords of his Majesties privy Councill by Malcolme More alias Reed prisoner in the Tolbooth of Pearth. Shewing That there petitioner being upon the first day of Aprile Instant sentenced by the Sheriff Depute of Perth to be hanged upon the 27th Instant for the alleadged Killing of Isobell Gloage Daughter to Ninian Gloage att the wood End of Nairn Their Petitioner does humbly Represent to their Lordships That ever their petitioner had the Least prejudice or any Evil or malicious design against the defunct or any other person whatsomever The True matter of fact (as to that, unhappy accident) Being as follows viz: Ther petitioner and his Collegue having Travelled all that morning and being both hungry and faint and wearied they came to the house of Ninian Gloage a common change house in my Lord Nairn’s Bounds and having gott their ane Choppin of ale and a piece of course Bread and not having money upon them to pay for the same, They were willing and did offer and promise both by parole and solemn oath, to pay the same att the next occasion, But the said Ninian Gloage would accept of no satisfaction unless Ther petitioner would Leave his Gun as a pledge for the said small Reckoning and declared That if he would not Consent to Leave her, he wold take her from him by force and accordingly did grip the Butt-End of the Gun and where their petitioner was only holding her by the midle, The Gun went of and Killed Issobell Gloage daughter to the said Ninian Gloage dead upon the place That the said slaughter of the said Issobel Gloage was only accidentall and that their petitioner hade no design of murder Either against her or any other person whatsomever. But that The said Slaughter was allenarly casuall and accidentall, Which by our Law specialy by the act of Parliament 1661 does not announce To any Captiall punishment, And the Petitioner being upon The 21 Instant sentenced to die to morrow being the 27th It is, obvious to their Lordships how short tyme is allowed the petitioner since he is unprepared for Eternity. And the Petitioner in all humilitie presumes, That if any person hade appeared for him and proponed a Defence upon the said act of parliament 1661 Anent casual homicide no succh sentence would have been pronunced against him. And Therfore Humbly craving to the Effect underwrittin as the said petition bears. The saids Lords of his Majesties privy Councill Having Considered this Petition given in to them by the within Malcolme More alias Reid, They heirby Reprive the Petitioner from the Sentence of Death, pronunced against him by the sherriff of Perth, untill the Fourteinth day of June next to come Inclusive That the Councill may take further Information in this matter and ordains the said sentence to be putt to Execution against the petitioner upon the Fifteenth day of the said Moneth of June next to come unless the Councill give order To the contrary. Sic subscribitur Annandale P Tweddale, Southerland, Ruglen, Yester, Tarbat, Teviot, Adam Cockburne, Archibald Muire.
