Letter from the King adjourneing the parliament

The letter afterinsert from his majestie to the Councill being read was ordored to be recorded whereof the tenor followeth sic suprascribitur William Rex Right trusty and right wel beloved Cousin and Councillor Right trustie and intirely beloved Cousin and Councillor Right trustie and welbeloved Cousins and Councillors and right trustie and welbeloved Councillors we greet you well. Whereas by our letter of the […] day of March last we ordered you to adjourne the parliament to the eighteen day of Apryle instant and whereas we are informed That such frequent adjourments hath begot ane oppinione that our Parliament is not to meet which makes the members more slow to come at the tyme appoynted, and therfore a tymeous positive advertisment is necessarie It is our will and pleasure and we doe Hereby authorize and requyre you to Issue furth a proclamatione in our name ordering a further adjournment of our parliament to the nynth day of May next at which tyme we are fully resolved our Parliament shall meet and therfore Ordaining all the members thereof to attend preceisly at that day in the usuall way and with the accustomed Certificationes for doeing qherof this shall be your warrant So we bid you heartilie farewell Given at our Court at Kensingtoune the thretteen day of Apryll 1695 and of our Reigne the 7th year By his Majesties Command sic subscribitur J Johnstoune

Liberatione William Finlaysone

The Lords of his majesties privy Councill doe hereby give ordor and warrand to the magistrats of Edinburgh and keeper of their Tolbooth to set at libertie furth thereof William Finlaysone presently prisoner therein In respect he hes given bond and found sufficient Cautione acted in the books of privie Council That He shall appear before the Councill when called for and in the meantyme that he shall live peaceablie under and with all submissione to the present Goverment of his majestie King William and that He shall not act, consult or contryve anything in prejudice thereof nor shall not converse nor corresponde with any Rebells under the penalty of two Hundred pound scots in case he shall transgress in any part of the premisses

Letter frae the King anent raising the value of the Coyne

Recomendatione Souldiers of the Bass to the Lords of Thesaurie

Anent the petitione given in to the Lords of his Majesties privie Councill by the Souldiers who serve presentlie in the bass Shewing that they being commanded to continow in the Bass whill his majesties pleasure were further knowen about it and it being extream dear liveing there and the petitioners haveing only allowed them four pence a day to live on which is not possible for them to subsist on which his excellence Sir Thomas Livingstoune Commander in Cheiff and one of the said Lords their number knowes verie well And therfore humblie Craveing the said Lords To recomend the said petitioners to the Lords of Thesaurie to allow them at least sex pence a day in the mean tyme untill his majesties pleasure be furder knowen as the said petitione bears
The Lords of his majesties privy Councill haveing considered the foresaid petitione given in to them by the said Souldiers presently in the Bass with Sir Thomas Livingstounes testificat therupon bearing the desyre thereof to be very necessarie They Hereby Recomend to the Lords Comissioners of his majesties Thesaurie To Cause payment be made to the said Souldiers presently in the Bass of sex shillings scots per diem for subsistance money being two shilling more then the subsistance ordinarlie allowed to other Souldiers.

Act Byres of Coats

Anent the petitione given in to the Lords of his majesties privy Councill by John Byres of Coats Shewing That the said petitioner being apprehended in England in the moneth of July last bypast and shortly therafter sent doune prisoner by sea to Scotland upon suspisione of haveing been in France, etc He hath ever since been keept prisoner in the tolbooth of Edinburgh to the very great prejudice of his private fortune and of his owne health and the petitioner is justly apprehensive That the inconveniencies which he is inevitablie lyable to from his said confynement may in all probability in a very short tyme indanger his lyfe for the want of the benefite of the free aire etc and seing the said petitioner was alwayes willing and readie to have clear’d himself as to anything that could have been laid to his charge in case he had been indicted and put to a legall tryalle before this tyme and that his imprisonment if continowed for any longer tyme may in all probabilitie occasione his death And therfore humblie Craveing the said Lords to take the premisses to their serious consideratione and to ordaine the said petitioner to be set at libertie upon his finding Cautione to appear before the said Lords when called or otherwayes to reenter to prisone at any particular day their Lordships shall think fitt to appoynt as the said petitione bears.
The Lords of his majesties privy Councill haveing considered the foresaid petitione given in to them by the said John Byres of Coats They hereby refuise to set the said petitioner at liberty But leaves to his electione whether he should be removed to the Castle of Stirline or the Castle of Blackness and Recomends to Sir Thomas Livingstoune Commander in Cheiff of his majesties forces within this Kingdome to cause convoy the said petitioner to either of the said Castles as he shall make electione under a sufficient guard And ordaines the magistrats of Edinburgh to delyver the petitioner to the Guard and the Commanding officer of either of the said Castles to receive and detaine the petitioner therein till farder ordor and in case the petitioner shall not make his electione appoynts him to continow where he is.

Letter from the Councill to the King anent the Earle of Home

The following letter being read in Councill was approven and signed and ordered to be recorded whereof the tenor followeth May it please your sacred majestie In obedience to your Royall Command we caused intimat to the Earle of Home at present at his house of Hirsell to enter himself Prisoner in the Castle of Edinburgh But had his returne That by reasone of his indispositione he was in noe case to travell as was also attested by the Certificats of Phisitians which moved us to send your majesties Phisitiane in ordinarie Sir Thomas Burnet with a Chirurgeon of his choise to visite the Earle who this day report to us That the state of his health is such, as at present he cannot come to Edinburgh without danger of his health and lyfe But upon the suppositione that he might not be in case to travelle He farder Caused intimat to Him That he should double the sum of his baille to two thousand pound sterline and add a new sufficient Cautioner to keep his former confynement and answer when called which he hes done which being all that we could doe in obedience to your majesties ordors we presume to lay it before your majestie attending your farder pleasure which shall be punctuallie obeyd by May it please you majestie your majesties most Loyall most faithfull and most obedient subjects and servants sic subscribitur Annandale P Southerland J Morton Lothiane Forfar Breadalbane Tarbat Strathnaver Carmichaell Polwarth James Stueart Thomas Livingstoune
