Act appoynting the Sollicitor to pay the Doctor and Chirurgeon who visited the Earl of Home

The Lords of his Majesties privy Councill doe hereby Appoynt his Majesties Sollicitor instantly To make payment to Sir Thomas Burnet his majesties Phisitiane of the sum of two Hundred merks Scots and to Gideon Elliot Chirurgeon Appothecary in Edinburgh of ane Hundred merks money foresaid for the paines and trouble they have been at in travelling to the house of Hirsell back and fore in visiteing the Earle of Home in obedience to the Councills Commands laid upon them for that effect and recomends to the Lords Commissioners of his majesties Thesaurie To repay to his majesties said sollicitor the said sum of three Hundred merks with what other expences he hes been at in this matter

Act Earle of Home

The Lords of his Majesties privy Councill haveing considered a testificat given in to them by Sir Thomas Burnet his majesties Phisitiane and Gideon Elliot Chirurgeon appothecarie in Edinburgh anent the conditione of the Earle of Home his present bodily health whom by ordor from the Council they have visited in ordor to knowing of the same The said Lords of privie Councill Doe Hereby allow and appoynt the said Earle of Home to remaine confyned at his owne House of Hirsle and two myles about the same on this syde of the river of Tweed and appoynts him2 not to goe without the bounds of the said Confynement and appoynts him instantlie to give bond subscryved by himself as principall and John Swintoune of that ilk and Mr William Cochrane of Kilmarnock as Cautioners conjunctly and severallie That He shall keep the bounds of his said Confynement and not goe without the bounds of the same And that He shall appear before the said Lords of privie Councille when called or requyred thereto and in the meantyme that he shall live peaceablie under and with all submissione to the present Government of his Majestie King William and that he shall not act, consult nor contryve anything in prejudice thereof nor converse or correspond with any Rebells under the penaltie of two thousand pound Sterline in case he shall transgress in any part of the premisses.

The Lords of his Majesties Privy Councill doe hereby ordaine Master James Forbes Preist who is under baill to depairt furth of his Majesties Dominions betwixt and the tuentie day of Aprylle instant to transport himself in the fleet which shall saill with the […] convey presentlie lyeing in the road of Leith in case that fleet with the Convoy shall staill betwixt and the said day And if the fleet and convoy remains after that day ordaines the said Mr. James to give bond and find sufficient Cautione acted in the books of privy Councill That He shall transport himself with the said fleet and convey whenever the same shall saill and not returne within his majesties Dominions under the penaltie of fyve Hundred pounds sterling in case he shall transgress in any part of the premisses

The Lords of his majesties privie Councill doe hereby recomend to Sir James Stueart his majesties Advocat to wryte to the severall shirriffs of the severall shirriffdoms within this Kingdome That they seaze upon apprehend and transport any persones knowen to be preists which are within their bounds to the tolbooth of Edinburgh and appoynts the magistrats of Edinburgh and keeper of their tolbooth to receive and detaine the said preists prisoners within their Tolbooth untill furder order from the Councill

Act

Act ordering Doctor Burnet and ane Chirurgeon to visite the Earl of Home

The Earle of Annandale President of his Majesties Privie Council haveing acquainted their Lordships That the Earle of Home, who by the Kings express letter is ordered to reenter the Castle of Edinburgh, hes wrot to his Lordship and also to the Clerk of privy Councill who by ordor from the Councill had acquainted the said Earle of Home with the Kings Commands and that the Councill requyred the Earle to reenter himself prisoner in the Castle of Edinburgh against Fryday next acquainting them with his indispositione of bodie and the said Lords of privy Councill haveing consider the Earle of Hom’s letter to their President with certificats under the hands of a Phisitian and a Chirurgeon of the said Earles indispositione of bodie They Hereby appoynt Sir Thomas Burnet Phisitians in ordinarie to his majestie furthwith to repaire to the said Earle of Home his house of Hirsell and to take ane Chirurgeon with him whom he shall think fitt, and if he be not in case for travell The said Lords ordain’s him to nominat an other skilfule phisitiane in his place for whom he will be answerable And ordains that Phisitian who shall be appoynted by Doctor Burnet to repaire to the Hirsle and visite the Earle of Home Carefully and betwixt and the nynth instant to returne under their hands ane account of the Conditione of his bodily health to the Councill and whether the Earle may travell without hazard of his lyfe from the Hirsle to Edinburgh Castle and lie prisoner there And the said Lords appoynts their Clerk to wryte to the Earle of Home acquainting him That if the Phisitian and Chirurgeon sent by the Councill shall report the Earle not to be in case for travelling then they requyre the said Earle to find new bale for two thousand pound sterline And appoynts his majesties Sollicitor to see the Phisitian and Chirurgeon dispatched upon the publict charges and to provyde them with all things neccessarie for their journey both outward and inward and defray the expence of the samine and pay to them such allowance as is usuall in the lyke cases and Recomends to the Lords Commissioners of his Majesties Thesaurie to reimburse his majesties Sollicitor what expences he shall be at in this matter
