Anent The petitione given in to The Lords of his majesties privie Counsell be Mr Ritchard Howiesone present minister of the Gospell at Mussleburgh Shewing That wher the petitioner haveing bein in September Jaj vic nyntie four transported from the church of Cockpen to the church of Mwssleburgh by the presbetrie at My Lord Chancellors Desyre And notwithstanding that his transportatione was Some few dayes befor the terme yet the petitioner did serve the said church of Cockpen efter the terme And the said kirk of Cockpen haveing continwed vaccant untill within this fourtnight and the petitioner haveing conforme to a visitatione of the presbetrie with consent of the deceast Sir Mark Kers the patrone being at considerable charges and expenss in repaireing of the said manse and office houses As the act of visitatione with compt of the reparationes produced with the said petitione hes testified As also The petitioner haveing bein at great charges besydes the danmadges he Sustained in transporting his household plainshing and furniture And being hard that he Should burden the parochin of Mwssleburgh therwith Seing the petitioner Served the cure at Cockpen for the whole yeir Jaj vic nyntie four as said is And ther being a yeirs Stipend vaccant of the kirk of Cockpen besydes what will belong to the present minister Lately ordained And therfore humbly craveing to the effect eftermentioned Which petitione being this day red and considered be the Saids Lords of privie Cownsell with ansuers made therto by The Laird of Cockpen with a verball report of a comittie of ther own number to whom it was remitted They heirby allow the petitioner the Soume of Thrie Hundereth and fiftie merks of the last half years Stipend of the yeir Jaj vic nyntie four of the above kirk of Cockpen And ordaines him to be readiely ansuered obeyed and payed therof be the heretors fewars Liferenters wodsetters titulars tacksemen of teinds tennents and possessors and others lyable in payment of the said half yeirs Stipend And ordaines Letters of Horning to be Direct at the petitioners instance against the heretors and wthers foirsaids lyable in payment of the said half yeirs Stipend wpon productione of a decreit of Localitie And in caice ther be non ordaines the heretors and others foirsaids Lyable in payment therof to make payment to the petitioner of ther respective proportiones therof according as they Shall be decerned by the Judge ordinary

Letters of denunceatione Mcaw Against Hamiltowne

William by the grace of God King of great Brittaine France and Ireland defender of the faith To […] Macers of our privie Cownsell messengers at armes out Shirreffs in that pairt conjunctlly and severallie speciallie constitut greeting Forasmuchas Anent the lybell or complaint raised and perswed befor the Lords of our privie Cownsell at the instance of William Mcaw Late tenent in Trochen with concurse of Sir James Stewart our Advocat for our interest in the mater wnderwritten Mentioning That wher albeit by the Lawes and Staitutes of this and all other well governed nationes The invadeing of any mans propertie and violent intrudeing upon his possessione And the maisterfull Spwillzeaing wrongows intromissioen with his cornes the invadeing of his house takeing and carying away of his plenishing and the wrongows imprisonement of our Leidges are contrairie to the Severall 2 Lawes and acts of parliament made theranent And are deeds of high oppressione and severely pwnishable, Yet nevertheles and trwe it is that upon the fourth day of October Jaj vic eightie four yeirs or upon ane or other of the dayes of the said moneth and yeir foirsaid Mr Alexander Stevensone writer to our Signet being then chamberland to The Countess Dowager of Cassills to whom the complainer was tenent came to the grownds of the Lands possessed be him And ther without any Legall title warrand or order of Law The said Mr Alexander and George Andersone merchand in Air his Substitute caused Shear what of the complainers cornes was wnshoarne Leiveing more then the feed upon the grownd wncutt Downe And therefter did dispose of and cary away the rest of that yeirs cropt which was in the barne and barne yeard without aither casting to proof or compriseing the Same And which cropt would have extended to more then sevenscore bolls of victuall which at […] per boll Extends to the Soume of […] Scotts money And furder The said Mr Alexander and his said Substitut in the foirsaid illegall way cawsed cary and drive away from off the ground of the saids Lands then possessed be the complainer his cattell horse nolt Sheepe And ane great qwantitie of wnmed and Staked Hay And not Satisfied with all this oppressione And wnjustice He the said Mr Alexander and his Substitute Did about two or thrie dayes efter the terme of Mertimes Jaj vic eightie four send and hwnd out severall Lowse persones who did cast the complainer owt of his house and putt out his fyre and left none therin bwt his old mother who not Long efter Died for cold and Hwnger Disposeing of all that was in the house at ther pleasure and who imediatly efter his ejectione The said Mr Alexander gave order and warrand to one John Mcgrwger now in the paroch of Dallrimple to possess the rowme and Lands possessed by the complainer And to intromett with the goods and others left wndisposed of by Mr Alexander and his order and so putt out and tooke in tenents and gave power to them to Laboure that grownd and Lands with what of the complainers goods and others not disposed of as said is By the which Deeds of oppressione and violent intromissione the complainer is prejudged and Damnified in Thrie thousand four Hundereth and fiftie nyn pwnds fourtein Shilling Scotts of planishing and others conforme to ane particular accompt repeated as a pairt brevitatis cawsa And the said substitut still incressing in ther malice most growndlesslie against the complainer did in the Late government informe against him and cawsed him to be imprisoned for some church disorders And efter he had lyen in prisone for the Space of twentie two moneths in a most sarveing3 and misereable conditione Least he Should be Sett at Libertie he the said Mr Alexander procured ane assignatione to ane debt owing be the complainer to Robert Dick in Crafurdstowne and therupon caused arreast him in prisone And when the complainer had gott owt of prisone he came to the said Mr Alexander and Sowght Something of his own to keep in his life He threatned the complainer with the theeves hole And haveing for his then church irregularities in caice he Should aither trouble Mr Alexander or represent his wnjustice and crweltie And haveing raised ane lybell befor The Lords of our privie Counsell Against the said Mr Alexander for the severall deeds of oppressione and others above uritten He owt of malice Did raise new Letters Captione and therupon cawsed incarcerat the complainer in the tollbwith of Cannongaite wher he remained from the twentie seventh of Apprile to the twentie eight of Jwlly Jaj vic nyntie two yeirs in a most straleing and desperat conditione thinking therto to force the complainer to desist from insisting in any proces against him And actuallie by the foirsaid Long imprisonement the foirsaid first lybell raised is become ineffectwall The Dyet of compeirance being elapsed while he was Lying in prisone And Soe altogither owt of caice to prosecute the Same Lykeas Robert Hamiltowne in Maybole present chamberland to the said Cowntess Dowager of Cassills as come in the place of the said Mr Alexander Stevensone is lyable to make compt reckning and payment to the complainer of what goods was left be the said Mr Alexander upon the grownd not intrometted with by him Conforme to Mr Stevensones Letter theranent Wherby the Saids Mr Alexander Stevensone and George Andersone his Substitut are gwiltie of ane most high and manifest oppressione against all Law And Justice And owght and Should not only be decerned to make payment to the complainer of the Said Sowme of Thrie Thowsand four hundereth and fiftie nyn punds fourtein Shilling Scotts as the price of the goods and others foirsaids wrongousely intrometted with and away taken be them without any title or collour of Law But Likewayes owght to be decerned to make payment to the said complainer of Swch a Sowme as The Lords of our privie Cownsell Shall modifie And the said Robert Hamiltowne owght also to be Decerned to make payment compt and reckning to the said complainer of his intromissiones foirsaid And also Severely pwnished in ther persones and goods to the terror of others to comitt the lyke in tyme comeing And Anent the charge given to the haill forenamed persones defenders to have compeared personallie befor the saids Lords of privie Counsell and to have ansuered to the foirsaid complaint and to have heard and sein Such order and course taken theranent as the saids Lords Should think fitt wnder the paine of rebellione and putting of them to the horne etc As in the principall Letters or lybell raised in the said mater and executiones therof at more length contained The which lybell being called upon the day and date of thir presents in presence of the saids Lords of privie Cownsell And the persewar compeareing personallie And the Defenders viz Mr Alexander Stevensone Robert Hamiltowne George Andersone and George Mcfruther being all Laufullie cited oft tymes called and not compeareing The saids Lords of our privie Counsell did grant certificatione against the Defenders in respect of ther absence except the said Mr Alexander Stevensone who is dead And ordained thir our Letters of Denunceatione to be Direct in maner and to the effect wnderwritten Our will is Herefore and wee charge yow Strictly and comand that ye pass to the mercat croce of […] and other places needfull And ther in his majesties name and authoritie Dwely Laufullie and orderly denunce The Saids Robert Hamiltowne George Andersone and George Mcgriger his majesties rebells and putt them to his highness horne And ordaine all ther moveable goods and geir to be escheat and inbrought to his majesties wse for ther contempt and disobedience

Anent The petitione given in to the Lords of his majesties privie Counsell be Maister Alexander Gwthrie minister of the Gospell Shewing that the petitioner being minister at the church of Haddam in anno Jaj vic eightie eight and some yeirs befor And haveing given obedience to the Law in praying for his present majestie King William and Qween Mary of Blessed memorie And in keeping thanksgivings as they were appointed by awthoritie did continwe in the exercise of his ministeriall fwnctione at the said church till the moneth March Jaj vic and nyntie about which tyme the petitioner was disturbed by a company of Straingers from other adjacent persones against the inclinationes of his own parishioners with whom he Lived in Love and peace And the petitioner was so farr from being Debarred from the exercise of his ministrie by the Saids Lords of privie Cownsell that upon a petitione to their Lordships in December Jaj vic and nyntie yeirs By ane act of Counsell produced with the said petitione The Saids Lords of privie Counsell Fand and Declaired that the petitioner had a right to the Stipend of the above kirk of Hoddan since his entrie to the said church And in all tyme therefter Dureing his incumbance therat And ordained him to be ansuered and payed therof With which the heretors and others of the parish did by ane attestatione prodwced with the Said petitione wnder ther hand Declaire ther Satisfactione and complyance But these Strangers being advertised of the petitioners returneing to the exercise of his ministrie Did come to the church in armes And threatned to kill the petitioner if he offered to enter to the Same soe that he was forced for fear of his life to Leave his charge And Durst never returne therto But the petitioner and and2 his familie hes bein necessitat to Live upon the charitie of others And the foirsaid kirk being Still wnprovided of a minister and the Stepend never disposed upon It is humbly conceaved that the bygone Stipends could not be bestowed to a more piows and chariteable wse then to be given to the petitioner As the lyke hes been freqwently granted to others in his circumstances Especiallie Seing the petitioner hes not only obeyed the Law in praying and keeping of Thanksgiveings and hes testified his willingnes to have Served the cure at the Said church to the hazard of his life But hes Likewayes otherwayes qwalified himself according to Law And therfore humblie craveing to the effect eftermentioned As the said petitione bears The Lords of his majesties privie Counsell haveing considered this petitione given in to them be the above Mr Alexander Gwthrie with the act of privie Counsell and attestatione of the heretors mentioned therin And produced therwith They heirby allow to the said petitioner the Stipend of Hoddam for the haill cropts and yeirs of God Jaj vic nyntie two and Jaj vic and nyntie thrie yeirs The petitioner first befor extracting heirof produceing a testificat that he hes taken the oath of alleadgeance and assureance or els takeing and Sweareing the Same befor any of the Lords of his majesties privie Counsell whom the Councell awthorizes to administer the Same to him And ordaines the said petitioner to be readiely ansuered obeyed and payed of the saids two yeirs Stipends be the heretors fewars wodsetters liferenters titulars tacksemen of teinds tenents possessors and wthers lyable in payment of the Saids Stipends And ordaines Letters of horning on fiftein dayes and others needfull to be Direct at the petitioners instance against the heretors and others foirsaids Lyable in payment of the saids two yeirs Stipends upon productione of a decreit of Localitie And in caice ther be non ordaines the heretors and wthers foirsaids to make payment to the petitioner of ther respective proportiones therof according as they Shall be determined and Decerned by the Judge ordinary which3 Act was upon the twentie third of Janwary instant Stopt upon a petitione given in be the Dwke of Qweensberrie And The Laird of Hoddam and was never extracted.

Anent The petitione given in to the Lords of his majesties privie Counsell be Maister Alexander Gwthrie minister of the Gospell Shewing that the petitioner being minister at the church of Haddam in anno Jaj vic eightie eight and some yeirs befor And haveing given obedience to the Law in praying for his present majestie King William and Qween Mary of Blessed memorie And in keeping thanksgivings as they were appointed by awthoritie did continwe in the exercise of his ministeriall fwnctione at the said church till the moneth March Jaj vic and nyntie about which tyme the petitioner was disturbed by a company of Straingers from other adjacent persones against the inclinationes of his own parishioners with whom he Lived in Love and peace And the petitioner was so farr from being Debarred from the exercise of his ministrie by the Saids Lords of privie Cownsell that upon a petitione to their Lordships in December Jaj vic and nyntie yeirs By ane act of Counsell produced with the said petitione The Saids Lords of privie Counsell Fand and Declaired that the petitioner had a right to the Stipend of the above kirk of Hoddan since his entrie to the said church And in all tyme therefter Dureing his incumbance therat And ordained him to be ansuered and payed therof With which the heretors and others of the parish did by ane attestatione prodwced with the Said petitione wnder ther hand Declaire ther Satisfactione and complyance But these Strangers being advertised of the petitioners returneing to the exercise of his ministrie Did come to the church in armes And threatned to kill the petitioner if he offered to enter to the Same soe that he was forced for fear of his life to Leave his charge And Durst never returne therto But the petitioner and and2 his familie hes bein necessitat to Live upon the charitie of others And the foirsaid kirk being Still wnprovided of a minister and the Stepend never disposed upon It is humbly conceaved that the bygone Stipends could not be bestowed to a more piows and chariteable wse then to be given to the petitioner As the lyke hes been freqwently granted to others in his circumstances Especiallie Seing the petitioner hes not only obeyed the Law in praying and keeping of Thanksgiveings and hes testified his willingnes to have Served the cure at the Said church to the hazard of his life But hes Likewayes otherwayes qwalified himself according to Law And therfore humblie craveing to the effect eftermentioned As the said petitione bears The Lords of his majesties privie Counsell haveing considered this petitione given in to them be the above Mr Alexander Gwthrie with the act of privie Counsell and attestatione of the heretors mentioned therin And produced therwith They heirby allow to the said petitioner the Stipend of Hoddam for the haill cropts and yeirs of God Jaj vic nyntie two and Jaj vic and nyntie thrie yeirs The petitioner first befor extracting heirof produceing a testificat that he hes taken the oath of alleadgeance and assureance or els takeing and Sweareing the Same befor any of the Lords of his majesties privie Counsell whom the Councell awthorizes to administer the Same to him And ordaines the said petitioner to be readiely ansuered obeyed and payed of the saids two yeirs Stipends be the heretors fewars wodsetters liferenters titulars tacksemen of teinds tenents possessors and wthers lyable in payment of the Saids Stipends And ordaines Letters of horning on fiftein dayes and others needfull to be Direct at the petitioners instance against the heretors and others foirsaids Lyable in payment of the saids two yeirs Stipends upon productione of a decreit of Localitie And in caice ther be non ordaines the heretors and wthers foirsaids to make payment to the petitioner of ther respective proportiones therof according as they Shall be determined and Decerned by the Judge ordinary which3 Act was upon the twentie third of Janwary instant Stopt upon a petitione given in be the Dwke of Qweensberrie And The Laird of Hoddam and was never extracted.

Decreit Kilgoure and Simpsone Against Hwttone

Anent The lybell or Letters of complaint raised and persewed befor The Lords of his majesties privie Counsell at the instance of Alexander Killgoure and James Simpsone present elders of The kirksessione of Dysert with concurse of Sir James Stewart his majesties advocat for his majesties interest in the mater wnderwritten That wher by the Laws and acts of parliament of this kingdome the imprisoneing any of the Leidges without any Jwst cause or occasione especiallie wher the Same is Done by a magistrat and wnder the colloure and pretence of Law And wher the persones imprisoned at the same tyme are reflected upon and unmaced and threatned for ther exerciseing of ther offices as elders being legallie and Duely elected according to the Lawes of this kingdome Yet Nevertheles David Hwttone one of the baillies of Dysert haveing Shaken of all fear of God and respect to our authoritie and Lawes is gwiltie of the foirsaides crymes In als much as on the twentie Eight day of December Last or ane or other of the dayes of the said moneth He haveing fenced a court did cause call for the saids Alexander Killgoure and James Simpsone complainers who are elders admitted by the wnited presbetries of Kirkaldie and Dumferleing And Did in ane threatening maner ask them who it was that Did dilate Mr Robert Law Doctor of The Grammer Schooll to the kirksessione And the saids complainers haveing ansuered That they Did not know he did reply that he would make them know that they were but pretended elders And that they could keepe no Sessione Therby plainely disowneing the awthoritie by which the saids complainers uere established in ther offces as elders And they haveing asked if ther was any lybell or complaint given in Against them And haveing likewayes told that David Williamsone who was present and was clerk to the Sessione could informe him of what he asked yet without any furder he did most imperiowsely and wnjunstly comand and order the townes officers to Detaine the saids complainers in prisone And accordingly the saids officers did Lay violent hands upon them And kept them prisoners wherupon they took instruments And protested for Damnadge All which being proven and instructed2 the Said David Hwtton ought to be Deprived of his office as baillie as being gwiltie of ane manifest act of oppressione And ought also to be otherwayes pwnished in his persone and goods To the terror of others to comitt the lyke in tyme comeing And Anent the charge given to the said Defender to have compeared befor the saids Lords at ane certaine day now bygone to have ansuered to the foirsaid complaint And to have heard and sein Such order and course taken theranent As the Saids Lords Should think fitt wnder the paine of rebellione and putting of him to the horne with certificatione etc As in the principall Letters and executiones therof at more Length is contained Which lybell being upon the fourtein of this instant called in presence of The Lords of his majesties privie Counsell And the persewars being absent in respect they are prisoners in the tollbwith of Dysert by the Defenders order And Sir James Ogilvie his majesties Solicitor compeareing as Advocat for them And the Defender compeareing also with Mr Hugh Dallrimple his advocat The Saids Lords admitted the lybell to probatione And the wittnesses haveing made faith The Counsell nominated and appointed a Comittie of ther own number for examining the saids wittnesses And in the mean tyme decerned and ordained the baillie of Dysert imediatly to putt to Libertie the persones of the said Alexander Killgoure and James Simpsone persewars furth of ther tollbwith wher they were then prisoners And the saids Lords of his majesties privie Cowncell haveing this day considered the depositiones of the wittnesses with a petitione given in be the said David Huttone Defender The Councell finds the lybell Sufficiently proven And therfore have Deprived and heirby deprives the said David Huttone of his office of Baillie in the said burgh of Dysert And appoints the rest of the magestrats and present Councell of the said burgh to meet and elect another baillie in his Stead for this current yeir Jaj vic and nyntie Six betuixt and the Second day of febrwary next to come And Decernes and ordaines the said David Huttone defender to make payment to the saids persewars of the soume of Ane Hundereth pund Scotts money which the Councell modifies in place of the expensses debursed and sustained be them in this proces The perseuars allwayes makeing payment of the wittnesses expensses adduced in this proces owt of the foirsaid soume And ordaines Letters of Horning on fifetein dayes and other executorialls needfull to be Direct heiron in forme as effeirs

Anent the petitione given in to the Lords of his majesties privie Counsell Be William Lord Forbes Sir Alexander Forbes of Tollqwhen and others the relationes and freinds of Margorie Forbes now Lady Dowager of Drwm in name and behalf of the said Lady And She for herself Shewing That wher Alexander Irving of Mwrtle pretended air of Taillie to the estate of Drwm haveing bein so farr concerned at the news of the said Ladyes being with child that he wsed all the methods in his power to occasione her abortione particularly by Swch representationes to the saids Lords of privie Counsell anent her being with chyld as few woemen of Spirit, especiallie in her conditione could Safely bear which nevertheles the saids Lords ther Justice did so order that by ther deliverance appointing phisitians to report what the Ladyes conditione was All Mwrtles designed course of rwdenes and wndecencie was disapointed als well as his callwminows Suggestiones of The Ladyes not being with child, were baffled by the saids phisicians ther report to the saids Lords of privie Counsell which Mwrtle hes thowght fitt for that cause never to offer or present, tho Long ago sent up, as appears by the missive Letter wnder one of the phisicians hands with the double of the report prodwced with the said petitione, Androw it haveing pleased God to visite the Laird of Drwm by Sicknes so that he is dead The said Murtle, upon report therof hes convocat a bond of armed men to the number of twentie or threttie with Swords gwns Sparrs, forehammers axes and others and wnder Silence of night did soe barbarousely assault and invade the house of Drum while the corpes were yet wmburned that they Scaled the walls, broke up the gates and doors teared of the Locks and possessed themselvs so farr of all the rowmes That The Lady is confyned to a most miserable conditione in a remote obscure narrow corner and no access allowed to her but at ane wndecent and most wnconvenient backentrie so that She is not only in hazard of abortion but Likewayes wnder dread and fear of being murdered by the said owtragiows band of men who carrowze and roar night and day to her great disturbance and terror as the forme of the instrument taken by one of the servants in her name against Murtle theranent produced with the said petitione can testifie And Seing by another Letter wnder the hands of the two phisicians that attended Drwm the tyme of his Sicknes It is evident that the Lady is in hazard of her life als well as of abortione through the bad wseage She meets with And that by these very argwments addwced for Murtle De Ventrie inspiciendo et in possessionem nuttendo altho The Lady were not in the actuall possessione yet She ought to be putt into possessione till by her being brought to bed it appears whit her ane air Shall exist or not She Therfore a factiori ought now to be mentained in the possessione till the tyme of her foirsaid deliverie which is expected once in March And Murtle Should be discharged all attempts and incroachments in the meantyme Especiallie Seing The Lady never refwises the frie wse of the house and conveniencies therof till the solemnitie of buriall be over As the Said forme of instrwment Likewayes bears Therfor and Seing Murtle as yet hes no Shaddow of pretensione his interest as administrator haveing fallen by the Lairds Decease and his clame as air of taillzea not existing till it appear by the Ladyes being brought to bed whither She brings furth a Sone or a doughter And therfor humbly craveing That the Saids Lords of privie Counsell will continwe to take care of preserveing the hope that ther is of propagateing the familie in the persone of the righteows air of The Lairds own bodie And by ther Deliverance heirupon not only discharge Murtle to attempt possessione of the house And to ordaine him and all his saids complices to remove therfrom imediatly efter the buriall But Likewayes to discharge him from troubleing or any wayes molesting the Lady in her persone or possessione And to direct Letters of Horning for chargeing him to that effect As the said petitione beares Which being this day red and considered be the saids Lords of privie Cownsell They heirby recomend to The Earle of Erroll Shirreff principall of the shyre of Aberdeen And appoints and ordaines Andrew Frazer off Lillmundie his Shirreff depute to visite the house of Drwm And take tryall what trouble or molestatione The Lady hes mett with therin Since her husbands decease and by whom And to remove all persones who have bein the occasione of Such Disturbance And to putt and continue the said Lady in that peaceable possession of the said house of Drwm which She was in the tyme of her husbands decease And that imediatly efter The Laird of Drums buriall Shall be over And in the mean tyme untill the bodie of the said Deceast Laird of Drum be interred that the said house of Drum be open and patent to the freinds and relationes of the familie and others concerned in The Lords of his majesties privie Counsell doe heirby recommend to Sir John Maxwell of Pollock to give in a List to the clerks of privie Counsell of such persones as can give informatione anent the compositiones or transactions made be David Crafurd of Drwmsuey or his deputs or ther Substituts with the importers of Irish victuall And of such persones as should be comissionat to examine them And appoints the clerks of Cownsell to prepare a comissione when they receave Sir Johns note And to present it to the Cownsell
