Act John Mitchell anent Hatts

Anent the petition given in and presented to the Lords of His Majesties privie Councill by John Mitchell Merchant in Edinburgh Shewing That the petitioner haveing commissioned three and ane half2 Dozon of Hatts at London and accordingly bought before the tuenty nynt day of Janwary last and shipped before the first of Febrwary also last as appears by the Bill of Loadning shouen to the saids Lords And which goods cam home in a ship belonging to James Law upon the third of March instant which goods the petitioner being now to enter The tacksman refuse to receave the samen as being prohibit by the late act of parliment And Therfore Craveing to the effect aftermentioned As the said petition bears The Lords of His Majesties privie Councill haveing considered the above petition given into them by the above John Mitchell with the Bill of Loadning mentioned therin and produced therwith They heirby give order and warrand to the Tacksment of Her Majesties Customes their Collectors Clerks surveyers waiters and other servants to suffer the said petitioner to enter the above three Dozen and ane half of Hatts the petitioner paying the ordinary duty therefore

Act anent Mistress Jean Wallace her Custodie and Education2

Anent the petition given in to the Lords of His Majesties privie Councill by Sir Thomas Wallace of Craigie Craveing That their Lordships would ordains Mrs: Jean Wallace to whom the petitioner is nearest agnat being Uncle on the Fathers side To be Delivered to the petitioners custodie and keeping for her Education on the true protestant Religion Specially and so much the raither that it is very weell knowne how the petitioners brother was Influenced by the same Childs mother to continue in his seduction and therafter prevailled wpon by this Lady Pitfoddells to make a second papist marriage, How it his bein the Ladies constant andeavour to breed up this Child not onlie in her oune popish errors but in ane utter aversion and aborrence of all her fathers protestant Relations As the said petition at more length bears which petition being wpon the threttein day of March instant read in presence of the saids Lords and ansuers made therto for the Lady Pitfoddells They Appoynted a Committie of thier oune number to meet and speak with the said Sir William Wallace3 and the Lady Pitfoddells and to endeavour to setle and agree them anent the place wherin the above Mistres Jean Wallace is to be Educat and brought up and likewayes to speak to them anent the said Mrs Jean Wallace her Choosing of Her Curators with pouer to them to order where she shall be sequestrat in the mean tyme Which Committie haveing this day mett They conforme to the pouer given to them by the Lords of His Majesties privie. Councill Doe heirby give order and warrand to William Biggar of Wolmet or any other person in whose hand the said Mrs Jean Wallace may be To Deliver in to the hands and house of John Hamilton of Halcraig one of the senators of the Colledge of Justice The person of the said Mrs Jean Wallace Daughter to the said unquhill Sir William Wallace of Craigie to be Educat and brought upon the protestant Religion

Act Thomas Sivewright for Importing some prohibit goods

Anent the petition given in and presented to the Lords of Her Majesties privie Councill by Thomas Sievewright Merchant in Edinburgh Humblie Shewing That where the said Thomas Sivvewright haveing at or before the fyftein day of november last bypast Commissionat for a Certain small parcel of Merchant goods to London Consisting of a litle Box with small tin buttons Item a small parcell of Hair plush Item a litle Box with Cotoon, tapes and Ribbons and silk lupine which goods were put on board James Law skipper of Leith his ship before the tuenty third day of Janwary Last as his bill of Loading shouen to the Lords of privie Councill did testifie and the saids goods haveing arryved at the Road of Leith the third day of March instant The said Thomas Sevewright went to enter the saids goods att the Custome house of Leith which the Collectors or their Clerks (to the said Thomas his surprise) refused to enter as being goods prohibit by vertue of the late act of parliament dated the thretty first of Janwary last entitled act Dischargeing of sick stuffs and etc But since the said Thomas was willing to make faith that the forsaids goods were Commissionat for And Lukewayes the skiper that they were put on board at the times abovementioned which was long before the act And since if through stress of weather the ship had not bein Forces ashoar she would have aryved six weeks agoe Wherby the saids goods might have bein entered before the promulgation of the act of parliament It was hoped their Lordships would not find that the forsaid goods fell under the Certification of the said act and therfore Craving To the effect aftermentioned As the said petition bears The Lords of His Majesties privie Councill haveing considered the above petition given in to them by the said Thomas Sivewright with the wryts and papers mentioned therin And produced therwith They heirby Give order and warrand to the tacksmen of his Majesties Customes and their Collectors Clerks and others at Leith to enter the above goods presently aboard of the said ship wpon payment of the ordinary Customes for the same In respect the said Thomas Sivewright petitioner hes given a Declaration under his hand That the saids goods conforme to the petition and Bill of Loadning were Commissionat and bought before the thretty one day of Janwary last bypast being the date of the act of parliament dischargeing sick stuffs and etc to be Imported
