The Lords of his majesties privy Councill Doe heirby Recommend to Brigadier Maitland governour of Fort William To allow to the Laird of McIntosh such number of the men in his Garrison of Fort William as he shall think fitt for mantaining McIntosh his possession of his own Lands against Keppoch and others who may disturb him in the peaceable possession thereof contrary to Law.

Decreet

Decreet his majesties Advocate against Mr James Adamson

Anent The Lyble or Letters of Complaint Raised before The Lords of his Majesties privy Councill att the Instance of Sir James Stewart his Majesties Advocate for his highness Interest in the matter underwritten. Making Mention That where By the Laws and acts of Parliament The Invading and Intruding of Pulpits and Kirks where the saids Kirks are legally provided by persons having no warrant To doe the same, as also The despising and Contemning of the sentence of presbetries by baptizing giving the Sacrament and Exercising other parts of the ministerial function, notwithstanding of the presbetries deposition, as also The marrieing of persons clandestinely without proclamation of Bans and conform to the Laudable Laws of the Church are all Crimes of ane high nature and ought to be severely punished according to the Laws and acts of parliaments made against the same, Especialy The act of Parliament Jaj vic nyntie Five against Intruding into Churches without a Legall call or admission Wherby It is statute That whosoever shall so Intrude or Exercise any part of the ministerial function within any paroch shall be Incapable of Enjoying any church or stipend within this Kingdom for the space of seven years, after Removal from the churches Into which they Intrude and from which they are ordained to be removed. And farder It is Recommended to the Lords of his Majesties privy Councill, To take some Effectuall course for hindering ministers deposed from preaching or Exercising The ministerial function after they are deposed, as Likeways The act of parliament Jaj vic sixty on against Clandestine and unlaufull marriadges wherby It is statute That the Celebrators of such marriadges shall be Banished the Kingdom never to return under the pain of Death. Nevertheless It is of verity, That Mr James Adamson once Incumbent att Kiltone near Dumfreis did att his own hand in one or other of the days of the moneths of the year Jaj vic nynty Three Invade and Intrude into the pulpit and paroch Kirk of Eymouth, after The saids Kirk was Legally setled by preaching therein for severall Lords days for which cause The said Mr James being cited before The presbetrie of the Bounds and proving contumacious was discharged to preach within their Bounds And Because of his Contempt of their said sentence by Continueing to baptize and give the sacrament unwarrantablie he was deposed. And yett did thereafter both preach and baptize and give the sacrament In high Contempt of the sentence of the presbetrie and authority of this Church, And farder upon ane or other of the days of the moneth of January February or March in this Instant year Jaj vic nyntie Eight he did presume to marry Clandestinely Mr John Chisholme with Elizabeth Young both Indwellers In Rentoun without any previous proclamation. Likeas It is furder Informed that the said Mr James hath never qualified himself by taking the oath of Alledgance and Assurance conform to the act of parliament Jaj vic nynty Three, And yet presumes to Keep up and preach in meetings in the paroch of Eymouth, Coldinghame and Aytoune infessting these Bounds to the great disquiet of the setled order and peace of this Church By all which the said Mr James being Guilty airt and pairt of The forsaids Transgressions and disorders he ought to be punished therfor with the pains of Law and furder Effectually Restrained for hereafter from Committing any such abuses To the Example and terror of others To Committ the Like in tyme Coming. And Anent The Charge given to the said Defender To have Compeared personally before the saids Lords of his Majesties privy Councill att ane Certan day bygon To have answered to the grounds of the above Complaint and to have heard and seen such order and course taken theranent as the saids Lords should think fitt under the pain of Rebellion and putting of him to the horn with Certification etc as in the principall Lyble or Letters of Complaint with the Executiones thereof at more Length proports. Which Lyble being this day called in presence of the Lords of privy Councill And his Majesties Advocate Compearing personally for his Majesties Interest and the said Mr James Adamson defender Compearing also personally and having acknowledged att the Councill Barr, That he hade not qualified himself by taking the oath of alledgance To his Majestie and signing the Assurance appointed by act of parliament And That he hes preached and married severall persones notwithstanding therof. The saids Lords of privy Councill having Considered the forsaid Lyble with the answers given in by the defender therto with the said Mr James his Judicial acknowledgement and Confession as said is. They find the points and articles of the said Lyble sufficiently proven by the defenders own acknowledgement and Confession forsaid. And Have Banished and heirby Banishes The said Mr James Adamson furth of his Majesties Dominions, And ordains him to Depairt furth therof Betwixt and the Tenth day of June next to come and not To Return therto without the King or Councills orders to that Effect. And In the mean tyme have discharged and heirby discharges The said Mr James to preach marry Baptize or Exercise any other part of his ministeriall function untill he Enter his Banishment as said is. And ordains the meeting-house att Eymouth where the said Mr James preached to be Shutt up and not to be opened again or made use of for a preaching house without the order of Councill, And Recommends To the sheriff principall of Berwick Shire And appoints his deputs to see the samen done, and to take care it be not opened again without order from the saids Lords of privy Councill.

Act Changing Cameron his sentence of death To Banishment

Anent The Petition given in To the Lords of his majesties privy Councill by John Cameron prisoner Shewing Ther Lordships That their poor petitioner is very sensible and sorry for his offence both against God Almighty and the Laws of the nation But his Ignorance and Temptation of the Devill drew him to it and now he First crave God pardon and then their Lordships and Beggs Banishment for Gods sake And Therfore Humbly craving to the Effect underwrittin as the said Petition Bears The saids Lords of his majesties privy Councill having Considered this petition given in to them by the above John Cameron They doe heirby change the sentence of Death pronunced by the Lords Commissioners of his majesties Justiciarie against the petitioner upon the […] day of […] To Banishment, And have Banished and heirby Banishes the said John Cameron petitioner To his majesties plantations in America And ordains the magistrats of Edinburgh To ship the said John Cameron Into The First ships going from Leith to his majesties said Plantation and discharges him to Return within his majesties Dominions at any tyme hereafter, under the pain of having the forsaid sentence of death putt to Execution against him without mercy The said John First Enacting himself in the Books of his majesties privy Councill That he shall depart to his majesties said plantations In America with the First ships going thither from Leith And That he shall never Return to his majesties Dominions without his majesties or the Councills warrant for that Effect under the pain of Having the forsaid sentence of death pronunced against him to be putt to Execution without mercy as said is sic subscribitur Melvill P. The Proclamation underwrittin being Read, was votted approven and signed whereof the Tenor follows:
William By the grace of God King of great Brittain France and Ireland defender of the faith To […] macers of our privy Councill messengers att armes our sheriffs in that pairt Conjunctlie and Severallie specialy Constitute Greeting. Forasmuchas The present cold and Back-ward season Doth Threaten the Scarcity of Victuall so that it it2 appears necessary That there be a Restraint and prohibition of the Export of victuall at Least of Meal oats pease, Barley and bear, wherby the forsaid Threatned scarcity may be the Better prevented. Therfore wee with advice of The Lords of our privy Councill have Thought fitt to prohibite and doe heirby strictly prohibite and discharge The Exporting furth of this Kingdom Either by Land or by sea any of the forsaids Kinds of Grains of victuall: viz meall oats pease Barley or Bear after the day and dait heirof, under all highest pains, To be Inflicted upon the Contraveeners, Either merchants skippers or others whatsomever. The Lords of his Majesties privie Councill Doe heirby grant warrant to his Majesties Advocate To Raise and prosecute a process before the privy Councill at his Lordships Instance against he persons who opened the meeting house at St Ninians after the same was shutt up and closed by order of privy Councill and discharged to be opened again without the Councils orders, and also against such Irregular ministers as have preached att the said meeting house since it was ordered to be shutt up and closed as said is.

The Lords of his majesties privy Councill Doe heirby allow Brigadier Maitland present Governour of Fortwilliam To Bring from Ireland for the use of that Garrison and the out-Garrisons belonging thereto, The number and quantity of one Thousand Bolls meall and ane Thousand Bolls malt. And appoints The said Brigadier Maitland To take sufficient Caution of the Skippers and others who shall be Employed by him, For Importing The said victual, That they shall Import no furder quantity of victual nor for no other use from the said Kingdom of Ireland then the quantity abovespecified. And That the same shall be Employed for the use of the said Garrison of Fort-William and out-garrisons belonging thereto allenarly and no other way.

Act

Act of the Synod of Lothian and Tweddale anent the observation of a Fast with the causes therof

Follows the Causes of the fast.
Edinburgh The sixth day of May Jaj vic nyntie Eight, post meridiem The Provincial Synod of Lothian and Tweddale met here, taking to their Consideration, The Dispensation of God in his providence with respect To the season of the year, in this cold and unkindly spring: Did Judge that God was thereby calling them, and the people under their charge, To solemn Humiliation for averting his Threatned Judgements, And Therfore appointed Twesday The seventeenth of this moneth of May To be observed as a day of solemn fasting and Humiliation in all the churches within The Bounds of the said synod for these causes following: (1mo) That Notwithstanding the Light of the Glorious Gospell shining among us, There is a great Contempt of the Gospell, much Ignorance and ungodliness in the Land, and self-seeking, and Luke-warmness in the matters of God among all Ranks of persons, and profanness and wickedness grow, The shamefull sins of Drunkenness and uncleaness Swearing, Sabbath breaking, The Totall neglect by some and superficial performing by others, of the worship of God, Both in secret and in families, abound in City and Countrey, and by frequent murder Blood Toucheth Blood. (2) That notwithstanding of vows and Engadgements national and personal, and after severe Judgements and signal mercies and after solemn Humiliation people go on in their sins and Continue Inpenitent hard heartede and unreformed. Edinburgh The sixth day of May Jaj vic nyntie Eight, post meridiem The Provincial Synod of Lothian and Tweddale met here, taking to their Consideration, The Dispensation of God in his providence with respect To the season of the year, in this cold and unkindly spring: Did Judge that God was thereby calling them, and the people under their charge, To solemn Humiliation for averting his Threatned Judgements, And Therfore appointed Twesday The seventeenth of this moneth of May To be observed as a day of solemn fasting and Humiliation in all the churches within The Bounds of the said synod for these causes following: (1mo) That Notwithstanding the Light of the Glorious Gospell shining among us, There is a great Contempt of the Gospell, much Ignorance and ungodliness in the Land, and self-seeking, and Luke-warmness in the matters of God among all Ranks of persons, and profanness and wickedness grow, The shamefull sins of Drunkenness and uncleaness Swearing, Sabbath breaking, The Totall neglect by some and superficial performing by others, of the worship of God, Both in secret and in families, abound in City and Countrey, and by frequent murder Blood Toucheth Blood. (2) That notwithstanding of vows and Engadgements national and personal, and after severe Judgements and signal mercies and after solemn Humiliation people go on in their sins and Continue Inpenitent hard heartede and unreformed. Forasmuchas The Holy and Righteous Dispensations of the Almighty God in sending so cold and unkindly a season and seed tyme after Two years scarcity and Dearth, as also The great death of Cattle through most part of the Kingdom and growing dearth and famine Threatned, doe all Express his high displeasure against this Land, and provoke him to multiply and Inflict these and heavier Judgements, as the Just deservings and Effects of the sins abounding in this nation, and of the great Security and Impenitency under them, And Therfore doe certanly call allowd for our own and our peoples deep humiliation, under The mighty hand of God, and our most Earnest and solemn application, by fasting and prayer, for his gracious pardon, and Removeing and averting the forsaids Judgements and turning us Sincerely to the Lord. Upon which Considerations The provincial Synod of Lothian and Tweddale with a Committee of the Commission from the Generall Assembly have Likeways addressed the Lords of our privy Councill, That a day of Humiliation may be appointed and Keeped for the causes forsaids and others mentioned in their said Address Throughout the whole Kingdom Therfore wee with advice of the Lords of our privy Councill Command and appoint a Day of Humiliation, Fasting and prayer To be Keeped and observed within the Bounds of the provincial Synod of Lothian and Tweddale upon Tuesday The seventeenth day of this current moneth of May, and upon the Twenty fifth day of the said moneth for the Rest of the Kingdom upon this side of the river of Tay and Throughout the rest of the whole Kingdom upon the First day of June next to Come upon which days respective, Wee and our people are to be deeply humbled before God, for the manifold sins and Provocations That so openly abound in the Land, and In which men continue still secure and hardened, Notwithstanding of Gods great mercy and Deliverance wrought for us, and of frequent Confessions and former fasts, which yett have produced no Amendment or Reformation, And Therfore To Deprecat his deserved Wrath and to Implore his Mercy and Grace, and That the Lord may turn unto us and Turn us and our people to him and avert the Judgements hanging over us, and other Evills wherewith we are so Eminently threatned and send Kindly weather To cherish the fruits of the Earth for food to man and Beast: Which respective daies of solemn Humiliation and prayer aboveappointed; Wee with advice forsaid Require and Command To be most Religiously and seriously observed by all our people, by publict prayer, preaching and all other acts of deep humiliation and devotion, suitable to the forsaids causes and occasions. Our Will is Heirfore and wee charge yow strictly and Command That Incontinent thir our Letters seen ye pass to the mercat Cross of Edinburgh and to the remanent mercat Crosses of the head Burghs of the severall shires and Stewartries within this Kingdom and their in our name and authority make publication heirof that none may pretend Ignorance. Letter from the King for apprehending of passengers

A Letter from his Majesty To the privy Councill To Issue furth a proclamation Commanding Masters of Ships Bringing home passengers to detain them till they be brought before a Councellour, Sherriff, or Magistrat, That if they be found disaffected or come from France without Licence they may be Keept prisoners till the Councill be acquainted and to Insert penalties, Read and ordered to be recorded. And Recommends to the Earle of Ruglen, Viscount of Tarbat and Lord Advocate, To meet in the Afternoon and to Draw and prepare a Proclamation In the Termes of his Majesties Letter, and to present The same to the Councill against their next meeting, And Declares any Two of the forenamed persons to be a sufficient quorum. Followes the tenor of his Majesties Letter.

Wheras Wee are Informed That severall disaffected persones who did go Into the Kingdom of France during the warr, are Resolving to Return privatly into that our Kingdom The which may prove of dangerous Consequence For Preventing whereof It is our Royall will and pleasure That yow Issue furth a Proclamation commanding and appointing all Masters of ships, who shall bring home any passengers from any Forraign Countrey That they doe detain them untill they be presented unto and brought before one of your number or The Sheriff or magistrat of the place where these ships shall happen to arrive, To the Effect that if the saids passengers be found disaffected or to have been in France without Licence during the warr, or to have been banished Interrcomuned or forfeited or cannot give any good account of themselves That they may be Kept prisoners untill yow are acquainted and shall give such orders as may be necessar. And for making this Proclamation the more Effectuall yow are to Insert therein such pains and Certifications against the Contraveeners as yow shall Judge most propper. For doing wherof this shall be your warrant. So wee bidd yow heartily Farewell. Given att our court at Kensingtoun the 28th day of Aprile 1698 And of our Reign the 10th year.
