Act Allowing Brigadier Maitland, To Import 600 Bolls of meal and malt, For the use of the garrison at Fort William

The Lords of his majesties privy Councill Doe heirby grant liberty to Brigadier Maitland Governour of the Garrison of Fortwilliam And allows the said Brigadier (notwithstanding of ane Proclamation of Councill or clauses therein) To Buy victuall in any shire within this Kingdom, For the use of the said Garrison at Fortwilliam and the out Garrisons belonging thereto, not Exceeding the number of Three Hundered Bolls meall and Three Hundered Bolls malt, with power to transport the said victuall from the shires within which it shall be Bought to the said Garrison at Fort William, And discharges The Commissioners of Supply and all others to trouble or molest them or these Employed by them in transporting thereof.

Act Explaining a clause in the Proclamation anent Setting prices upon Victuall

Sir Gilbert Eliot one of the Clerks of privy Councill Having Represented to the Board That he hes Receaved a Letter from the Earle of Tullibardin Desireing That there be Three more Commissioners for the Shire of Perth, added to these named in the proclamation for setting prices upon victuall, And desyreing to Know if the clause in the said proclamatione, Giving power to the Commissioners of Supply to Retain victuall in each Shire, where they find the Shires Stand in need, and not to suffer the same to be Exported out of the shire, whither the same be a Generall clause relating to all shires in the Kingdom, or only particular relating To the northern Shires. The Lords of his Majesties privy Councill being Informed That the Commissioners For setting prices upon victuall in Perth Shire are to meet upon Twesday next, Superceed to add any to these Commissioners named in the proclamation till it appear what shall be done at the meeting of these commissioners named in the Proclamation upon Twesday next, And declares The clause anent the not Suffering victuall to be transported out of the Shires, not to be a particular clause, relating only to the Northern Shires, but to be Generall, Relating to Each Shire in the Kingdom conform to the words of the proclamation.

Act In favours of Mungo Campbell of Burnbank

Anent The Petition given in to the Lords of his Majesties privy Councill By Mungo Campbell of Burnbank Shewing That their Lordships petitioner having obtained ane precept from The deceast Lord Cardross upon James Campbell of Keranoch (Then Collector of the vacant stipends of Gargunock paroch) for Fourty pounds Scots To be applied towards the building The one half of a Ferrie-boat on the water of Forth betwixt the parishes of Kingcairne and Gargownock That River not being foordable their, and the said Lord Cardross having dyed before the payment of The said precept was obtained The said Collector Refuses to pay the same without their Lordships authority be Interponed thereto. And Therfore Humbly Craving to the Effect underwrittin as the said Petition Bears. The saids Lords of his majesties privy Councill Having Considered this Petition given in to them By the above Mungo Campbell of Burnbank with the precept mentioned therein And produced therewith They heirby give order and warrant To the abovenamed James Campbell of Kernoch To make payment to the Petitioner of the above soume of Fourty pounds Contained in the forsaid precept and ordains Letters of Horning on six days and others needfull To be direct heirupon In form as effeirs.

Commission To Thomas Richardson For seasing Irish Catle

The Lords of his majesties privy Councill Having Considered The act of parliament dated The Fourteenth day of June Jaj vic Eightie six and proclamation of privy Councill of the Thritteenth of March Jaj vic nyntie four years Discharging the Importing of Catle from Ireland Doe for the Better Execution thereof and making the samen more Effectual Grant full power warrand and Commission To Thomas Richardsone writer In Edinburgh by himself his deputs and servants and such as he shall think fitt to appoint for whom he is to be answerable To search for seize and apprehend all Irish horse and Catle, That is all horse mares nolt and Sheep or other Cattell That shall be Imported Into this Kingdom from and after the day and date heirof and that att any port harbour or other pairt of the Coast Betwixt the Firth of Salluay and the Town and Shire of Air and further into the Sound of Mull Inclusive with Liberty To him and his forsaids To seize upon any such horse and Nolt That he cann find resett Besouth the River of Forth And to cause value and Comprise the samen And to Exact the penalty of Ane Hundred merks Scots for each beast Imported after the day forsaid, from the Importer as also from the Resitter conform to the said act of parliament The one half of the value both of Beasts and fine To be made furthcoming to the Lords Commissioners of his Majesties Thesaury for his Majesties use, and the other half to belong to the said Thomas Richardson and his forsaids as the said act appoints And sick like They heirby Grant full power warrand and Commission To the said Thomas Richardson to make Exact Enquire and search anent whatsoever persons That have Imported any of the forsaids Irish Cattle since the said proclamation of Councill of the date The Thirteenth day of March Jaj vic nynty four years within the Bounds of forsaids and to prosecute them as also the Resetters for their Transgression of the said act and the pains thereof Conform to the said act in all points And The saids Lords For the saids Thomas Richardsone and his forsaids their Encouragement and Expence in faithfully prosecuteing this present Commission. Doe not only allow him the Kings half of the saids seisures and Fines by and attour what may belong to him as apprehender or discoverer But Likewise Recommends him to the Lords Commissioners of his Majesties Thesaury For the soume of Ane Hundered pounds sterling he always Imputeing payment thereof what he shall actually receave of the Kings pairt as said is. As also he before Extracting heirof Giving Bond and finding sufficient Caution for himself and forsaids acted in the Books of privy Councill for their faithfull performance of the premisses under the penalty of Two Hundereth pounds Sterling And declares this Commission shall Endure During the Councills pleasure and no Longer. Proclamation against Importing of Irish Catle or resetting thereof

The Proclamation underwrittin being read was voted approven and signed, and ordered to be Recorded whereof the Tenor follows.
William By the Grace of God King of great Brittain France and Ireland defender of the faith: To; […] macers of our privy Councill messengers att armes, our sheriffs in that part Conjunctlie and Severallie specialy Constitute Greeting: Forasmuch as by the fourteinth act of the Parliament holden in the year Jaj vic Eightie six, It is Expresly Enacted and ordained that no horse, mare, or Catell whatsomever, shall be Imported from Ireland to this Kingdom under the pain and penalty of forefalture of the horse mares or cattell that shall be Imported. And further of paying the soume of One Hundred merks Scots for Each beast That shall be so Imported The one half of both the Beast and fines To belong To the Seizer and discoverers and the other half to his Majesty As Likewise That no person within this Kingdom resett or Buy any horse, Mares, or Nolt, That they know to be Imported out of Ireland under the pain of Ane hundered merks Scots for each Beast, besides the forfaulture of the Beasts themselves The one half to belong to the discoverer (he alwise pursueing and Instructing the Importation within six moneths after) and the other half to his Majesty: And wee being Resolved That due and Exact obedience should be given to the forsaid act of parliament for the tyme to Come, and that the same shall be Execute with all rigor against such as Transgress The same Therfore wee with advice of the Lords of our privy Councill In pursuance of, and conform to the forsaid act of parliament Strictly prohibite and discharge The Importing of any horse Mares, Cows or other Cattell from Ireland into this Kingdom Either by the Natives thereof or Inhabitants in Ireland or any other Forraigners whatsomever and all persons to buy or Resett any horses mares, or Nolt, That they Know to be Imported out of Ireland after the day and date heirof under the pains abovementioned Respective contained in the forsaid Act of Parliament for Importing buying or resetting any horse, Mares or nolt, Imported from Ireland contrary thereunto. William By the grace of God King of great Brittan France and Ireland defender of the faith To […] macers of our privy Councill pursevants messengers att armes, our sheriffs in that pairt Conjunctlie and Severallie specialy Constitute Greeting: Whereas Wee are Informed That severall disaffected persones who did goe into, or remain in the Kingdom of France during The Late warr contrary to the Late act of parliament made thereanent, are Resolving to Return privatly into this our Kingdom. Therfore and for preventing any Inconveniency That may arise thereupon, Wee have Thought fitt with advice of the Lords of our privy Councill To Command and appoint all masters of ships who shall bring home any passengers from any forraign Countrey after the date heirof. That they doe detain them And Take security of them for the Effect afterspecified untill they be presented unto and brought before one of the members of our said privy Councill or before the Sheriff Stewart, Lord of Regality, or Bailie of the Bounds within the which The said ship shall happen to arrive, or their Deputes, or before the Magistrats of the Burghs or Ports att which the saids ships may arrive as said is, That the saids passengers may be by them Examined and if the saids Sheriffs and other officers of the Law and their Deputes or the forsaid Magistrats shall find the saids passengers or any of them to be disaffected To us and our Government or to have gone to, or remained In France Contrary to Law during the said Late warr, or to have been Banished Intercommuned or forfaulted, or that they cannot give a good account of themselves, That then and in that caice The saids sheriffs and other officers of the Law and Magistrats forsaids make and Keep the saids passengers prisoners untill they acquaint The saids Lords of our privy Councill and Receave from them such orders as the shall think fitt to give in this matter: Certifieing all masters of ships and also all the saids sheriffs, stewarts, Lords of Regality, Baillies and their Deputes and magistrats of the Burghs and ports forsaids who shall not observe, or who shall Contraveen the premises, That they shall be proceeded against before the Lords of our privy Councill and by them punished with all Rigour. Our Will is Heirfore And wee charge yow Strictly and command That Incontinent These our Letters seen ye pass to the mercat Cross of Edinburgh and to the mercat Crosses of the Remanent head Burghs of the severall Shires and Stewartries within this Kingdom and There in our name and authority by open proclamation make Intimation heirof that none pretend Ignorance. And ordains these presents To be printed. Givin under our Signet att Edinburgh The Eleventh day of May and of our Reign the Tenth year 1698. Sic subscribitur.
