Anent the petitione given in to the Lords of his Majesties privie Councell By Mr Andrew Burnet Late Minister at Aberdeen Sheuing That wher by sentence of the Current Parliament in the Last session upon the first of Jully Jaj vjc nynty five The petitioner was depryved of his benefice and Discharged the exercise of his ministeriall functione uithin this kingdome and Imprisoned untill he Enacted himself not to Goe to the other syde of Forth after the first of August Last bypast To which sentence the petitioner hath given full obedience and hath Lived with his family at Edinburgh these nyne months bygone as became a Deutifull subject without giving any Ground of offence aither to Church or state But his suddaine removall from the north obleidging him to Leave all his affairs ther in confusion and any mean of subsistance he hath for his family being scarce sufficient to mantaine them att Edinburgh the one halfe of the year he is redacted to Great straits and difficulties And therfore Humblie Craving their Lordships uould Consider the premisses And seing the petitioner hath ouned his Majesties Government even since his accession to the throne And never designed to have given the Least offence to any Concerned therin And is willing to Enact himself under the highest paines not to Give the Least disturbance to Church or state But to Live in his privat statione as Becomes That therfore their Lordships would allow him to Live with his family in the north or to goe thither as his necessary occasions requyre For Looking after the small means of subsistance for his family as the said petitione bears The Saids Lords of his Majesties privie Councell Having Considered this petitione given in to them by the said Mr Androw Burnet They heirby Recommend to Sir James Steuart his Majesties Advocat to Consider the sentence or Act of parliament pronunced against the petitioner with pouer to his Lordship to allow the petitioner to Goe north for some tyme to doe his affairs In caise he shall find the same to be Consistent with the said sentence of parliament

Anent the petitione given in to the Lords of his Majesties privie Councell By Hugh Rian and Mr Robert Monroe prisoners in the tolbooth of the Cannongate Sheuing That wheras the petitioners being apprehended by the officers of Collonell Hill Governor of Fortwilliam in Inverlochie were Confyned uithin that garrisone for severall weeks And by the said Collonell Hill his orders Conveyed to this prisone wher they were Committed by order of Major Generall Livingstoun And have remained here since the Eleventh day of march Last In a Condition to be Compassionat In regaird of their bad health occasioned through the want of wholsome air and other necessaries they were accustomed to in the north And Collonell Hill alleadged to the petitioners that they were Called hither by the Councell and Advocat as persons that troubled the peace of the Government yet since nothing hes or Can be made appear against the petitioners They having Lived severall years in this kingdome peacably not doing anything that had the Least tendency to the Disturbance of the Government And therfore Humbly Craving their Lordships to order the petitioners Liberatione upon their Enacting themselves to Continow still peacably But if it be their Lordships pleasure to send them off this Kingdome only the petitioners Humbly Intreat their Lordships to allow them a Competent tyme out of prisone to prepare themselves for their transportation rather then dye in prisone which will unavoydablie follow on the on if not on both if they be detained Longer in prisone As also to free them from paying the prisone Dues In regaird they are Indigent persons as the said petition Bears The Saids Lords of his Majesties privie Councell Having Considered the above petitione They heirby Give order and warrand to the Baillies of the Cannongate and Keeper of their tolbooth To sett the petitioners at Libertie furth therof In respect they have enacted themselves in the books of his Majesties privie Councell that they shall depairt furth of his Majesties Dominions and shall saile with the first shipps which shall Goe from this kingdome to Holland or to any other place belonging to his Majesties allayes And that they shall Return testificats to the Councell of their Landing and the places at which they shall be Landed att

Sir Robert Cheyslie Lord provost of Edinburgh Having acquanted the Lords of his Majesties privie Councell That […] one of the souldiers for recruits who was transported from the castle of Edinburgh to the tolbooth of Leith Is since his coming to the said tolbooth removed by death and that […] another of the saids souldiers Is become Lame and not fitt for service And therupon being Left by the officers Is sett free from prisone to begg for his Livelyhood The saids Lords Doe heirby approve of what the Magistrats of Edinburgh hes done in this matter And Doe heirby Declare them and the keeper of the tolbooth of Leith to be free of any thing which may be Laid to their charge upon account of the saids tuo souldiers any manner of way
