Act Johnstoune postmaister of Haddintowne

Anent the petitione given in to The Lords of his majesties privie Counsell be William Johnstowne postmaister of Haddingtowne Shewing That wheras by the comon Law and Lawes and practices of this realme such persones as are imployed in important services for the benefite of mankynd which requyre haist and Dispatch injoy Severall priviledges and are fried from severall burdens wherunto other men are made Subject As the whole incorporatione of chirurgeons are frie from watching and warding within burgh Likeas by severall acts of parliament especiallie by the 153 act of the twelve parliament and the 275 act of the fiftein parliament of King James the sixth and the […] act of the third parliament of King Charles the Second A persone of ilk craft imployed in his majesties service is exeemed from all Stent and burden with in burgh And in respect that the petitioner is imployed in his majesties service as postmaister of Haddingtoune wher the petitioners imployment requyres the greatest attendance And his majesties affairs often requyre the greatest dispatch which are freqwently retarded and impeded upon occasioen of the particulars following In the first by being made Subject to qwartering when Souldiers are qwartered in the towne wherby the petitioner aither hes no rowme left att all for Noblemen or gentlemen who are goeing by the post or express or the Same are so incomoded by the noise of those who are qwartered upon the petitioner That Such honorable persones can injoy no rest in the post house Secondly the petitioner is impeded in his majesties Service for want of a power to press horses althowgh his majesties most urgent affaires Should peremptorly requyre the Same Thirdly wheras the petitioner hes agried with two or thrie persones to provide good and Sufficient horses for the Service of his majesties Leidges and discharge of his office yet these are called for freqwently by the magistrats and by ther order the owners are compelled to give out Such horses for the wses they think fitt without any previows notice given to the petitioner By which means he depending upon his being Served by the saids horses is freqwently Disapointed nor can he expect it to be otherwayes wnles The Saids Lords ordaine intimation first to be made to the petitioner that he may declaire whither he hes imployment in the Service of his Statione befor they be otherwayes taken up Lastly the petitioner is Called away and Diverted from his Service by the Saids magistrats requyreing him to attend them when they goe to burialls or Such other publict occasiones wnder the penaltie of ten pund Scotts toties qwoties All which tends to the great Discouragement of the petitioner and detriment of his majesties service wnles The saids Lords provide remeid And therfore humbly craveing to the effects eftermentioned As the said petitione bears Which petitione being this day red and considered be the saids Lords of privie Counsell They heirby recomend to Sir Thomas Livingstowne comander in cheife of his majesties forces within this kingdome to consider that point therof anent the qwartering of Souldiers upon the petitioner allenarly with power to him to Doe therin as he shall find Just

Anent the petitione given in to the Lords of his majesties privie Counsell be Mr James Gordone minister of the gospell Shewing that the petitioner haveing ever Since the yeir Jaj vic nyntie two Served the cure at the kirk of Foverane till of Late that he Did Dimit and renunce any title or interest he might have in the foirsaid church Conforme to and Dimissione under his hand now lyeing befor the saids Lords The Stipends were pairtlie payed to the petitioner and pairt of them remaine as yet unpayed And which the parochiners are willing to pay to the petitioner upon the saids Lords interponeing ther warrand for that effect And now Seing that the petitioner hes constantly and carefullie waited on the cure of the said church for the yeirs befor mentioned Wherby it is Just and eqwitable that the Stipend Should be applied for exonering the mentainance of the petitioner and his family Dureing that tyme And Seing he is content that nothing be extracted till the petitioner obtained The Earle of Marishall who is patron his consent ther anent And therfor humbly craveing to the effect eftermentioned As the said petitione bears which being this day red and considered be the saids Lords of privie Counsell with the consent of the Earle of Marishall The patron of the kirk of Foveran That the petitioner Should have the Stipend of that kirk from Mertimes Jaj vic nyntie two till whittsonday Jaj vic and nyntie Six yeirs They Doe heirby allow to the petitioner the Stipend of the Said kirk of Foverane frae the said terme of Mertimes Jaj vic nyntie two to the Said terme of whittsonday next to come in this instant yeir of God Jaj vic nyntie Six And decernes and ordains him to be readiely ansuered obeyed and payed therof be the heretors fewers wodsetters Liferenters titulars tacksemen of teinds tennents possessors and others lyable in payment of the Said vaccant Stipend And ordaines Letters of horning wnder the Signet of Counsell and wthers needfull to pass heiron at the petitioners instance against the heretors fewers and others foirsaids lyable in payment of the Saids vaccant Stipends upon production of a decreet of Localitie and in caice ther be non ordaines the heretors and others foirsaids to make payment of ther respective proportiones of the saids vaccant Stipends according as they Shall be decerned by the Judge ordinary And the Saids Lords doe heirby burden the Saids Stipends with the Soume of Two Hundereth threttie one punds Seven Shilling Scotts And ordains the same to be payed out of the first and readiest therof to the ministers and elders of the presbetrie of Aberdeen for defraying the expenss of the process befor the Councell at ther instance against the said petitioner And ordaines Letters to pass at the instance of the saids ministers and elders in the same way and maner as at the petitioners instance

Anent the petitione given in to The Lords of his majesties privie Counsell Be William Lindsay of Maines George Kennedy of Hallathes and John Mcnaught Stewart clerk of Kirkcudbright Shewing That wher the petitioners haveing intrusted Gilbert Maxwell merchand in Dumfreise with the collecting of the excyse of Nithsdale Annandale and Stewartie of Galloway wherof they were taxmen and the said Gilbert never haveing found cawtione and not haveing cleared the tack duety albeit by the abreviats Signed with his hand produced with the said petitione It is apparent that he hath collected als much as will pay the tack Dwetie wherby the petitioners have reasone to Suspect that he is either lapsws bonis or in meditatione fwgae And as the petitioners is informed He is presently intending for Ireland And therfore Humbly craveing the saids Lords to grant warrand to the magistrats of Dumfreise to Secure the persone of the said Gilbert Maxuell ay and whill he find Sufficient cautione to hold compt for his intromissiones and make payment therof as Law will As the Said petitione bears Which petitione being this day red and considered be the saids Lords of privie Counsell with the abreviats Signed be the above Gilbert Maxwell his own hand mentioned in the said petitione and produced therwith They heirby Remitt to the Magistrats of Dumfreise to call for and examine the said Gilbert Maxuell and to take tryell if he be goeing to Ireland or any other place out of this kingdome with power to them if he be goeing furth of the Same to comitt and Detaine him prisoner ay and while he give Satisfactione to the petitioners anent the Debt resting be him to them for the publict excyse conforme to the Saids abreviats or that he find Sufficient cautione to the petitioners for that effect

Anent the petitione given in to the Lords of his majesties privie Counsell be Patrick Howstowne and pairtners Shewing Forasmuch as the said Patrick Houstoune and James and William Walkingshawes William Crafurd and James Corbett merchands burgess of Glassgow his pairtners have entered into a contract of Copairtnery for setting up and erecting in the burgh of Glasgow or some other convenient place on the river of Clyde a manwfactorie for Spining and makeing of all maner of Cabbles and all other cordage great and small fitt for shipping and navigatione and of all other white cordage for serveing the Countrie and to bring in workmen natives or Forraigners Skilled and able in the said airt with all instruments and materialls needfull and to bwild workhouses Storehouses and others Suteable and expedient to this designe And to doe all other things needfull for carieing on the Same And for this effect to advance and Stock in each of them for ther equall pairts the Soume of Fourtie thousand punds Scotts or more as Shall be condescended to by them As ther said contract more fullie proports Which work and manufactorie will be of Singular advantage for the publict good of this kingdome And Seing that his majestie and the estates of paraliment by the 40th act of parliament Jaj vic Sixtie ane intituled act for erecting of namwfactories Did for the notable advantadge and ends therinspecified grant to all Such persones as Should wndertake to Sett up any manwfactories the particular priviledges therin enumerat And furder by the twelve act of the parliament Jaj vic eightie one Intituled act for incouradgeing trade and manufactories ratifie the former act in most ample maner And therby expressly awthorizes The Lords of privie Counsell to Declaire these manufactories allreddy then sett up or that herefter Should be Sett up to be Such to the effect they may enjoy the priviledges Liberties and immwnities granted by the Said act of parliament And therfor humbly craveing to the effect eftermentioned As the said petitione bears The Lords of his majesties privie Counsell haveing considered the above petitione given in to them be the said Patrick Houstowne and his pairtners with the contract of Copairtnershipe mentioned therin and produced therwith They heirby erect the above work into a manwfactorie of Cables Cordage and ropes And Declaires the Same to have the whole priviledges Liberties and immwnities particularly and generally granted be the above act of parliament and the Same belong als fullie and effectually to the pairners Said manufactorie themselvs and Servants imployed by them as if these men had bein estaiblished by ane express act of parliament And as all the foirsaids priviledges Liberties and immwnities were particularly and expressly herein Sett Downe and granted or that any other awthorized manufactorie within this kingdome hath or death enjoy conforme to the said act of parliament dispenseing with the generalitie heirof and holding and willing the Same to be als good valid and effectuall as if the saids haill priviledges Liberties and imwnities were heirin expressly enumerat Att pronounceing this interloquitor The Counsell reserved to the manwfactorie of at Newhaven or els where to be heard in Jwny next if they have thing to object against this And the petitioners to ansuer

A Safe conduct to Archibald Grahame of Killmanan And Hugh called Mcgregor his servant to attend the Lords of his majesties privie Counsell or ther comittie upon the second Day of Jwne next anent affairs of the government was signed by a qworum And the saids Lords recomends to Mr Francis Montgomerie one of ther own number to transmitt the extract of the said safe conduct to The Laird of Luss to be by him transmitted to The said Laird of Killmanan And appointes The Laird of Luss to transmitt him to Mr Francis Montgomerie the ansuer which he shall receave from Killmanan with ane accompt of what becomes of the Safe conduct And recomends to the said Mr Francis Montgomrie and to report to the Counsell what returne he shall receave from the Laird of Lwss in this affaire
