Decreet

Interloquitor anent seazed horses

The Lords of ther Majesties privy Councill haveing Considered the Report of the Comittie anent seazed horses They Approve of the said Report as to ther keeping still of the horses taken from the Viscount of Oxinfoord, Lady Rosline, Lairds of Scatsbuss and Gosfoord, Sir John Ramsay and Mathew Hamilton And Aproves of the Disposall of the horses taken from the Laird of Spott as in the Report and appoints the horsses taken from Colstoune to be delivered to my Lord Beilhaven upon his Lordships recept Appoints the horses belonging to the Lairds of chatto Hayning, stobbs, and Graden and Baillie Maitland to be keeped as in the report, As to the four horses belonging to the Laird of Ferningtoune Appoints these horses to be given back if they be within the value of ane Hundred merks a peice and if they bae above that value appoints them to be given back upon Fourningstounes qualifieing himself in the termes of the proclamatione mentioned in the report Otherweys Appoints them to be keeped as in the Report, Appoints Hary Sinclairs horss to bee keeped as in the report Approves of the Report as to Alexander Dalmahoy and Hew Inglis horses, and approves the armes seazed with the horses to be disposed of according as the horsses shall be Disposed.

Warrand for giveing back the sheriff Court books of Stirling

The Lords of their Majesties privy Councill Doe heirby give order and warrand to their Clerks To deliver up the Register book of the shireff Court of Stirling which was produced in thar hands verifieing what persones in their shyre have taken the benefit of their majesties act of Indemnitie the Originall oathes being insert in that book And that in Respect ther is a Compleit extract of all that concernes the said affair in the said book under the hands of the shirreff Clerk Lying in the hands of the Clerks of Councill.

The Councill also Allowed the Lord Hatton to goe from this toune to attend the Randevouze of the heritors and fencible men in this shyre of Edinburgh he allwayes returning once on Thursday nixt.

Comittie anent Mr Bruce minister at Pittenweyme

The Lords of their majesties privy Councill being informed that ther are some ministers sent from the united presbytries of Couper and St Androwes to attend the Committie of Councill formerly appointed to Conferr with the ministers which should come from the saids presbytries upon the subject matter of Mr Bruce minister at Pittenweyme his petitione who have been some dayes at this place to have attended the said Comittie viz The Lord Fontonhall and Sir Robert Sinclar of Stivensone who are justly in the Countrey They Nominat the Lord Viscount Stair and Lord Raith Thesaurer depute to Conferr with the saids ministers and Report.

Act Thomas Stewart

Anent a Petitione given in to the Lords of their Majesties privy Councill be Thomas Stewart prisoner in the Tolbooth of Edinburgh Shewing That quher he being taken prisoner in the west and sent to this toune by the duke of Hamiltone with ane partie of horse guards his Grace was pleased to send four pound sterling of Current money which he at the tyme had of his oun upon him, And cause seall it in a Purse and gave it to the Captaine of the partie to be delivered be him to the saids Lords for the petitioners mantinance whill the petitioner should be tryed of the cryme laid to his charge, And now being fully perswaded that the said Captaine would not Disobey the Duke his Order in delivering the same to the saids Lords to be bestowed upon the petitioner that he therby might be preserved from starving for since the petitioner came to prisone he hade gotten nothing less nor more to save his Lyfe these dour dayes by past wherby he is in the point of starving And Therfore Humbly Craveing the saids Lords aither to give a part or all his money to the bearer in his name seing his Conditione was miserable and indigent and beggs for god sake to grant his desyre and Consider his Starving condition and prevent it as the petition bears The Lords of their majesties privy Councill Haveing Considered this petition given in to them be the above Thomas Stewart They Appoint the Clerks of Councill in whose hands the said money is to deliver to the petitioner such Current money belonging to him as they received from the Comander of the partie who brought him to this place.
