Procedure

Recommendation to the Lord Chancellor to lay befoir the parliament the tumult at Drumfreise

James Earle of Seafeild Lord high Chancellor haveing represented to the Board that besyde the Rable that happened at Glasgow ther has since been severall tumultuary Convocations of people in armes about Dumfreise and other places within the Kingdome who have committed severall disorders and threatned further violence, His Grace her Majesties high Commissioner, and the Lords of privie Councell doe unanimously aggree that ane account therof be laid before the parliament, and recommends to the Lord Chancellor to doe it accordingly In such termes as his lordship shall think fitt.

James [Ogilvie] earl of Seafield, lord high chancellor, having represented to the board that besides the rabble that happened at Glasgow, there has since been several tumultuary gathering of people in arms about Dumfries and other places within the kingdom, who have committed several disorders and threatened further violence. His grace [James Douglas, duke of Queensberry] her majesty’s high commissioner and the lords of privy council do unanimously agree that an account thereof be laid before the parliament, and recommend to the lord chancellor to do it accordingly in such terms as his lordship shall think fit.

Right trustie and right well beloved Cousine and Councellor, Right trustie and intyrely beloved Cousine and Councellors, Right trustie and well beloved Cousins and Councellors, Right trustie and well beloved Councellors, and trustie and well beloved Councellors, Wee greet yow well; Wheras in consideration of the Loyaltie and abilities of our Right trustie and well beloved Sir Alexander Ogilvie of Forglen one of the Senators of our Colledge of Justice, Wee have thought fitt to add him to the privie Counsell of that our Kingdome; It is therfore our will and pleasure, and wee doe heirby authorise and Requyre yow to admitt and receive him into that our privie Councell In the ordinary forme and methode, In such cases accustomed; For doeing wherof this shall be your warrant, And so wee bid yow heartily farwell; Given att our Court att Windsor Castell the Twentie Sevinth day of August Jaj vijc and Six and of our reigne the fyfth year, By her Majesties Command Sic Subscribitur David Nairne.

Whereas in consideration of the loyalty and abilities of our right trusty and well beloved Sir Alexander Ogilvie of Forglen, one of the senators of our college of justice, we have thought fit to add him to the privy council of that our kingdom. It is therefore our will and pleasure, and we doe hereby authorise and require you to admit and receive him into that our privy council in the ordinary form and method in such cases accustomed. For doing whereof this shall be your warrant. And so we bid you heartily farewell. Given at our court at Windsor Castle 27 August 1706 and of our reign the fifth year. Letter from the Queens Majestie to the Councell for adding Sir Alexander Ogilvie of Forglen one of the Senators of the Colledge of Justice, To the privie Councell, Read and ordered to be recorded, and his lordship being present qualified himselfe to her Majestie as a privie Councellor by Swearing the oath of alleadgance, and Subscribing the Same, with the assureance, and the Lord Chancellor did administrat to his lordship the oath de fideli, Therafter his lordship took his place at the Board accordingly, Follows the tenor of her Majesties letter.

Letter from the queen’s majesty to the council for adding Sir Alexander Ogilvie of Forglen, one of the senators of the college of justice, to the privy council read and ordered to be recorded, and his lordship being present qualified himself to her majesty as a privy councillor by swearing the oath of allegiance and subscribing the same with the assurance. And [James Ogivlie, earl of Seafield] the lord chancellor did administer to his lordship the oath de fideli. Thereafter his lordship took his place at the board accordingly. His Grace her Majesties high Commissioner and Lords of her Majesties privie Councell, Doe heirby Repryve Nicolas Lamb Sentenced to death for murdering her own Child from wednsday the thretteinth day of November instant to the second day wednsday of January nixt to come, and discharges the said sentence of death to be putt in execution against her untill the said day, and appoynts and ordains the Magistrats of Edinburgh to see and cause the Sentence of death pronunced against the said Nicolas, be putt in execution upon the said second wednsday of January nixt att the Same place and in the Same maner Contained in the Sentence of Justiciary Sic Subscribitur Queensberrie Commissioner Seafeild Cancellar. His grace [James Douglas, duke of Queensberry] her majesty’s high commissioner and lords of her majesty’s privy council do hereby reprieve Nicolas Lamb, sentenced to death for murdering her own child, from Wednesday 13 November instant to the second day Wednesday of January next to come, and discharge the said sentence of death to be put in execution against her until the said day, and appoint and ordain the magistrates of Edinburgh to see and cause the sentence of death pronounced against the said Nicolas be put in execution upon the said second Wednesday of January next at the same place and in the same manner contained in the sentence of justiciary. Order

Order to the Collector at Port Patrick to delyver up the Earl of Abercornes bond

James Earle of Seafeild Lord high Chancellor haveing represented to the Board that when the Earle of Abercorne Came from Irland to this kingdome his lordship was obleidged to give bond to the Collector at Port Patrick, obleidgeing himselfe to export furth of this kingdome the haill horses brought over with him, and these in this returne, and that noe some of the said Earles freinds who came over with him being to returne to Irland, and to carrie ther horses with them, The said Earle hes given his promise that the rest of the horses brought over with his lordship Shall be exported how soon his lordships bussieness in this kingdome is over, His Grace her Majesties high Commissioner and the Lords of her Majesties privie Councell Doe heirby give order and warrant to Dallrymple Collector and Port Patrick, To give up to the said Earle of Abercorne or his order the bond abovementioned, In respect his lordship hes given his promise in the termes abovespecified, For doeing wherof this shall be the said Collector and all concerned a sufficient warrant.

Order to the collector at Portpatrick to deliver up the earl of Abercorn’s bond

James [Ogilvie] earl of Seafield, lord high chancellor, having represented to the board that when [James Hamilton] the earl of Abercorn came from Ireland to this kingdom, his lordship was obliged to give bond to the collector at Portpatrick, obliging himself to export forth of this kingdom the whole horses brought over with him, and these in this return, and that now some of the said earl’s friends who came over with him being to returned to Ireland, and to carry their horses with them, the said earl has given his promise that the rest of the horses brought over with his lordship shall be exported how soon his lordship’s business in this kingdom is over. His grace [James Douglas, duke of Queensberry] her majesty’s high commissioner and the lords of her majesty’s privy council do hereby give order and warrant to […] Dalrymple, collector at Portpatrick, to give up to the said earl of Abercorn or his order the bond abovementioned, in respect his lordship has given his promise in the terms above specified, for doing whereof this shall be the said collector and all concerned a sufficient warrant.
