Proclamation

Proclamation anent the Staple-port

Proclamation anent the Staple port Read votted approven and Signed and appointed to be published, wherof the tenor followes William by the Grace of God King of France and Ireland defender of the faith To […] macers of our privy Councill, messengers at armes; our Shirriffs in that part, Conjuncttlie and Severallie Specially Greeting; Forasmuchas by a treaty betwixt our Commissioners appointed by us as Marquis of Camphir, And the Commissioners of our toune of Camphir; And the Royall Burrows of this our ancient Kingdome concerning the Continuation and re-establishment of the Staple port of this kingdome within the forsaid toune; The Steple port of this kingdome within the forsaid toune; The Steple port of this kingdom for the Neitherlands is re-established by Contract and Setled at the said toun of Camphir and the said Contract ratified and approven by the Estates of Zeland and the Convention of our Royal Burrows on the one and other parts; And wee being Satisfied that the said Contract is for the advantage of Trade and Comerce of this our ancient kingdom And by long experience it hath been found that the toune of Camphire, Is the most convenient and fitt place to be the Staple port of this our kingdome Have Therfore by a Signatur under our royall hand of the date the twenty day of March One thousand Six hundred Nyntie Nyne Ratified approved and confirmed the Said Contract in its wholl heads clausses and articles And Wee being furder resolved that the same be duely observed by all the Subjects of this our ancient kingdom tradeing to the Unitted Provinces of the Neitherlands, And that all the Standing Lawes and acts of parliament with all other acts of our Councillor Exchequer relateing to the said Staple and acts of Convention of our Royall-burrowes be put to full and vigorous execution for the due and exact observance of the said Steple-port for the futur Did by our former proclamation of the date the Threttie day of the said moneth of March One Thousand Six hundred Nyntie Nyne; Ordaine the Said Staple to be oberved by all our good Subjects in maner amply therin and hereafter expressed And Seing That Notwithstanding of the forsaid establishment of the Staple and proclamation therupon emitted; the Same hath not (as is informed) been duely observed and obeyed; Therfore Wee with the advice of the Lords of our privy Councill Doe hereby Requyre and Command all our Subjects to give due and punctuall obedience to the Lawes and acts of parliament, with all other acts of our privy Councill or Exchequer relateing to the Said Steple and acts of the Convention of our Royal burrows made for the observeing of the Steple port which are all hereby declared to be in full force, And Seing now the forsaid Scots Staple-port is re-established and continued at the said toun of Camphire, Therfore Wee with advice for said prohibit and Discharge all Merchants and Skiper or any other of our Subjects to export furth of this kingdome any goods ware, or Commodities which are or Shall be declared to be Staple-Commodities to any other port or place of the Unitted Provinces of the Neitherlands, but only to the said Staple-port and Town of Camphire in Zeland under the pains and certifications contained in the saids acts of parliament with all other acts of Councill or Exchequer relateing to the said Staple, and acts of Convention of burrows, Which paines and penalties, wee ordaine to be exacted from the transgressors with all rigour, And that they be furder proceeded against As our privy Councill Shall find cause, And wee with advice forsaid doe hereby Requyre the farmers tacksmen or Collectors of our Customes and their Sub Collectors and Surveyors for the time being that they make exact Search and tryall of all Staple-goods and Commodities That Shall be hereafter2 Exported furth of this kingdome; to any part or port of the Unitted Provinces in the Neitherlands, and that they and their Clerks and all the Clerks of Cocquetts take Sufficient Security from the Merchants or Skipers Saillen and transporters of goods to the said Neitherlands; That they shall cary and Liver the same at the said Staple-port of Camphire at no other place nor port within the said Unitted Provinces; and that they shall nor break bulk before their aryveall therat; Conforme to the acts of parliement oblidging the exporters to report Certificats from the Conservator or his deputes at Camphire, bearing that the said Staple-Commodities were livered ther without breaking bulk as they will be answerable to the Lords of our privy Councill theranent And wee doe ordaine the Saids Certificats to be delyvered in quarterly by the Collectors and their Clerks at the Severall ports to the agent of our Royall Burrows or person Commissionat by them in his vice and place for the time, to the end exact dilligence may be done by him against all the transgressors of the said Staple conforme to the Lawes and acts made theranent; And Farder that the said agent or person Commissionat in his vice doe and use exact dilligence in the premisses and give ane exact and particular account thereof to the Lords of our privy Councill, as oft as he shall be by them requyred; Under the pain of Deprivation and such farder paines as they shall think fit to inflict. Our Will is Herefore and wee Charge yow Strictly and Command That incontinent thir our Letters Seen yee pass to the marcat cross of Edinburgh and wholl remanent Royal burrows of this kingdom and other places needfull and therat in our name and authority by open proclamation make publication of the premisses to the effect our Royall Burrowes and all Merchants and other persones may have timeous Notice hereof and give due and punctuall obedience as they will be answerable at their outmost perill; And appoints Coppies to be affixed at the Severall Custome houses and Sea ports of this kingdom That non pretend Ignorance And Ordaines these presents to be printed, Given under our Signet at Edinburgh the Twenty sixth day of September Jaj viic and one years And of our reign the threteinth year. Warrand for transporting John Weir to Flanders to be a Souldier

Anent a petition given in to the Lords of his Majesties privy Councill be John Weir prisoner in the Tolbooth of Edinburgh under the Sentence of death Shewing That wher the poor petitioner was in a most misserable condition and Lyke to Sterve for want of aliement, And the saids Lords haveing in their great goodnes clemency and mercie to the petitioner granted Severall reprives to the saids Lords poor petitioner which he hoped he would never be forgettfull of while he Lived; and also that he should be a new man and never fall in such snairs as formerly he hade done And that if it should pleasure the saids Lords to Change his sentence of death to Banishment wher the saids Lords pleased he should never be seen therafter within this kingdome without express Libertie for that effect And Therfore Humbly Supplicating the saids Lords to the effect aftermentioned as the petitione bears The Lords of his Majesties privy Councill haveing Considered this petition given in to them be the above John Weir They hereby Commutt the Sentence of Death Pronounced by the Lords Commissioners of his Majesties justiciary at Edinburgh from death to Banishment; And the saids Lords Have Banished and Doe hereby Banish the said John Weir furth of his Majesties dominions and appoints him to depart furth therof And Discharges him to returne therto at any time comeing In regaird2 The said John Weir first before extracting hereof hath enacted himself in the books of privy Councill that he shall depart furth of his Majesties dominions betwixt and the Fifteinth day of October nixt to come and that he shall never returne within the same under the pain of haveing the above Sentence of Death peremptorly execute against him, And appoints the Magistrats of Edinburgh and keeper of their Tolbooth to delyver the person of the said John Weir to Captain James Lindsay to be caried abroad by him as a Souldier in his Majesties Service abroad; and also before extracting hereof hath given in to the Clerks of privy Councill ane enactment Subscrybed by him Whereby he enacts himself that he shall goe abroad with the said Captain Lindsay as a Souldier in his majesties Service and not to returne as said is Sic Subscribitur Marchmont Cancelar, Annandale Seafield, Tarbat, Teviot, Rosebery, Montgomry, Hyndfoord, James Stewart.

The Lords of his Majesties privy Councill haveing heard a pitition given in to them be William Cochran of Ferguslie against Robert Semple of Full wood anent the pole money They hereby Remitt to the Lord high Chancelor to Consider the bill of Suspension given in to the said Robert Semple and reasones therof; and to Compare the Collectors books with the recepts mentioned in the bill of Suspension and to pass or refuse the said bill of Suspension as his Lordship shall think fitt.

Proclamation explaining some parts of the Commission for the Justiciary of the Highlands

Proclamation anent the powers of the highland Justiciary Read voted approven and Signed. Wherof the tenor followes
William by the Grace of God King of Great Brittain France and Ireland defender of the faith To […] Macers of our privy Councill messingers at armes; Our Shirriffs in that part Conjunctllie and Severallie Specially Constitute Greeting Forasmuchas by the Commission of Justiciary granted by us under the great Seall for the Highlands and bounds therin mentioned of the date the threty day of May Last by past It is declared that fyve of the Commissioners therin named meetting at the time and place therin appointed Shall be a quorum; and the wholl other Commissioners are requyred to give attendance unless excused for relevant reasones; Under the pain of being removed from the said trust As also by the said Commission the first generall meetting of the saids Commissioners is appointed the first Thursday of September instant to hold Courts and to adjourne and to appoint new dyets as they shall think expedient Likeas by the said Commission two districts are appointed according to the division therin mentioned; with Conveeners for the said districts; Which Conveeners are to appoint the most convenient times for the meeting of the Respective Commissioners, or their quorum at the places therin designed; For clearing wherof and preventing of any Mistake that may arise theranent; Wee with advice of the Lords of our privy Councill; Likeas Wee hereby Declare that any of the Commissioners named in the said Commission for aither of the said districts may and are hereby Allowed to Compear before any of the meetings to be hold by vertue of the said Commission at any time betwixt and the first day of January nixt to come and them to qualifie themselves by Swearing the oath of alledgance and Subscrybeing the Same with the assurance and association as is prescribed by the Said Commission; which Shall be alse good and Lawfull as if they hade appeared and qualified themselves in maner forsaid at the first meetting therby appointed And Requyreing hereby the other Commissioners duely qualified in the termes of the said Commission to admitt and receive them to meet and act as Commissioners As If qualified from the begining as said is Certifieing such of the said Commissioners as Shall not Compear and qualifie themselves betwixt and the forsaid first of January in maner forsaid they shall be excluded from the trust; as if they hade not been named in the said Commission; Likeas Wee with advice forsaid Doe farder Declare that the said Commissioners meeting at the times and places mentioned in the Said Commission have power2 in absence of ther Conveener to adjourn themselves to Such time and place as they Shall See cause without prejudice to the Conveeners therin nominat to call and Conveen the said Commissioners pro re nata As also when present in the said meettings and the whole affairs therto appointed ended and Concluded to adjourn the Court with Consent of the said Commissioners to the day and place of ther nixt meeting As they Shall See cause Our Will is Heirfore and wee Charge yow Strictly and Command That incontinent these our Letters seen yee pass to the marcat cross of Edinburgh and to the marcat crosses of the head burghes of the severall shyres mentioned in our Said Commission of Justiciary; And therat in our name and authority; by open proclamation to make intimation hereof; That non pretend Ignorance; And Ordaines these presents to be printed; Given under our Signet at Edinburgh the twentie fifth day of September and of our Reign the threteinth year 170i Sic Subscribitur.

William by the Grace of God King of Great Brittain France and Ireland defender of the faith To […] Macers of our privy Councill messingers at armes; Our Shirriffs in that part Conjunctllie and Severallie Specially Constitute Greeting Forasmuchas by the Commission of Justiciary granted by us under the great Seall for the Highlands and bounds therin mentioned of the date the threty day of May Last by past It is declared that fyve of the Commissioners therin named meetting at the time and place therin appointed Shall be a quorum; and the wholl other Commissioners are requyred to give attendance unless excused for relevant reasones; Under the pain of being removed from the said trust As also by the said Commission the first generall meetting of the saids Commissioners is appointed the first Thursday of September instant to hold Courts and to adjourne and to appoint new dyets as they shall think expedient Likeas by the said Commission two districts are appointed according to the division therin mentioned; with Conveeners for the said districts; Which Conveeners are to appoint the most convenient times for the meeting of the Respective Commissioners, or their quorum at the places therin designed; For clearing wherof and preventing of any Mistake that may arise theranent; Wee with advice of the Lords of our privy Councill; Likeas Wee hereby Declare that any of the Commissioners named in the said Commission for aither of the said districts may and are hereby Allowed to Compear before any of the meetings to be hold by vertue of the said Commission at any time betwixt and the first day of January nixt to come and them to qualifie themselves by Swearing the oath of alledgance and Subscrybeing the Same with the assurance and association as is prescribed by the Said Commission; which Shall be alse good and Lawfull as if they hade appeared and qualified themselves in maner forsaid at the first meetting therby appointed And Requyreing hereby the other Commissioners duely qualified in the termes of the said Commission to admitt and receive them to meet and act as Commissioners As If qualified from the begining as said is Certifieing such of the said Commissioners as Shall not Compear and qualifie themselves betwixt and the forsaid first of January in maner forsaid they shall be excluded from the trust; as if they hade not been named in the said Commission; Likeas Wee with advice forsaid Doe farder Declare that the said Commissioners meeting at the times and places mentioned in the Said Commission have power2 in absence of ther Conveener to adjourn themselves to Such time and place as they Shall See cause without prejudice to the Conveeners therin nominat to call and Conveen the said Commissioners pro re nata As also when present in the said meettings and the whole affairs therto appointed ended and Concluded to adjourn the Court with Consent of the said Commissioners to the day and place of ther nixt meeting As they Shall See cause Our Will is Heirfore and wee Charge yow Strictly and Command That incontinent these our Letters seen yee pass to the marcat cross of Edinburgh and to the marcat crosses of the head burghes of the severall shyres mentioned in our Said Commission of Justiciary; And therat in our name and authority; by open proclamation to make intimation hereof; That non pretend Ignorance; And Ordaines these presents to be printed; Given under our Signet at Edinburgh the twentie fifth day of September and of our Reign the threteinth year 170i Sic Subscribitur.

The Lords of his Majesties privy Councill Doe hereby give full power and warrand to Sir James Stewart to wryt to the magistrats of Ruglen and to give order to the said Magistrats to Transport Katharin Smith who is prisoner in the said toune for suspicion of Murthering her own Child or accessory therto and to delyver her to the magistrats of Edinburgh or keeper of their tolbooth therin to remaine prisoner till farder order.
