Att Edinburgh The Twenty Third day of September J^aj vi^c nyntie six years

A1696/9/27¹

Act

Act allowing Messengers to take bond from the Collectors of the polemoney against whom they have Captions

His Majesties High Commissioner and the Lords of his Majesties privie Councill Doe heirby allow the Messengers who shall be Imployed to execute the Captions at Sir Patrick Home his Majesties Sollicitors instance Against the Collectors of the polemoney To Take from the respective Collectors of the said polemoney Bonds with sufficient Cautione acted in the books of his Majesties privie Councill That they shall appear before the said Councill and ansuer to what shall be said to their charge anent the said penaltie of five hundreth merks each persone And appoints the saids bonds Immediately upon except thereof to be delyvered in to his Majesties sollicitor or the Clerks of the privie Councill And in case the saids bonds are not Granted Ordaines the Captions to be execute as formerly appointed.

His Majesties High Commissioner and Lords of his Majesties privie Councill Doe heirby Give order and warrand to the Magistrats of Peebles and Keeper of their tolbooth to sett at Libertie furth thereof William Williamsone Shirreff Clerk of Peebles who is Incarcerat therein upon a Caption before the Councill as one of the Collectors of the pole money In respect it appears that the Greatest part of the said pole money of the said Shire is already payed in to the Receavers of the Supplie and pole money Conforme to ane abbreviat theron shouen by Sir Thomas Moncrieff Clerk of Exchequer In respect he hath Given bond and found sufficient Cautione cited in the Books of privie Councill That he shall appear before the saids Lords of privie Councill upon the Nynteenth day of November nixt to Come And ansuer to what the saids Lords shall say to his charge Concerning the said pole money under the penaltie of five hundreth merks Scotts money.

Act The Laird of Hoptoun

Anent the petitione given in to the Lords of his Majesties privie Counsell By Charles Hope of Hoptoune heretabell shireff of the shirefdome of Linlithgow Shewing That whereas It is appointed by Act of parliament that Masters of Game be appointed within the severall shirrefdomes of his Kingdome For putting in executione the Laus and Acts made anent Game and sport And seing that the office of Master of Game is now fallen vacant in the shirrefdome of Linlithgow by the decease of the Late Earle of Linlithgow And therfore humblie Craving to the effect under wryten as the said petitione Bears His Majesties high Commissioner and the Lords of his Majesties privie Councill having Considered this petitione given in to them by the above Charles Hope They heirby Nominat and appoint the said Charles Hope of Hopetoune to be Master of the Game within the bounds of the said Shirrefdome of Linlithgow With power to him to exercise the said office And to Enjoy the prviledges and Emoliments theirby arrysing also fullie in all respects as by the Law of this Kingdome Any master of Game may exercise and Enjoy the same.

Act The Laird of Hoptoun

Order

Recomendation for furnishing 80 souldiers for Captain Burds ship

Sir James Steuart his Majesties advocat having reported to the Councill That Captain Burd who Commands one of the Scotts men of warr his Company Consists only of ane hundreth men whereas the Complement putt upon him by the Admiralty is ane hundred and Eightie men so that he lakes Eightie of the Admiralities Complement And Craves to be provyded for some tyme out of his Majesties standing forces untill his Complement be made up His Majesties high Commissioner and Lords of his Majesties privie Councill Doe heirby Recommend to Sir Thomas Livingstoune Commander in chieff of his Majestes forces within this Kingdome to furnish to the said Captain Burd the said Number of Fourscore men with Thomas Livingstoun to take care that these men be Good and sufficient men And appoints officers to be sent allong with them And ordaines Capgain Burd to furnish sufficient provisions for their aliment during their abode aboard which is to be till the first day of November next to come.
