Complaint Anent Souldiers

Sir Thomas Livingstoune Commander in cheiff of ther Majesties forces uithin this kingdome Declared in open Councell That Having heard some Rumors of souldiers Living disordorly in the Country noe Complaint had hitherto been made to him of any such disordors And if therafter ther should He declared he uould redress them to full satisfactione And in case any persones uould Instruct to him that any souldier is resting payment of meat and drink He uould pay the same himself The Commissaries appoynted by the Lords of Thesaurie being ordored to pay the horse provisiones And furder declared in Counsell that if any should Instruct they Have heretofore Compleaned and uere not redressed He uas content presently to redress the same upon his oune charges

The Lords of their Majesties privie Councell Being Informed that ther is a Commissione directed from the Admirality of England to the Magistrats of Edinburgh for examining uitnesses Anent the shipp seized In the river of Forth and Carryed to England by ane English man of warr or privateers And that among the Interrogatours sent from England to be asked at the uitnesses this is one viz whither or not Scotland be a free natione Independent of the kingdome of England And whither or not the Admirall Court of Scotland be a supream Court Independent of England They Recommend to the Viscount of Tarbat Lord Register and Sir James Steuart their Majesties advocat to see the right wording and extending of the ansuer to the saids Interrogatours

Warrand to the Lord Advocat To pursue Mr Richard Waddell

The Lords of their Majesties privie Councell Being acquanted that uithin the Gates of the Earle of Homes mansione house of Hirsle ther are severall meetings and a meeting House keeped wher Ministers disaffected to and depryved be the Government doe preach And in their prayers doe not pray for their Majesties King William and Queen Mary And that Mr Richard Waddell Late Dean of St Andreus Is one of the said Ministers They heirby Recommend to the Lord Advocat to raise and prosecute a Lybell Against the said Mr Richard Weddell or any other Ministers whom he shall be Informed of as preaching and praying at the said house that they may be punished according to Law And appoyntes the Clarks of privie Councell to make Intimatione to the Earle of Home that the Councell are Informed of these unlaufull meetings that he may stopp them in tyme coming

Anent the petitione Given In to the Lords of their Majesties privie Councell Be Sir John Murray of Drumcairne Sheuing That the petitioner being formerly under baill to appear before their Lordships when called for accordingly He uas charged in the month of May last to appear before their Lordships And upon his appearance was Committed prisoners to the Castle of Edinburgh wher he hath remained ever since To the Great prejudice of his health and ruine and loss of his privat affairs And seing the petitioner hes alwayes Lived quietly and peacably and is Content upon his being sett at Liberty to find sufficient Cautione not only to Live peacably in tyme Coming but also to appear before their Lordships when called for And therfore Humbly Craving their Lordships to take the petitioners case to their Consideratione And to ordaine him to be sett at Liberty upon his finding sufficient Cautione in the termes forsaid The Saids Lords of their Majesties privie Councell Having Considered this petitione Given in to them Be the above Sir John 2 Murray uith a missive Letter from Doctor Ballfoure to the petitioner Acquanting him of the doctors daingerous case And that he is desyrous to putt his Concerns in order which he Cannot doe uithout the petitioners assistance whom He desyres to deall uith their Lordships of Councell for some few dayes Liberty They Hierby Recommend to the Earle of Leven governour of the Castle of Edinburgh and in his absence Gives ordor and uarrand to the Deputy Governour or other Commanding officer ther To allow the said Sir John Murray to Goe from the Castle of Edinburgh to the duelling House of Doctor Ballfour in Edinburgh ther to remaine from Morning to Evening each day for the space of a week under the Guaird of ane of the officers of the said Castle who is to attend the said petitioner from the Castle to the Doctors Lodging to remaine uith him in the same and to Returne each night to the said3 Castle untill the ueek be expyred After which tyme appoyntes the petitioner to Continow prisoner in the said Castle and not goe uithout the same

Act appoynting the dyet of meeting of the Commission for schools and colledges

The Lords of their Majesties privie Councell Considering That by the Fourtie and first Act of the last session of this Currant parliament Anent the Quorum of the Commissione for visitatione of Colledges and schools appoynted by the seventeenth Act of the second sessione of the said parliament It is expressly ordained that Eleven of the persones nominat be that Commissione be a Quorum In place of the Major part formerly appoynted be the said Commissione And that the dyet to which the said Commissione uas adjurned is elapsed uithout meeting theron so that they Cannot meet till a new dyet be appoynted Doe therfore Heirby appoynte the first meeting of the said Commissione To be att Edinburgh the second uedensday of november nixt to Come att ten of the clock in the forenoon And therafter to adjurne themselves from tyme to tyme to such other dyetts as they shall appoynte And appoynts Intimatione heirof to be made to all persones concerned

Anent the petitione given In to the Lords of their Majesties privie Councell Be Charles Earle of Home Sheuing That the petitioner being formerly under Bale to appear before their Lordships when called for Accordingly He was charged in the Month of May last to appear before their Lordships And upon his appearance was Committed prisoner to the Castle of Edinburgh wher he hath remained ever since To the Great prejudice of his health and ruine and loss of his privat affairs And seing the petitioner hes alwayes Lived quietly and peacably And is content upon his being sett at Liberty to find sufficient Cautione to Live peacably in tyme Coming But also to appear before their Lordships when called for And the petitioners health doeth most necessarly Requyre his liberty as Sir Archibald Stevenson Doctor of Medicine uill declare if called and who attends their Lordships for that effect And therfore Humblie Craving their Lordships to take the petitioners case to their Consideratione And to ordaine him to be sett at Libertie upon his finding sufficient Cautione in the termes forsaids as the said petitione Bears The saids Lords of their Majesties privie Councell Having Considered this petitione given In to them Be the above Earle of Home and Doctor Stevensone being Called for And having declared the Earls Indispositione They Heirby Recommend to the Earle of Leven Governour of the castle of Edinburgh And in his absence Gives ordor and uarrand to the deputy Governour or other Commanding officer To sett at Liberty the said Earle furth of the said castle He first Giving his parroll of honour in wryte that he shall appear before the Lords of privie Councell upon the first ordinary Councell day in october nixt And in the mean tyme that he shall Live peacably under and uith all submissione to the present Government of thar Majesties King William and Queen Mary And that he shall not Consult nor Contryve any thing in prejudice therof nor Converss uith any rebells and that he shall not depart furth of the toune of Edinburgh
