Comittie on the Lybell The Lady Bamff against The Lord Bamff and a protectione

The Lybell at the instance of the Kintoir and Leyes trusties for the Lady Bamff Against the Lord Bamff being this day Called in presence of His Majesties high Commissioner and the Lords of privy Councill and the said Lady Bamff and her trusties Compeiring personally with Sir2 James Stewart his majesties advocat and Mr James Scougall ther procurators and the defender Compeiring also personally The Lybell and also a petit[ion] for the defender Craving protection being read and the witnesses being Called two of them viz James Edisone and William Grant Compeiring personally and the Rest of them being Called and not Compeiring his Majesties Commissioner and the Lords of privy Councill Grants farder dilligence by Caption against the witnesses Cited and not Compeiring for aduceing these witnesses before the Councill upon the second Tusday of Jully nixt And Grants personall protection to the said Lord Bamff for the space of fourtein dayes from the date heirof and from the first day of the said moneth of Jully to the fifteinth day of the same inclussive to the effect he may see the witnesses examined and attend the said proces And Discharges any messenger at armes officers and other executers of the Law as weell in burgh as Landward to put any letters of Caption or acts of warding or other dilligence to executione against his persone for the said space of fourtein dayes from the date heirof and from the first day of Jully nixt untill the said fiftein day of the same moneth be first elapsed excepting allwayes for his majesties rents dues and particular burdeins and the two witnesses present having made faith nominats and apoints the Viscount Tarbet Lord Carmicheall and Enstruther to be a Comittie for examining the witnesses Reserves all objectiones to be proponed and discust before the Comittie And Recomends to them to meett the morrow at ten in the fornoon and Declairs any two of them to be a quorum Sic Subscribitur Annandale P. Queensberry Cassills, Rosse Carmicheall, Adam Cockburne, F Montgomry Lodovick Grant John Maxwell.

Recomendation The Lairds of Kelburne and Sornbegg

Anent the petition given in to His majesties Commissioner and Lords of privy Councill be David Boyll of Kelburne and Robert Dicksone of Sornbegg Shewing That quher the petitioners upon the Credit of the late act of parliament anent the pole money Did advance severall soumes of money to sundrie particular persones living within burgh and in the Countrey In Contemplation of the Arreirs due to them by the army and acquered a right from them to their saids arreirs and upon the petitioners haveing therby […] the Clamour of the Countrey for the want of payment of what was resting to them be the army And Likewayes having Supplied the wants and releived the necessities of Severalls to whom present money was of great use, the petitioner in prosecutione of their ryts Caused state the saids accompts Conforme to the said act of parliament before the Commissioners of Supply and after much trouble and Charges bestowed theron the petitioners obtained them to be revised by a Comittie of their Lordships number who haveing made report therof to them quherin a great many articles and the soumes due therby are retrinche’d and Cutt off and when they were given in to the saids Lords for a recomendatione theron to the Lords of thesaury, The saids Lords Thought fitt to delay approveing therof or Recomending the same upon ane apprehensione that the persones from whom they accquired right hade been injured and ther right hade been illicite from them upon missrepresentatione made by the petitioners and albeit it be a Considerable time since these accompts were given in to the saids Lords, And that it is not only knowen to all the Countrey of their punctuall payment hath been made of all the accompts Recommended by their Lordships and that the only obsticle for the2 saids Lords not recomending the transacted accompts were the reasones forsaids yet never any persone hath reclaimed nor made the least insinuatione of any injury done to them or Complained that their rights hade been illcite from them by any sinistreous methode Nevertheless the petitioners for Convinceing their Lordships with what ingenuity and integrety they proceided and to remove all doubt of ground of delay with their Lordships They are Content upon approving and Recomending to the Lords of thesaury the transacted accompts with the rest to find suficient Cautione acted in their Lordships books that They should answer to and satisfie any Complaints that should be made to their Lordships upon the accompt of the saids transactiones by any persone whatsomever according as their Lordships in Justice should determine the samen being but to Continue for a year And Therfore Humbly supplicating the saids Lords to the effect aftermentioned His Majesties high Commissioner and Lords of privy Councill Having Considered this petition given in to them be the above Lairds of Kelburne and Sornbegg They heirby Recomend to the Lords Commissioners of his majesties thesaury To Cause make payment to the petitioners of any accompts formerly recommended by the Councill to the saids Lords out of the polemoney notwithstanding of any former stop, and Declairs that any accompts either revised or not revised be the Committie appointed for that effect given in for the petitioners are to pass and proceid without Impediment in the Comon forme as the accompts resting to any other of his majesties Leidges within this kingdome In Respect the petitioners have given bond and found suficient Cautione acted in the book of privy Councill that they shall answer to and satisfie any Complaints that shall be made to the Lords of privy Councill be any persone whatsomever upon account of the two transactiones made betwixt the petitioners and them anent the accompts resting by his Majesties forces to them Which bond bears this express provisione that the same is only to endure for the space of one year Compleat nixt after the day and date heirof.

Recomendatione The principall and masters of the Marshall Colloge of Aberdein

Anent the petition given in to his Majesties Commissioner and Lords of his majesties privy Councill be the principall and masters of the Marishall Collodge of Aberdein Shewing That wher the edifice of the forsaid Colledge being nowayes suficient for accomodating the students and which has a great stopt and hinderance to ther Learning the petitioners did undertake the errecting of ane new building and hade no encouragment to this save that the nobillity and Gentry in the north Countrey did assist the petitioners with some small Contribution But notwithstanding all the petitioner gott that way they were put to vast charges and expences themselves and all they are able to doe is to bring the forsaid edifice to be rooffed But the same is yet neither Glassed nor floored, And they haveing represented this formerly to their Lordships they were pleased to Recomend to the Lords of thesaury for the stipend of the Church of Foverain then vaccant But all that they gott by this was that they were put to expenses Foveraine and Udney the principall heritors having suspended their gift, and did prevaill in the suspensione against the petitioners, And ther being two Churches of which the King is patron Viz Auchterless and Rossmarkie now vacant and which is also Churches of which the Bishops were formerly patrones, and in which no minister has preached or officiat as incumbent since they were vaccant And Seing ther can be no more pious use then the assisting of the petitioners in a work so usefull Especially seing they were disappointed of ther Lordships former bounty And Therfore Humbly Supplicating the saids Lords to the effect aftermentioned His Majesties high Commissioner and Lords of privy Councill having Concidered this petition given in to them be the above principall and masters of the Marishall Collodge of Aberdeen, They heirby Recomend to the Lords Commissioners of his majesties thesaury to dispose of the vaccand stipends of the above Churches of Auchterless within the shyre of Aberdeen and Rossmarkie within the shyre of Ross in favors of the petitioners for Compleating the above edifice upon ther finding Cautione for the due application of the same.

Act of Banishment Jonet Cook

The Lord Advocat having acquainted his majesties Commissioner and Lords of privy Councill That there is one Janet Cook prisoner in the Tolbooth of Leith for adulterie and incest against whom probatione cannot be found and that the said Lords Commissioners of Justiciarie desyred him to acquaint the said Lords of privie Councill That it is there opinione she might be banished the Kingdome and that the said Janet hes consented to her Banishment conforme to a consent instantly given in to his Majesties Advocat to the Clerks of privie Councill The said Lords of privy Councill in respect of the said Consent have banished and Hereby banisheth the said Jonet Cook furth of this Kingdome and appoynts her to depairt furth of the same betwixt and the first day of July next and Discharges her to returne within the same under the highest pains and penalties that can be inflicted and doe hereby give ordor and warrand to the magistrats of Edinburgh or Leith and keepers of ther Tolbooths to set her at Libertie furth therof in ordor to her said banishment and appoynts the said Janet Cook her Consent to her banishment as said is to remaine in the hands of the Clerks of privie Councill.

Anent the petitione given in to his Majesties high Commissioner and Lords of privy Councill by James Gladstaines of that ilk Shewing That after imprisonment in the Castle of Blackness for a Considerable tyme The said petitioner was liberat with the Laird of Ednem and Confyned to his owne house and two myles about it which the said petitioner hath most exactly observed in all peaceable submissione though to the great prejudice of his affaires in the Countrey and severall Concerns of his at Edinburgh which may be utterly lost to the said petitioners great hurt and damnage unless unless the said Lords ther goodness provyde remedie as hath been done in the lyke Caices and therfore Humblie Craveing in maner and to the effect aftermentioned as the said petitione bears
His Majesties high Commissioner and Lords of privy Councill Having considered the foresaid petitione given in to them by the said James Glaidstaines of that Ilk They Hereby take of the said petitioners confynement and declaires him free therfrae and to be at libertie and freedome to goe about his affaires at Edinburgh or elsewhere as any of his Majesties free leidges In respect the said petitioner before extracting hes given bond and found Cautione acted in the books of privy Councill That he shall appear before the said Lords of privie Councill when called for and in the meantyme That He shall live peaceably under and with all submissione to the present Government of his majestie King William and that He shall not act consult nor contrive anything in prejudice thereof nor converse nor correspond with any Rebells under the penalty of fyve thousand merks scots in case He shall transgress in any part of the premisses

Act Byres of Coats

Anent the petitione given in to his Majesties high Commissioner and Lords of his majesties privy Councill by John Byres of Coats Shewing that where the petitioner being apprehended in England in the moneth of July Last bypast and shortly therafter sent doune prisoner by sea to Scotland upon suspitione of haveing been in France and He hath ever since been keept prisoner in the tolbooth of Edinburgh to the very great prejudice of his private fortune and of his owne Health and the said petitioner is justly apprehensive That the inconveniencies which he is inevitably lyable to from his said Confynement may in all probability in a very short tyme indanger his lyfe for the want of the benefitt of the free aire And seeing the said petitioner was alwayes willing and readie to have cleared himself as to anything that could have been laid to his Charge in case he had been indycted and putt to a legall tryall before this tyme and therfore humblie Craveing in maner and to the effect aftermentioned as the said petitione bears
His majesties high Commissioner and the Lords of privy Councill haveing considered the foresaid petitione given in to them by the said John Byres of Coats They Hereby give ordor and warrand to the2 magistrats of Edinburgh and keeper of their Tolbooth to set the said petitioner at libertie furth thereof In respect he hes given bond and found sufficient Cautione acted in the books of privy Councill That He shall live peaceablie under and with all submissione to the present Government of his majestie King William and that he shall not act consult nor contryve any thing in prejudice thereof nor converse nor correspond with any Rebells and that He shall appear before the said Lords of privie Councill when called for under the penalty of three Hundred pound sterling incase he shall transgress in any part of the premisses

His majesties high Commissioner and the Lords of privy Councill haveing considered the foresaid petitione given in to them by the said John Byres of Coats They Hereby give ordor and warrand to the2 magistrats of Edinburgh and keeper of their Tolbooth to set the said petitioner at libertie furth thereof In respect he hes given bond and found sufficient Cautione acted in the books of privy Councill That He shall live peaceablie under and with all submissione to the present Government of his majestie King William and that he shall not act consult nor contryve any thing in prejudice thereof nor converse nor correspond with any Rebells and that He shall appear before the said Lords of privie Councill when called for under the penalty of three Hundred pound sterling incase he shall transgress in any part of the premisses
