Anent a Petition given in to the Lords of their majesties privy Councill be Mr James Young writter in Edinburgh Shewing that wher the petitioner in bringing to perfectione ane Engine for wryting wherby five Copies may be done at the same time, which thought may prove not 2 unusefull, And the petitioner conceiving that if upon the event any profitt aryse therfrae ingenious tradsemen or others may fall upon the Imitation therof, And that by seing of this Engyne, which the petitioner cannot weell conceall since he intends it for publict use wherby the same may not only be rendered useless to the petitioner and tend to his Loss and damnage But likewayes may prove a discouragment to others to attempt the like in time comeing And Seing by the Custome of all weell Governed nationes as weell as by the saids Lords constant practise in the like cases ther is allwayes incouragment granted to such who Imploy ther time paines and expences about any project for the publict good, And Therfore humbly Suplicating to the effect aftermentioned The Lords of their majesties privy Councill haveing Considered this petitione given in to them be the above Mr James Young They heirby Discharge any others besydes the petitioner and his airs of assigneyes to make have or use any of the above Inguynes without the petitioners speciall allowance for the space of nyntein years to runn after the day and date heirof under the penaltie of five hundred merks fur ilk partie failure toties quoties.

Act and Intimatione anent this Current parliament

The Lords of their majesties privie Councell Considering That wher the present Current Parliament was by their Majesties Last proclamation theranent adjurned to the Fifteenth of June instant And that his Majestie being now abroad furth of his Kingdoms Hes not as yet signified his pleasure aither by sending a Commissioner for holding therof at the said day nor his royall order for adjurning the same to a further day And seing that both by the nature of the High Court of parliament and by express acts of parliament parliaments are Current uithout the necessity of ane express continuatione untill they be dissolved by their Majesties express warrand whose sole prerogative it is to dissolve as uell as to Call hold and prorogue the same Therfore the saids Lords of their Majesties privie Councell In expectation of their majesties express orders And to prevent the unnecessary trowble of the members and other good subjects who may be Concerned to repaire to the meeting of parliament Have thought fitt to ordaine Intimatione to be made That all members of Parliament be ready to meet and attend in this present Current parliament so soon as his Majesties uill and pleasure shall be signified to them for that effect and that none may pretend ignorance ordaines these presents to be printed and to be published at the mercat Cross of Edinburgh by the Lyon King att arms and his brethreen Heraulds and pursevants and at the whole mercat Crosses of the remanent head burghs of the severall shires uithin this Kingdome by macers or messengers sic subscribitur ut sederunt except the Lord Hattoun

Act anent Deficient in Insufficient men in the present Levys

Forasmuchas by the seventh act of the fourth session of this Currant parliament The Estates therof For themselves and in name and behalfe of their Majesties good subjects uithin this kingdome Did Cheerfullie offer to their Majesties a present Levy of Tuo Thousand nyne hundreth and seventy nyne men To be Levyed off the severall shires and Burghs of this Kingdome effeiring to the proportions and numbers sett doune in the act Jaj vic sixtie thrie And particularly exprest in the forsaid act of this Current parliament And their Majesties uith Consent of parliament Did authorize and Impoure the Lords of privie Counsell to Give such orders in this matter as they should find necessar In pursuance wherof albeit by the severall proclamations of Councell The particular quotas of every shire were appointed to be made readie and Delyvered to the officers appointed for receaving therof at Certain places and upon prefixed dayes particularly expressed in the saids proclamations yet the saids Lords of privie Councell are Informed by the Collonells and other officers who are to Command the regiments that ther are Many of the quota’s in sundrie shires not yet fullie outreicked nor delyvered to them And severall men of the said quota’s who have been delyvered rejected and sent back as Insufficient and unfitt for their majesties service For remeid wherof The Lords of their Majesties privie Councell Conforme to the pouer Granted to them by the forsaid act of this Current parliament Doe heirby authorize and ordaine Letters to be direct by the Clerks of privie Counsell under the signet therof att the Instance of Sir James Ogilvie their Majesties Sollicitor Charging the severall Clerks of supplie of the respective shires and burghs uithin this Kingdome to Give up and delyver true full and faithfull Lists of all deficients uithin their respective bounds Bearing the names and designations of the persons Lyable to putt out the said deficient men in the said List subscribed by their hand And if need beis to Conveen the Commissioners for making up therof And to delyver the saids Lists soe subscribed to any messenger whom the saids Clerks or Commissioners shall think fitt to Imploy uithin three dayes nixt after the charge given to them for that effect which messengers are also authorized and ordained to Charge the saids severall Heretors and others to be Contained in the saids Lists To furnish and poutt out good and sufficient Fencible men fitt and able to bear arms wherin they are deficient by the saids Lists And to present and delyver them at the sight of the magistrats of the place to any Commander of any party of their majesties forces nixt adjacent To be Convoyed by them to Collonell Robert Mckay and Collonell Douglas according to the divisione and orders contained in former proclamations And that uithin ten dayes nixt after they be charged for that effect As also that Letters of Horning be direct in manner forsaid to be execute by messengers to be Imployed by the Clerks or Commissioners of Supplie as above For Charging the severall Heretors and others Lyable for men in place of these who have been rejected as Insufficient Conforme to the particular Lists given in by the severall2 officers and presented in Councell and Act of Councell follouing therupon of the tuenty fourth of Apryle Last aither to furnish and Delyver good and sufficient men In place of these which have been rejected as Insufficient to the severall officers In manner forsaid To be Conducted In manner above mentioned or otheruise to Give in and delyver recepts if they any have of the saids men rejected as insufficient to be Contained in their Charge under the hand of some officers appointed to receave the Levys bearing the recept therof And that uithin […] dayes nixt after they be charged for that effect And which Letters are ordained to bear a warrand to Charge the saids severall Clerks of supplie to Give ane Certificat under their hands to the party of their getting the severall recepts produced to them And to transmitt the saids principall recepts to the Clerks of privie Councell uithin […] dayes nixt after receaving therof And the severall Charges to be under the paine of rebellione

Anent the petitione given in to the Lords of their Majesties privie Councell By Alexander Taite prisoner in the tolbooth of Edinburgh Sheuing That wher the petitioner hath remained thir tuo months by past in the tolbooth of Edinburgh upon the account that he uent Lately abroad uith Alexander Tait skipper in Leith Albeit He uas both Ignorant of the Laues and also of the port wher the said Alexander and he was to arryve For by the aggreement betuixt him and the petitioner It was expressly Conditioned that the petitioner should goe to Ostend And now through the petitioners Long Imprisonment He hath Lost the means of his subsistance The ship wherof he was master being taken from him and ane other Imployed in his place for transporting the Late garrisone of the Bass to France wherby he is redacted to the highest extremity of penurie and hes not one farthing wherupon to mantaine himself nor Creddite to burrow any money which he had formerly while he Continoued master of the said ship And therfore Humbly Craving to the effect underwryten as the said petitione bears The saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby allow the magistrats of Edinburgh and Keeper of their tolbooth To sett the petitioner at Libertie farth therof In respect he hath given bond and found sufficient Cautione acted in the books of privie Councell that he shall appear before the saids Lords of Privie Councell when called for And in the mean tyme that he shall Live peacably under and uith all submission to the present government of their Majesties King William and that he shall not Act Consult nor Contryve any thing in prejudice therof nor shall not Converse or Correspond uith any rebells under the penaltie of ane Thousand merks scotts In caise he shall transgress in any pairt of the premisses

Anent the petitione given in to the Lords of their majesties privie Councell By Sir John Murray of Drumcairn Sheuing That the petitioner being formerly prisoner in the Castle of Edinburgh And Having in March Last applied to the Councell for ane Inlargement Their Lordships were pleased to favour him uith ane exchange of his Imprisonment to a Confynment at Balvaird in Fyfe and tuo mylls about it wher he hes Continoued ever since And now the petitioner Having processes of great Consequence depending before the Lords of session In which his presence is unavoydablie necessar as is nottour to some of their Lordships number And the session being now Currant and bussiness urgent And the petitioner Having alwayes Lived peacablie and is Content upon his being sett at Libertie and his Confynment taken off so as he may attend his affairs at Edinburgh or elsewher uithin the kingdome To find sufficient Caution not only to Live peacably in tyme coming but also to appear before their Lordships when called for And therfore Humblie Craving to the effect underwryten as the said petitione Bears The saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby allow the petitioner to repaire to Edinburgh about his necessar affairs In respect The petitioner first before extracting heirof Hath Given bond and found sufficient Cautione acted in the books of privie Councell That he shall returne to and observe his former Confynment at the house of Balvaird and tuo mylls about the same betuixt and the tenth day of Agust nixt And not goe uithout the bounds therof And that he shall appear before the saids Lords of privie Councell when called for And in the mean tyme that he shall Live peacablie under and uith all submission to the present Government of their Majesties King William and Queen Mary And that he shall not Act Consult nor Contryve any thing in prejudice therof nor Converss or Correspond uith any rebells under the penaltie of Fyve Hundreth pounds sterling In caise he shall transgress in any pairt of the premisses
