Act Anent the skiners of Edinburgh and Whitfeild Hayter

The Lords of ther Majesties privy Councill haveing Considered a petition given in to them be the magistrats of Edinburgh and incorporatione of the skiners and other incorporationes of the burgh Craveing that the act of Councill In favors of Whitfeild Hayter for a manufactorie of dressing and Collouring Leather and makeing glew might be Rescinded with the answers made therto for the said Whitfeild Hayter and his factor They hereby Refuse the desyre of the said petitione and adveres to ther former interloquitor of Councill pronunced upon a former petitione given in be Whitfield Hayter Upon the second of may last with this additione That Hayter and his partners shall sett up in no burgh Royall within this kingdome unles upon the express invitatione and with the Consent of the burgh, and that they shall be scots men both to be partners and also to be apprentisses and Communicat the instence of ther trade to ther saids prentices.

Act Geddes of Kirkurd for a vaccand stipend.

Anent a Petition given in to the Lords of ther Majesties privy Councill be James Geddes of Kirkurd Shewing That quher the kirk of Kirkurd being vaccant and the vaccant stipend due to the minister being appointed by the acts of parliament to be Imployed for pious uses within the parish wher the samen vaiks Wherupon the toune Councill of Edinburgh undoubted patrons of the said Kirk and paroch be ther act of the date the fifteinth day of June this instant year Jaj vjc nyntie four Did allow and Grant warrand to the petitioner to uplift this years stipend from the persones Lybable in payment of the samen To be applyed for the pious usses within the said paroch And that necessarie it is that the petitioner have letters from the saids Lords against these lyable in payment of the samen And Therfore Humbly Suplicating the saids Lords to the effect aftermentioned The Lords of their Majesties privy Councill haveing Considered this petitione given in to them be the above James Geddes with the act of the toune Councill of Edinburgh mentioned therin and produced therwith They heirby allow the petitioner the stipend of the above kirk of Kirkurd for this present year Jaj vjc nyntie four and nominats and appoints the said James Geddes to be factor for uplifting the said years stipend and Imploying the same for repairing the rooff of the said kirk and puting a sclait rooff theron, and repairing the manse and kirk yeard dykes and other piouse usses abovementioned And Ordaines him to be readily answered obeyed and payed therof be the heritors fewers wodsetters Lyfrenters titulars tackmen of teynds tennents and others Lyable in payment of the same And Ordaines letters of horning under the signet of Councill to be direct at the instance of the said factor against these lyable in payment of the said years stipend upon productione of decreet of Localitie and incaice ther be no decreet of Localitie Ordaines these lyable to make payment of their respective proportiones of the same according as they shall be Decerned by the Judge ordinary In Respect the petitioner before extracting heirof has given bond and found suficient Cautione acted in the books of privy Councill that he shall Imploy the said years stipend upon the ends and uses forsaids.

Liberation William Cuthbertsone and William2Jack

Anent the petitione given in to the Lords of their majesties privie Councell By William Cuthbertsone and William3Jack prisoners in the tolbooth of the Cannongate Sheuing That wher the petitioners being tuo simple boyes were about half ane year agoe Imposed upon and persuaded by one John Drow sclaiter and another of his Imployment who are now gone souldiers to Flanders to sell and vend some Lead they had uithout their knouledge or accession stollen and Carryed away from off the rooffs of the Lodgings in the abbay And they not supposing them to be guiltie of this fact and uickednes uere allured to vend the same as said is And for which tho they most Ingenuously confessed what they knew in this matter They were Cast in the Cannongate tolbooth wher they have remained prisoners in the Cannongate tolbooth this halfe year by past In Great straits and misirie Having nothing to mantaine them but their Imployment which they are heirby destitut of and the saids Leads tho they be nothing guiltie as said is In order to their Liberation are requyred by their master And therfore Humbly Craving to the effect underwryten as the said petitione bears The saids Lords of their majesties privie Councell Having Considered the above petitione They heirby Give order and warrand to the magistrats of Edinburgh Baillies of the Cannongate and Keeper of their tolbooth to sett the petitioners at Libertie furth therof For which this shall be to all Concerned a sufficient warrand

Liberation The Viscount of Frendraught

Anent the petitione given in to the Lords of their Majesties privie Councell By Leues Viscount of Frendraught prisoner in Stirling Castle Sheuing That the petitioner Having been made prisoner upon his surrender of the Castle of Fedderit Sir Thomas Livingstoune by their Lordships authority alloued him to use all means for his releasment or by exchange of prisoners in France or otheruise as the supplicant could best propose And the petitioner offering to find baile to Live peacably at hame and to ansuer when called as the most Convenient and acceptable means he Could think upon at the tyme Their Lordships were pleased favourablie to accept of and allow him the benefite therof for the space of six months And therafter to ordaine him to Enter his persone upon the first day of July Jaj vic nyntie three in to the Castle of Stirling againe which he did punctuallie obtemperat and wher he hes ever been keeped prisoner since now almost a tuelve month which uith the tyme of his former Imprisonment ther at Edinburgh castle Montrose and Aberdeen amounts to neer four years since the surrender of the said Castle of Fedderit wherby the petitioner hes Contracted a Complicatione of deseases such as scurvey Gravell Spleen etc wherby he hes been tormented since his Last Imprisonment most Lamentablie and frequently reduced to Great want Having nothing for his mantinence but a share of six hundreth merks alloued for his wyfes aliment which hardly Intertained him and her uith very sober fare during ther Lordships favourable allouance to him to Live uith her at home wher ther was something more of ease in Living then can be found in a prisone wher nothing is to be had uithout ready money And therfore Humblie Craving to the effect underwryten as the said petition bears The saids Lords of their majesties privie Councell Having Considered the above petitione With the testificats of his Indispositione mentioned therin and produced theruith They heirby Give order and warrand to Leivtennant Collonell John Erskine Leivtenant Governour of the Castle of Stirling and in his absence to the nixt Commanding officer ther to sett the petitioner at Libertie furth therof In respect he hath given bond and found sufficient Cautione acted in the books of privie Councell That he shall Live peacably under and uith all submission to the present government of their majesties King William and Queen Mary And that he shall not Act Consult nor Contryve anything in prejudice therof nor Converss or Correspond uith any rebells And that he shall appear before the saids Lords of privie Councell when called for under the penaltie of five Hundreth pounds sterling In caise he shall transgress in any pairt of the premisses

Anent the petitione given in to the Lords of their Majesties privy Councell By Mr William Gray Sheuing That wher the petitioner having exercised the office of ane ordinary Advocat before the Lords of session from the beginning of the year in Jaj vic Eightie nyne untill he uas admitted shirref deput of Angus about three years since or therby since which tyme he did follow closs that Imployment as shirref depute and waited Constantly upon the Court to serve the Leidges of that shire uithout giving the usuall attendance as ane Advocat upon the sessions as he formerly used to doe And the petitioner having duely qualified himself as shirref deput and Lykeuise in other stations by taking the oaths of alleadgance and assurance He had noe thought nor Consideratione of the Certification of the Act of parliament debarring all ordinary Advocats who should not duely qualifie themselves as such betuixt and the prefixed day therinmentioned from exercising their Imployment for the future And that in respect the petitioner did In a manner neglect his Imployment as ane Advocat during the tyme he was shirref deput And it being their Lordships benigne practique to allow and admitt of any relevant excuse for purging the Contumacy of such persons who have not given precise obedience by taking the oaths and qualifying themselves uithin the tyme prefixed by Law And therfore Humbly Craving to the effect underwryten as the said petitione bears The Saids Lords of their majesties privy Councell Having Considered the above petitione They heirby Recommend to any one of the Lords of their majesties privy Councell to Administer the oath of alleadgance and assurance to the petitioner And In respect he hath suorne and signed the oath of alleadgance and signed the assurance They heirby repone the petitioner to the office of ane Advocat And Declares that he hes full right to exerce the said office and Enjoy all the privileges therof alse freely as if he had qualified himself as ane Advocat uithin the tyme prescribed by the act of parliament
