Liberation The Viscount of Frendraught

Anent the petitione given in to the Lords of their Majesties privie Councell By Leues Viscount of Frendraught prisoner in Stirling Castle Sheuing That the petitioner Having been made prisoner upon his surrender of the Castle of Fedderit Sir Thomas Livingstoune by their Lordships authority alloued him to use all means for his releasment or by exchange of prisoners in France or otheruise as the supplicant could best propose And the petitioner offering to find baile to Live peacably at hame and to ansuer when called as the most Convenient and acceptable means he Could think upon at the tyme Their Lordships were pleased favourablie to accept of and allow him the benefite therof for the space of six months And therafter to ordaine him to Enter his persone upon the first day of July Jaj vic nyntie three in to the Castle of Stirling againe which he did punctuallie obtemperat and wher he hes ever been keeped prisoner since now almost a tuelve month which uith the tyme of his former Imprisonment ther at Edinburgh castle Montrose and Aberdeen amounts to neer four years since the surrender of the said Castle of Fedderit wherby the petitioner hes Contracted a Complicatione of deseases such as scurvey Gravell Spleen etc wherby he hes been tormented since his Last Imprisonment most Lamentablie and frequently reduced to Great want Having nothing for his mantinence but a share of six hundreth merks alloued for his wyfes aliment which hardly Intertained him and her uith very sober fare during ther Lordships favourable allouance to him to Live uith her at home wher ther was something more of ease in Living then can be found in a prisone wher nothing is to be had uithout ready money And therfore Humblie Craving to the effect underwryten as the said petition bears The saids Lords of their majesties privie Councell Having Considered the above petitione With the testificats of his Indispositione mentioned therin and produced theruith They heirby Give order and warrand to Leivtennant Collonell John Erskine Leivtenant Governour of the Castle of Stirling and in his absence to the nixt Commanding officer ther to sett the petitioner at Libertie furth therof In respect he hath given bond and found sufficient Cautione acted in the books of privie Councell That he shall Live peacably under and uith all submission to the present government of their majesties King William and Queen Mary And that he shall not Act Consult nor Contryve anything in prejudice therof nor Converss or Correspond uith any rebells And that he shall appear before the saids Lords of privie Councell when called for under the penaltie of five Hundreth pounds sterling In caise he shall transgress in any pairt of the premisses
