Att Edinburgh the Tuelvth day of July Jaj vic nyntie four years

Anent the petitione given in to the Lords of their Majesties privie Councell By James Gladstanes of that ilk Sheuing That wher ther hath been a Long and vexatious proces Intented and depending at the instance of the Lord Philiphaugh as Donator to the waird and marriag of Sir William Douglas of Caivers To the behoofe of the Brethren and sisters of the said Sir William In so farr as may extend to the soume of Fourty Thousand merks modified by his Majestie and the Lords of the Thesaury for naturall portion to the saids Children against the petitioner as one of the waird vassalls of the barrony of Caivers And seing the said Cause is now ready to be advysed It is necessar for better Clearing of the petitioners Intrest That he should be present before the Lord Ordinary upon Concluded Causes to Clear what Lands the petitioner holds of the said barrony and the rent therof and the other Grounds wherin he may plead aither to be altogither free of Contributing for the said soume of Fourtie thousand merks or for Clearing how farr he Can be lyable in the said Contributione without which He uill be heavily prejudged and overburdened by the other vassalls of the said barrony as is nottourly knouen to severall of their Lordships number by the progress of the said Action already And therfore Humblie Craving their Lordships to allow the petitioner to repaire to Edinburgh to attend the said affair and severall others of his privat bussines For such tyme as their Lordships shall think fitt And He is Content to find Caution to repaire to and keep his present Confynment after the said tyme is expyred In the termes and Conforme to their Lordships act theranent as the said petition bears The Saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby allow the petitioner to Come to Edinburgh For attending the particular affaire in the said Bill and others his affairs The petitioner first Giving bond and finding sufficient Cautione acted in the books of privie Councell That he shall Returne to his Confynment at his house of Humbleknoues and tuo mylls about the same and that betuixt and the tenth day of Agust nixt and that he shall keep his said Confynment and not goe without the bounds of the same and In the mean tyme that he shall Live peacably under and uith all submission to the present Government of their Majesties King William and Queen Mary And that he shall not Act Consult nor Contryve any thing In prejudice therof nor Converss or Correspond uith any rebells and that he shall appear before the saids Lords of privie Councell when called for under the penalty of five Thousand merks scotts In caise he shall transgress in any part of the premisses
