Act James Dumbars elder and younger
Anent a Petition given in to the Lords of ther majesties privy Councill be James Dumbar elder baillie of Invernes and James Dunbarr his nephew late and present Collectors of the supply of the said shyre Shewing That ther is ane very unjust Lybell raised against the petitioners befor the saids Lords at the instance of Donald Mcdonald of Castltoune in the Islands of Skye, Who to this hour owes ther majesties twentie moneths cess at least, for their alleged causing quarter more men upon him then the law allowes, And Refuseing Discharges for the cess offered till the preceiding rests and deficiencies were payed and other unreasonable pretences Lybelled And Seing the petitioners can fully clear and vindicat themselves of every point of the said Lybell and are publict Servants of the government And that any one2 of them is ready to answer for the other and are willing to doe so that any dyet to be appointed after the Whitsundays terme when they must be necessarly oblidged to attend the Collection of the cess and other publict affairs of the Shyre They Therfore humbly Craved that the forsaid Complennt may be presently Discussed or that they may not be tyed to attend in the vaccance Since they are content to answer any time after the midle of June nixt and that they being both publict Servants one may be allowed to answer for the other as the said petition bears The Lords of their Majesties privy Councill haveing Considered this petition given in to them be the above James Dunbar They heirby Continue the above proces till the first Councill day of June nixt And Ordaines all parties to attend that day And Declaires defenders free from any hazard that may occurr throw their not attendance incase the pursuer shall offer to call the above Lybell before the said first Councill day of June nixt
