Protection Gairden of Ballamoir
Anent the petitione presented to the Lords of his Majesties privy Councill by William Gairden of Ballamoire Shewing2 that where the said petitioner was ceitted to compear before the said Lords upon the tuentie second day of November upon ane lybell raised at the instance of John and William Ewens sones to the deceast James Ewen Indweller in the Insh of Glenmuick and William Ewen their Uncle, and the said petitioner being under Captione could neither compear before the said Lords nor advyse with any of his Lauiers anent the raiseing of a reconventione or drawing his defences unless the said Lords grant him ane protectione and which the said Lords were alwayes in use to grant to persons in the saids petitioners Circumstances And seeing the Coppie of the lybell the petitioner hes received under the hand of William Dougal messinger does instantly verifie that there is a depending proces againes the said petitioner And therfore Humblie Craveing That the said Lords would take the premisses to their serious Consideratione and grant the petitioner ane protectione to continue till the first day of December They Lords of their Majesties privy Councill Haveing considered the abovewryten petitione given in to them by the said William Garden of Balamoir They Hereby Grant protectione to the said petitioner untill the threttieth day of November next to come exclusive and Discharged all macers messingers officers of burgh or Landward or other Executors of the Law To put any Letters of Captione acts of warding or other personall dilligence to executione against the said petitioners persone untill the said day Excepting alwayes their Majesties rents and publick dues sic subscribitur Tweeddale Cancel Ipd Sutherland Morton Leven Broadalban Tarbat James Stueart Adam Cockburne Archibald Murray
