Att Edinburgh the Tuelvth day of June Jaj vic nyntie four years

Act of Banishment Captain and John Lothian

The Lords of their Majesties privie Councell Having thought fitt to requyre Captain John Bell and John Lothian now prisoners in the tolbooth of Edinburgh to take the oath of alleadgance and assurance For Evidence of their affectiones to their majesties and the Government And the saids tuo persons being brought to the barr The Lords of their Majesties privie Councell requyred them to signe and suear the alleadgance and subscribe the assurance which they absolutely refuised And therfore the saids Lords Have Banished and heirby banishes the saids Captain John Bell and John Lothian from the Kingdome of Scotland And ordaines them to departe furth of the same uith the fleet which is to saile uith the Hollands2 Convoy presently Lying in the road of Leith Called the Breill frygott And Gives order and warrand to the Clerks of Councell to delyver up the said Captain Bell the bond granted by him and his Cautioner to Sir Thomas Muncreiff for a years valued rent dated the tuenty nynth day of June Jaj vic nyntie three years And Lykeuise to delyver up to the said John Lothian the bond granted by him and his Cautioners for his Living peacably in Commone forme and appearing when called for dated the Eleventh day of March Jaj vic nyntie three years And appointes the saids tuo persons to be Carryed back to prisone Ther to remaine open prisoners (The magistrats and Keeper being alwayes ansuerable for their safe Custody) untill they departe this kingdome as said is And appointes the magistrats of Edinburgh to see this sentence putt in executione as said is by putting the persons forsaids aboard of the said fleet and to returne a recept of them to the Clerks of privie Councell
