Act Livt Coll Shipie Hill anent 4 dragoons

Anent a Petition given in to the Lords of their Majesties privy Councill be Livetenant Collonell Shipie Hill Shewing That upon the Complaint of Peeter Baveradge tenant in Cullforgie, William Arnot and John Watson to their Lordships against the persones of Corporall Duncan and Androw Aiken in Captain Burnetts troop and Daniall Frazer and James Telferr in the Lord Beilhavens Troop about some insolencies Committed by one Georg Oliphant sometimes in Orchard mylne the said Dragoons are brought prisoners to the Abbay Guard by Sir Thomas Liveingstounes order And Therfore Humbly Craveing the saids Lords That the said Dragoons may be Imediatly tryed and either Condemned or assoylzied since by their long Lying into prison their horsses will be intirely ruined as the petition bears The Lords of their Majesties privy Councill Haveing Considered the above petition given in to them be the above Livt Coll Shipie Hill They heirby Give order and warrand to the magistrats of Burghs masters of prisones or officers in whose Custody the above Dragoons are to sett them at libertie they first giveing bond and finding the petitioner Cautioner for them That they Shall appear before the Councill and answers to any Lybell quhich shall be raised against them in the above matter and that whensoever they shall be cited or called ther to each of them under the penaltie of ane Hundred punds Scots money a peace and Ordaines the above persones Complaineing upon the saids Dragoons to raise a lybell and insist against them to the first day of May nixt, and the bond of Cautionrie to be granted by the petitioner to bear expressly that he shall produce them before the Councill the said day And that they shall attend the dyets of the said process.
