Act In favors of the Lady Glascloon

Anent a Petition given in to the Lords of their Majesties privy Councill be Issobell Tyrie Lady Glascloon Shewing That quher the petitioner stands infeft in the Lands of Glascloon with the pertinents and accordingly in possession by Mr George Bair of Lethendie his right therof to the petitioner and her deceased husband yett notwithstanding therof the said Mr George did take right to ane adjudicatione from one William Duk of Grange who hade ane adjudicatione of ten Thousand merks or therby upon the saids lands And be vertue therof James Blair now of Lethendie Sone to the said Mr George with his mother Euphan Blair to whom he disponed his rights of the said adjudicatione with the way he made with Mr Nathaniall Fyfe then shireff depute of Pearth obtained a decreet of removeing and ejecting or haveing the last knowledge therof untill they came in a most violent maner and ejected her deceased husband and her and ten Childrein with their wholl familly and seazed ther Chartor Chist and wholl papers throw the want wither of the petitioners know not whither or no the Ten Thousand merks may be payed or any part therof and that ther may be alsoe bonds and other rights therin quhich would clear many defficulties on the said estate And the treuth is that the Opression and violences done most unnaturally by the said Mr George and his Sone against her deceast husband and her being very near relationes are so weell and nottourly knowen tho she neither needed nor could enumerat them haveing utterly (2what by defending his most unjust persuites at Law and puting her from her own joynture hade driven her and her numerous familly to the outmost of extreamities that she could not have bread or subsist with her numerous familly being all of them at the point of Sterving And the petitioner haveing pursued maills and duties against the tenents;3 Lethendie in the tennants names did advocat the same which is Lying at avisandy to the Lords readie to be reported by my Lord Crossrig, as is also Lethendies proces of reduction Improbation and declarator against her as also the petitioner haveing applyed her self in her husbands time to the saids Lords for ane aliment The Lords were graciously pleased by ther decreet in anno 1683 to allow her the house yeards and others to the the4 value of thrie or four hundred merks yearly and that for the space of thrie years therafter for their mantinance till their rights were Discussed, And that conforme therto the petitioner did intromitt And which was all she hade to mantaine her self and familly these ten years except every small matter the Lords of session allowed her not exceiding four hundreth fiftie merks And that their Lordships in the like caces were in use to help poor widdowes and others to ane aliement out of their oun estate the samen being two thousand merks a year And that the haill debt is truely resting will not exceidd ten Thousand merks for payment quherof this Lethendie and his father have hade the said estate since the year Jaj vjc Eightie thrie, and intromitted with the maills and duties therof except what the petitioner has received by vertue of the saids Lords gracious Decreet and from the Lords of Sessione as aforsaid And Therfore Humbly Craveing the saids Lords in the first place to appoint her ane aliement for her and her ten fatherles Cheldrein for their Subsistance that they starve not, And in the nixt place that she may be repossessed to the said house and yeards of Glascloon with the pleugh of Land Lying contigue therof including the six Cotters Conform to their Lordships former decreet and that untill their severall wryts be determined before the Judge ordinar which is now Lying at avisandum readie to be reported as the petition bears, The Lords of their Majesties privy Councill haveing Considered this petition given in to them be the above Issobell Tyrie Ladie Glascloon with a Counter petition given in against the Same be Euphan Blair relict of Mr George Blair of Lethentie They allow to the petitioner ane aliement of Thrie hundred merks for this current year And Ordaines the said Euphan Blair to make payment to her of the same at the termes following viz the one half therof betwixt and the first day of october nixt and the other half therof betwixt and the first day of December therafter, And ordaines letters of horning and others needfull to be direct heiron.

Anent a Petition given in to the Lords of their majesties privy Councill be Elizabeth Seatton eldest Lawfull Daughter to the deceast George Seatton of Carristoune in Fyfe Shewing That quher the petitioners deceast father did leave behind him ane estate of threttie Chalders of victuall free of any or verie litle burdein Wherunto Christopher Seatton his eldest sone and the petitioners brothers german has Succeided and ever since his fathers death has been in peacable possessione therof and becaus by ane oversight and want of due Circumspectione the petitioners said umquhill father at his decease did not procure ane bond of provisione to the petitioner from the said Christopher Seatton for a Competent portion to be payed to the petitioner by him after the petitioners fathers decease as in Justice he ought to have done Considering that be2 her mothers Contract of mariadge she as the eldest daughter have good right to six Thousand merks of portion therin provyded to the petitioner, The said Christopher Seatton haveing casten off all naturall affection as a brother not only refuses to pay her Any portion Bot to give and allow to her any kynd of aliement and mantinance quherupon she is reduced to the Outtermost extreamity of wont as is notourly knowen to some of the said Lords number which being accompanied with weaknes and infirmity of body adge and other sad circumstances and not being able any longer to subsist in the case the petitioner is now in, And finding no other way of a present releiff have Compelled the petitioner to apply to the saids Lords for redress therof in Justice And Therfore Humbly Craveing the saids Lords to take the premisses to their most serious Consideration, And to ordaine the said Christopher Seatton to pay to the petitioner yearly such a soume of money as the saids Lords shall pleace modifie for ane aliement to the petitioner ay and whill the petitioner can procure ane Decreet against him before the Judge ordinar for payment to the petitioner of her portion destinat to her be her mothers contract of mariadge as the petition bears, The Lords of their Majesties privy Councill Haveing heard this petitione given in to them be the above Elizabeth Seatton Read in their presence They heirby Recommend to the Earle of Melvill Lord privy Seall and Lord Raith Lord thesaurer depute to call for the parties mentioned in the above petition and to deall with and indeavor to setle them and incaice of Deficultie to report to the Councill.

Act Earl of Kintoir and for Thomas Burnet Against The Lord Bamff.

Anent a Petition given in to the Lords of their Majesties privy Councill be John Earle of Kintoir and Sir Thomas Burnet of Leyes trusties for and in name and behalf of the Ladie Jean Keith Ladie Bamff and her daughters and William Panton in Todsholls George Andersone mossgreive and other tenants threatned and oppressed by My Lord Bamff Shewing That quher it is notourly knowen that the said Ladie Jean Keith being intollerably maltreated by the said Lord Bamff her husband was upon aplication to the Lords allowed a seperation And Ordained to have ane aliement of two thousand merks yearly, Which aliement upon the Said Lord Bamffs turning papist in the year Jaj vjc Eightie seven was restarted to twelue hundred merks yearly And yet the said Lord Bamff did prove So untoward and uneasie to his oun Lady and Cheldrein that ther was a necessitie for a new setlment to be made by the interposeing and at the sight of freinds in the year Jaj vjc nyntie at which time the said Lord Bamff with the advice and consent of Sir Patrick Ogilvie of Boyne and Alexander Ogilvie of Forglen his brother Did Grant to the petitioners as trusties for and to the behove of his Ladie and thrie daughters a localitie of sixtein Chalders victuall yearly with the burdein of ministers stipends to be uplifted out of the lands quherof the rents were assigned and Disponed to the petitioners by his forsaid disposition and assignatione Which Dispositione and assignatione Doeth not only bear warrandice Bot also this express Declaratione that incaise the said Lord Bamff should directly or indirectly medle with the said Locallitie or rents therof ore contract debts to affect the same then he should Loss and omitt his Lyfrent right of the house yeards and parks of Inshdrower with fourtie bolls of reserved rent to him out of the Ryland in his Disposition granted to the Master of Bamff, Which should be allocat to the saids trusties for the furder aliement of the said Ladie and her Cheldrein And Farder that incaice they should be debarred from the forsaids Lands alocat and rents therof Then the Lady should Imediat recourse to her Decreet of aliement for the wholl soume therin Decerned to be uplifted furth of the lands disponed in fie to the Master of Bamff Bot not out of the lands sett apart for payment of Creditors as the said Dispositione and assignatione dated in August and september Jaj vjc nyntie bears Notwithstanding quherof And that the petitioners appoynted the said Alexander Ogilvie of Forglen his brother to be the petitioners factor And that the said Lord Bamff himself Did also give other Seperat Declarationes and assurances for their peaceable and queyet possession for the behove forsaid, yet such is his foreward temper and Unaccountable ill2 Dispositione and his associats Viz […] Stewart provest of Bamff George Chessor merchant ther George Gordone late baillie ther, Robert Duffes gardner ther Robert Rait and John Beath servitors to the said Lord Bamff, James Lindsay elder servitor to my Lord Airly William Galloway in […] James David burges in Bamff […] Ogilvie of Truchaw and Robert Ogilvie his Sone vexes and molests the tennants by most violent threatnings, and otherwayes so as they can never possess nor make payment to the petitioner of the saids rents for the necessary uses forsaid Bot on the Contrary, He has therby manifastly incurred the forsaid ferittancy And the samen ought and should be so found and Declared And he removed from the forsaid house yeard and orchyeards And fourtie bolls3 of victuall abovespecified And the petitioners possessed of the same; or otherwayes the Lady should have the4 benefite of the saids Lords former Decreet in maner above exprest And seing that this cause is not only aliementary Bot obviously attended with all the favorable circumstances that can plead for the destressed Lady and her thrie Daughters, And that it is not only most proper for the saids Lords to help them in the said matter, Bot that without the saids Lords present help and assistance they must be reduced to extreamity, And Farder that the said Lord Bamff his deeds of molestatione are attested by his oun brother the petitioners factor Lykas letters of Laborowes being raised against him and he therwith charged and letters of Captione out therupon he hath deforced the messengers that came to execute the same as ane atestatione under the majesties hand and ane other articular informatione anent my Lords threatning and oppression bears And Therfore Humbly Craveing the saids Lords In Consideratione of the premisses in the first place to give warrand for sumonding the said Lord Bamff to answer before the saids Lords in the premisses the […] day of […] nixt to come with Certificatione as said is And in the nixt place to give the saids Lords warrand and Commissione to Sir James Ogilvie Shireff of the said shyre and his deputes to take care that heirafter the petitioner or ther factors may not suffer no molestatione or oppositione whatsoever in uplifting of the saids Rents And that our tenants may be keept free of all shoaring boasting and minaceing to the effect the petitioners may have queit and peacable possessione other wayes to Impower the said Sir James to secure the persone of the said Lord Bamff Or to take what other effectuall Course he shall think expedient untill the Lords should Cognosie and determine in the wholl premises as the petitione bears The Lords of their majesties privy Councill Haveing Considered the petitione on the two preceiding pages gaven in to them be the Earle of Kintoir and Sir Thomas Burnet of Leyes They heirby Ordaine letters to be direct for citeing the Lord Bamff and his accomplices mentioned in the foregoeing petitione To Compeir before the saids Lords of privy Councill The […] day of […] nixt to answer to the poynts of the said petitione And Grants warrand for citeing witneses And the saids Lords Doe heirby give warrand and Commission to Sir James Ogilvie of Churchhill shirref principall of Bamff or his depute to take care that for the future the petitioners nor their factors suffer no molestatione or oppositione in uplifting the rents contained in the petitione And that their tenants bee keeped free of the Lord Bamffs shoaring, boasting and minaceing.

Anent a Petition given in to the Lords of their Majesties privy Councill be John Earle of Kintoir and Sir Thomas Burnet of Leyes trusties for and in name and behalf of the Ladie Jean Keith Ladie Bamff and her daughters and William Panton in Todsholls George Andersone mossgreive and other tenants threatned and oppressed by My Lord Bamff Shewing That quher it is notourly knowen that the said Ladie Jean Keith being intollerably maltreated by the said Lord Bamff her husband was upon aplication to the Lords allowed a seperation And Ordained to have ane aliement of two thousand merks yearly, Which aliement upon the Said Lord Bamffs turning papist in the year Jaj vjc Eightie seven was restarted to twelue hundred merks yearly And yet the said Lord Bamff did prove So untoward and uneasie to his oun Lady and Cheldrein that ther was a necessitie for a new setlment to be made by the interposeing and at the sight of freinds in the year Jaj vjc nyntie at which time the said Lord Bamff with the advice and consent of Sir Patrick Ogilvie of Boyne and Alexander Ogilvie of Forglen his brother Did Grant to the petitioners as trusties for and to the behove of his Ladie and thrie daughters a localitie of sixtein Chalders victuall yearly with the burdein of ministers stipends to be uplifted out of the lands quherof the rents were assigned and Disponed to the petitioners by his forsaid disposition and assignatione Which Dispositione and assignatione Doeth not only bear warrandice Bot also this express Declaratione that incaise the said Lord Bamff should directly or indirectly medle with the said Locallitie or rents therof ore contract debts to affect the same then he should Loss and omitt his Lyfrent right of the house yeards and parks of Inshdrower with fourtie bolls of reserved rent to him out of the Ryland in his Disposition granted to the Master of Bamff, Which should be allocat to the saids trusties for the furder aliement of the said Ladie and her Cheldrein And Farder that incaice they should be debarred from the forsaids Lands alocat and rents therof Then the Lady should Imediat recourse to her Decreet of aliement for the wholl soume therin Decerned to be uplifted furth of the lands disponed in fie to the Master of Bamff Bot not out of the lands sett apart for payment of Creditors as the said Dispositione and assignatione dated in August and september Jaj vjc nyntie bears Notwithstanding quherof And that the petitioners appoynted the said Alexander Ogilvie of Forglen his brother to be the petitioners factor And that the said Lord Bamff himself Did also give other Seperat Declarationes and assurances for their peaceable and queyet possession for the behove forsaid, yet such is his foreward temper and Unaccountable ill2 Dispositione and his associats Viz […] Stewart provest of Bamff George Chessor merchant ther George Gordone late baillie ther, Robert Duffes gardner ther Robert Rait and John Beath servitors to the said Lord Bamff, James Lindsay elder servitor to my Lord Airly William Galloway in […] James David burges in Bamff […] Ogilvie of Truchaw and Robert Ogilvie his Sone vexes and molests the tennants by most violent threatnings, and otherwayes so as they can never possess nor make payment to the petitioner of the saids rents for the necessary uses forsaid Bot on the Contrary, He has therby manifastly incurred the forsaid ferittancy And the samen ought and should be so found and Declared And he removed from the forsaid house yeard and orchyeards And fourtie bolls3 of victuall abovespecified And the petitioners possessed of the same; or otherwayes the Lady should have the4 benefite of the saids Lords former Decreet in maner above exprest And seing that this cause is not only aliementary Bot obviously attended with all the favorable circumstances that can plead for the destressed Lady and her thrie Daughters, And that it is not only most proper for the saids Lords to help them in the said matter, Bot that without the saids Lords present help and assistance they must be reduced to extreamity, And Farder that the said Lord Bamff his deeds of molestatione are attested by his oun brother the petitioners factor Lykas letters of Laborowes being raised against him and he therwith charged and letters of Captione out therupon he hath deforced the messengers that came to execute the same as ane atestatione under the majesties hand and ane other articular informatione anent my Lords threatning and oppression bears And Therfore Humbly Craveing the saids Lords In Consideratione of the premisses in the first place to give warrand for sumonding the said Lord Bamff to answer before the saids Lords in the premisses the […] day of […] nixt to come with Certificatione as said is And in the nixt place to give the saids Lords warrand and Commissione to Sir James Ogilvie Shireff of the said shyre and his deputes to take care that heirafter the petitioner or ther factors may not suffer no molestatione or oppositione whatsoever in uplifting of the saids Rents And that our tenants may be keept free of all shoaring boasting and minaceing to the effect the petitioners may have queit and peacable possessione other wayes to Impower the said Sir James to secure the persone of the said Lord Bamff Or to take what other effectuall Course he shall think expedient untill the Lords should Cognosie and determine in the wholl premises as the petitione bears The Lords of their majesties privy Councill Haveing Considered the petitione on the two preceiding pages gaven in to them be the Earle of Kintoir and Sir Thomas Burnet of Leyes They heirby Ordaine letters to be direct for citeing the Lord Bamff and his accomplices mentioned in the foregoeing petitione To Compeir before the saids Lords of privy Councill The […] day of […] nixt to answer to the poynts of the said petitione And Grants warrand for citeing witneses And the saids Lords Doe heirby give warrand and Commission to Sir James Ogilvie of Churchhill shirref principall of Bamff or his depute to take care that for the future the petitioners nor their factors suffer no molestatione or oppositione in uplifting the rents contained in the petitione And that their tenants bee keeped free of the Lord Bamffs shoaring, boasting and minaceing.
