Act and Recomendatione Elizabeth Seatton

Anent a Petition given in to the Lords of their majesties privy Councill be Elizabeth Seatton eldest Lawfull Daughter to the deceast George Seatton of Carristoune in Fyfe Shewing That quher the petitioners deceast father did leave behind him ane estate of threttie Chalders of victuall free of any or verie litle burdein Wherunto Christopher Seatton his eldest sone and the petitioners brothers german has Succeided and ever since his fathers death has been in peacable possessione therof and becaus by ane oversight and want of due Circumspectione the petitioners said umquhill father at his decease did not procure ane bond of provisione to the petitioner from the said Christopher Seatton for a Competent portion to be payed to the petitioner by him after the petitioners fathers decease as in Justice he ought to have done Considering that be2 her mothers Contract of mariadge she as the eldest daughter have good right to six Thousand merks of portion therin provyded to the petitioner, The said Christopher Seatton haveing casten off all naturall affection as a brother not only refuses to pay her Any portion Bot to give and allow to her any kynd of aliement and mantinance quherupon she is reduced to the Outtermost extreamity of wont as is notourly knowen to some of the said Lords number which being accompanied with weaknes and infirmity of body adge and other sad circumstances and not being able any longer to subsist in the case the petitioner is now in, And finding no other way of a present releiff have Compelled the petitioner to apply to the saids Lords for redress therof in Justice And Therfore Humbly Craveing the saids Lords to take the premisses to their most serious Consideration, And to ordaine the said Christopher Seatton to pay to the petitioner yearly such a soume of money as the saids Lords shall pleace modifie for ane aliement to the petitioner ay and whill the petitioner can procure ane Decreet against him before the Judge ordinar for payment to the petitioner of her portion destinat to her be her mothers contract of mariadge as the petition bears, The Lords of their Majesties privy Councill Haveing heard this petitione given in to them be the above Elizabeth Seatton Read in their presence They heirby Recommend to the Earle of Melvill Lord privy Seall and Lord Raith Lord thesaurer depute to call for the parties mentioned in the above petition and to deall with and indeavor to setle them and incaice of Deficultie to report to the Councill.
