Liberatione The Earle of Perth
Anent the petitione Given in to the Lords of their Majesties privie Councell Be Marie Countess of Perth Sheuing that the Earle of Perth her husband did Enter himself prisoner in the Castle of Stirline so soon as their Lordships pleasure was signified to him by the Lord Chancellor and hath since Continoued ther wherby his health is much Impaired by his former Long and closs imprisonment Is againe Indaingered unless their Lordships allow him some remeid And therfore Humbly Craving their Lordships to allow the petitioner to Represent in his behalf That albeit a persone in his Circumstances ought not to be a Choiser yet banishment is in effect more tollerable to him then Imprisonment And if their Lordships uill allow him the choice all the favour he Craves Is to be Liberat upon Cautione aither to reenter when their Lordships shall be pleased to Call him or to Goe out of the kingdome if so be their Lordships will allow him the liberty of making the forsaid choyce For which he doubts not but their Lordships uill alwayes allow him a Competent tyme to prepare for his departure as the said petitione Bears The saids Lords of their Majesties privie Councell Having Considered this petitione given In to them Be the above Countess of Perth They Heirby Grant ordor and warrand to Leivtennant Collonell John Areskine Deputy Governour of the castle of Stirline or other Commanding officer ther To sett at Liberty furth of the said castle James Earle of Perth presently prisoner therin In respect that the said Earle have procured bond subscribed be sufficient persones That he shall depart furth of their Majesties dominiones betuixt and the fifteenth day of Agust nixt to Come and never returne therto uithout his Majesties or the Councells Licence for that effect And in the meantyme that He shall live peacably under and uith all submissione to the present government of their Majesties King William and Queen Mary And that He shall not Act consult nor Contryve any thing In prejudice therof nor shall not Correspond or converss uith rebells And that he shall appear when called for if called for betuixt and the said day under the penaltie of fyve thousand pounds sterline In case he shall transgress in any part of the premisses
