Act Charles Stewart of Bigtoune
Anent a petition given in to the Lords of their majesties privy Councill be Charles Stewart younger of Bigtoune for himself and fiftein more of the heritors of Zetland Shewing That quher the said Charles for himself and as Commissioner for the forsaid number of heritors hath raised letters before the saids Lords against the said Commissioners of Supply of these bounds, and Mr John Mitchell ther Collector for oppressione and exorbitant exactiones under the Collour of Levieing of the Supplie to the heavie prejudice of the saids heritors and others They one the other hand hath raised a reconventione upon no other ground save that they alledged themselves to be standared and Calumniat by the forsaid Lybell Albeit they be able to prove it in every point And therin have called not only the said Charles Stewart raised of the forsaid Lybell as Commissioner consitute by the rest Bot his woll fiftein constituents on purpose to vex them by bringing them from Zetland in the harvest and winter seasons, And seing that the said reconvention is evidently groundles, And that as they have Commissionat the forsaid Charles Stewart to pursue for them so they are content to Impower him to answer in their name with ane oblidgment to undergoe any censure or punishment that can be incurred be the said reconvention And Therfore Humbly Craveing the saids Lords would Declair that it should be sufficient for them to make their appearance to the said reconventione by the said Charles Stewart or any other they should name instructed and qualified in maner forsaid And therby to releive the petitioners of the great vexatione and expenses as the comeing from Zetland to Edinburgh upon the forsaid pretended reconventione Must needs Occasion as the said petitione bears The Lords of their Majesties privy Councill haveing Considered the above petition given in to to2 them by Charles Stewart of Bigtoune, They heirby allow any one of the defenders who is Responsall person Called in the Lybell at the instance of the Commissioners of Supply in Orkney and Zetland To Compeir for the haill defenders, The said person Compeiring allwayes sisting himself in name of the haill defenders and becomeing bound and Lyable to satisfie and fulfill any sentance that shall be pronunced in the said proces not only against himself, Bot alsoe against the haill defenders cited or any of them.
