Liberation Thomas Irving

Anent the petitione given in to the Lords of there majesties privie Councill be Thomas Irving sone to Mr Christopher Irving doctor of medicine Shewing That where it wes the petitioners misfortune to have been overtaken with drink on Thursday Last And comeing out of a Cellar in the Land mercat at eleaven of the cloack at night It being pitch dark The petitioner did fall over some Loose whins which Lay on the high street And in a passione The petitioner said that no persones should be troubled with them againe And did rune in to the taverne where he hade been drinking and brought furth a candle to sett them on fyre whereupon the petitioner wes delated as being accessorie to and ane encouradger of the tumult which wes the forsaid night And Lykewayes in haveing some badd designes againest the toun And wes Imprisoned upon that suspicion upon saturnday Last And yet Continowes prisoner whereas God knowes he hade no designe to doe prejudice to any persone But what he did wes out of the heat of his passione when he wes not much maister of himself whereupon nothing followed And it is a thing altogether extrinsick from the Rabble and tumult As can be declared by those persons who were with the petitioner If the saids Lords think it worth there whyle to examine them And therefore Craveing that the saids Lords would be pleased to take the premisses to there Consideratione And sieing this wes a meer accidentall thing without any previous designe And whereupon nothing followed To Cause sett the petitioner at Liberty As the said petitione bears The Saids Lords of there Majesties privie Councill Haveing considered this petitione given in to them be the above Thomas Irving with the depositiones of the witnesses taken againest him They hereby Give order and warrand to the magistrats of Edinburgh and Keeper of there tolbooth To sett the petitioner at Liberty furth thereof And Remitts the petitioner to the saids magistrates To be punished by them for his exercise and ryot that night In which the late tumult wes made within the citie of Edinburgh
