Act Stopting the electione of the proveist ane bailzie and theasurer of Edinburgh

The Lord2 High Chancellour acquanted the Councill that his Lordship being Informed that the present toun councill of Edinburgh hade appoynted tuo severall dayes viz yesterday for Leitting and this day for electing a proveist one Bailzie and a theasurer In place of Sir John Hall Robert Cheislie and George Warrander who were chosen to these offices at this last electione of the magistrats of Edinburgh And have not accepted And that his Lordship hade Called tuo of the present bailzies And did Intimate to them not to proceed in that electione untill he should acquant the Councill And the Lords of there Majesties privie Councill haveing Considered the Maister of Stair secretary of state his Letter written by his Majesties Command to the said Lord high Chancellour anent the electione of the magistrats of Edinburgh daitted in december last with a petitione Given in to them be the said Sir John Hall Robert Cheisly and George Warrander Representing the reasones of there not accepting to be, That there is a reductione depending befor the privie Councill of this Last Electione of the Magistrates and toun Councill of Edinburgh And that they Conceave the secretaries said Letter wreitten by the Kings Command for Stopting a new electione untill the matter be represented to his Majestie Excuses there not acceptance And therefore Craveing they may be exonered from accepting And the pretended magistrates and toun councill discharged from Leitting and electing any in there places till his majesties pleasure be knowen The Saids Lords of there majesties privie Councill have stopted and hereby stopts any farder procedure which might be made be the present magistrates and toun councill of Edinburgh aither by Leitting or electing any to be magistrates In place of these who have not accepted as said is untill his majesties pleasure be knowen in the said matter

Act stopping the election of the provost, one bailie and treasurer of Edinburgh

The lord high chancellor acquainted the council that his lordship, being informed that the present town council of Edinburgh had appointed two separate days, viz yesterday for leeting and this day for electing a provost, one bailie and a treasurer in place of Sir John Hall, Robert Cheislie and George Warrender who were chosen to these offices at this last election of the magistrates of Edinburgh and have not accepted, and that his lordship hade called two of the present bailies and intimated to them not to proceed in that election until he should acquaint the council, and the lords of their majesties’ privy council having considered the Master of Stair, secretary of state, his Letter written by his majesty’s command to the said lord high chancellor concerning the election of the magistrates of Edinburgh dated in December last, with a petition given in to them by the said Sir John Hall, Robert Cheislie and George Warrender representing the reasons of their not accepting to be, that there is a reduction depending before the privy council of this last election of the magistrates and town council of Edinburgh and that they conceive the secretary’s said letter written by the king’s command for stopping a new election until the matter be represented to his majesty excuses their non-acceptance, and therefore craving they may be exonerated from accepting and the pretended magistrates and town council discharged from leeting and electing any in their places till his majesty’s pleasure be known. The said lords of their majesties’ privy council have stopped and hereby stops any further procedure which might be made by the present magistrates and town council of Edinburgh, either by leeting or electing any to be magistrates in place of those who have not accepted as stated until his majesty’s pleasure be known in the said matter.
