Act James Montgomrie Clerk to the Justice Court
Anent a Petition given in to the Lords of their majesties privy Councill be James Montgomrie Clerk to the Justice Court Shewing That the petitioner being patron of the parochin of Stewartoune hath right to dispose of the vaccand stipends for pious uses within the said parish Cropt and year of god Jaj vjc nyntie two, And ther being severall pious uses for Disposeing of the said vaccand stipend which are very urgent and necessary such as repaireing of the church and manse which are near ruineing building of bridges building of a Churchyeard-dyke and other pious uses within the parish not particularly mentioned in the act of Parliament which retards the Frank payment of these Lyable in payment of the said stipend to the petitioner in the speedie application therof to the uses forsaid Except the saids Lords gift and authoritie ware interponed therto, To which the heritors and elders of the said parish have consented as the Commission to David Boyle of Kelburne and the petitioner therwith produced would testifie And Therfore humbly Craveing The saids Lords would grant the petitioner ane gift of the said years stipend to be applyed for the forsaids pious uses and others within the said parishin as the petition bears The Lords of their Majestyes Privy Councill Haveing Considered this petition given in to them be the above James Montgomrie with the Commission mentioned therin and produced ther with They heirby allow the stipend of the above kirk of Stewartoune for the haill cropt and year of god Jaj vjc nyntie two and that for the repairing of the Church and manse building of bridges building of a Church yeard-dyke and other pious uses within the said parish of Stewartoune And at desyre of the petitioner patron of the said kirk Doe heirby nominat and appoint William Boyle writter in Edinburgh to be factor for uplifting the said years Stipend And ordaines the said factor to be readily answered obeyed and payed therof be the heritors fewars wodsetters and others Lyable in payment of the same And Ordaines letters of horning under the signet of Councill against them for that effect upon production of a Decreet of Locallitie, And in caice ther be non Ordaines these Lyable to make payment of their respective proportiones of the said years Stipend according as they shall be Decerned by the Judge ordinary In Respect2 The said factor has before extracting heirof Found suficient Cautione acted in the books of privy Councill that he shall Imploy the forsaid years stipend upon the ends and uses forsaids at the sight of the said James Montgomrie patron forsaid.
