Act The Lady Monktoune.
Anent the petition given in to the Lords of their majesties privy Councill be Hellen Ramsay spouse to Mr Alexander Hay of Mounktoune Shewing That quher the said Mr Alexander Hay her husband haveing in anno Jaj vjc Eightie Siz purchased the Lands of Monktoune from Alexander Hay late therof about the space of ane year therafter the petitioners parents disposed of her to him in maraidge with ane Suitable tocher which was ten Thousand merks secured by infeftment upon the estate of Abottshall In contemplatione quherof the petitioner was infeft in ane lyfrent of ane yearly annutie of Eightein hundred merks payable furth of the said estate of Monktoune with the north syde of the mansion house therof for her dwalling house, Wherwith the petitioners parents and freinds were satisfied they hade acquyt themselves of their dutie In provydeing reasonably for her against the2 fraud and Collusion of her husband his auther and Creditors Notwithstanding quherof ther were such laitent and fraudelent incumberances upon the saids Lands of Monktoune as made the same recognoese in the hands of the Earle of Lauderdale superior therof after payment of more then the adequat pryce agreen upon, And the gift of Recognitione disponed to James Cockburne goldsmith burges of Edinburgh, Be vertue quherof not only the maills and duties of the said estate of Monktoune are sequestrat upon ane Competition betwixt the Donator and Creditors Bot also her tocher yet resting and secured upon the estate of Abottshall as said is, Is also ajudged and arresisted by his Creditors Wherby the petitioner and her familly are brought to that condition that her husband after haveing been for sometime protected from personall Dilligence in the Abbay of Hollyruidhous was in the end for want of Subsistance necessitate to leave the3 Nation neither hade heard from him this long time and knowes not whither he be dead or alive leaveing the petitioner and her familly without any mean of subsistance (And hade not so much as ane six-pence of his effects to live upon thir thrie years by past) so that the petitioner and her familly are brought to ane extream pinsh of necessitie and exposed to Sterving Except the saids Lords out of their Justice and goodnes provyde remeid therto And Therfore Humbly Craveing the saids Lords to take the premisses to their serious Consideratione And to allow the petitioner the annualrent of her oun Tocher yet resting upon the estate of Abbotshall with Such ane addition therto out of the rents of the said estate of Monktoune with the North Syde of the Mansion house therof as the saids Lords should please to modifie, yearly to be payed in all tyme comeing And that the petitioners Discharge to those due in payment of the annualrent of her tocher, And to the tenants and possessors of the saids lands of Monkstoune might be by Decreet of the saids Lords ordained to be ane sufficient exoneratione to them for payment of the aliement swae to be modified by the saids Lords, That therby the great indigence of the petitioner and her familly might in some measure be supplied for the future which as it would be ane act of great Justice, So it wuld be of Charitie as the said suplicatione bears The Lords of their Majesties privy Councill haveing Considered the above petition togither with the report of a Comittie of their oun number appointed in this affair Bearing that the Comittie haveing heard The Ladie Monktounes procurators and the Donator to her husbands escheat, And also Mr James Leslie advocat a Creditor, And Finding that the Creditors doe consent that the Ladie have six hundred merks allowed her being the annualrent of her Tocher for her aliment this Current year frae whitsunday last to whitsunday nixt to come, The lands of Monktoune being under appearance of sale very quickly wherby the Creditors will get payment of their soumes It is their opinion that the Councill Decerne the said six hundred merks to be payed to the petitioner be the Chamberland of the estate of Abbotshall Upon which lands the Ladies tocher Lyes, for the years aliement forsaid The Lords of privy Councill Doe heirby Approve of the said Report And Ordaines the Chamberland of the estate of Abbotshall To make payment to the petitioner of the forsaid soume of six hundred merks for her aliement this Current year forsaid And ordaines letters of horning to be direct against the Chamberland of Abottshall to be Condescended on before giveing out of the horning And ordaines the horning to be on Fiftein dayes.
