Liberatione Sir Robert Hamilton

Anent the petitione Given in to the Lords of there Majesties privie Councill be Robert Hamiltone brother germane to Sir William Hamilton of Prestoun Shewing That where the petitioner is there Lordships prisoner in the tolbooth of Edinburgh these fyve moneths bygone for the Causes only knowne to there Lordships And that he is extreamly unweell to the hazard of his Lyfe As is evident by the testificat under the hand of Sir Thomas Burnet the petitioners phisician (produced with the said petitione) who is also one of the Kings phisicians and therefore Craveing That the saids Lords would be pleased to allow the petitioner his Liberty for his recovery as the said petitione bears The Saids Lords of there Majesties privie Councill haveing considered this petitione given in to them be the above Robert Hamiltone with the testificat mentioned therein and produced therewith They hereby Confyne the petitioner to the toun of Prestoun and a myle about the same And gives order and warrand to the Magistrats of Edinburgh and Keeper of there tolbooth To sett the petitioner at Liberty furth thereoff he first finding sufficient Cautione and Enacting himself in the books of privie Councill That he shall repair to the said toun of Prestoune Imediatly after his said Liberatione And that he shall keep his said confynement And not depairt furth the said toune and a myle there about as said is And that he shall appear befor the saids Lords of there majesties privie Councill upon Fourty eight houres warning when called for under the penalty of Ane Thousand Merks scotts In case he shall transgress in any pairt of the premisses

Liberation for Sir Robert Hamilton

Concerning the petition given in to the lords of their majesties’ privy council by Robert Hamilton, brother to Sir William Hamilton of Preston, showing that where the petitioner is their lordships’ prisoner in the tolbooth of Edinburgh these five months bygone for the causes only known to their lordships, and that he is extremely unwell to the hazard of his life, as is evident by the certificate under the hand of Sir Thomas Burnet the petitioners physician (produced with the said petition), who is also one of the king’s physicians, and therefore craving that the said lords would be pleased to allow the petitioner his liberty for his recovery as the said petition bears. The said lords of their majesties’ privy council having considered this petition given in to them by the above Robert Hamilton with the certificate mentioned therein and produced therewith, they hereby confine the petitioner to the town of Preston and a mile about the same, and give order and warrant to the magistrates of Edinburgh and keeper of their tolbooth to set the petitioner at liberty furth thereof, he first finding sufficient caution and enacting himself in the books of privy council that he shall repair to the said town of Preston immediately after his said liberation and that he shall keep his said confinement and not depart furth the said town and a mile thereabout as stated, and that he shall appear before the said lords of their majesties’ privy council upon 48 hours’ warning when called for, under the penalty of 1,000 merks Scots in case he shall transgress in any part of the premises.
