Act Mr Thomas Mitchell

Anent a Petition given in to the Lords of their Majesties privy Councill to Mr Thomas Mitchell minister of Kilmaro2nock Shewing that quher the petitioner being ane old and informe man of Fourscore years age, And so troubled with ane Palsie these thrie years bygone that he could take neither meat nor drink bot as it was given him by the hands of another persone, And haveing served in the Ministrie at Kilmarnock for the space of fourtie years, And haveing received great prejudice and Loss by the depredatione Committed by the highlanders upon the barrony of Kilmarnock in the year Jaj vjc nyntie who takeing his case to Consideratione The said Killmaronock as Patron of the parish kirk of Killmaronock Considering that he hade right by the act of Parliament to dispose upon the vaccand stipend of the said parish for pious uses with the samen, Did by his dispositione and assignation of the date the Eight day of December Jaj vjc nyntie two years assigne and dispone to the petitioner the vaccand and stipend of the said parish of Kilmaronock for the cropt Jaj vjc nyntie two years as the samen therwith produced would testifie, yet notwithstanding the petitioner would make no intromission be vertue therof untill first he hade the saids Lords warrand for that effect And Therfore humbly Craveing the saids Lords to take the premisses to their serious Consideratione And to appoint and Ordaine the haill Persones Lyable in the forsaid stipend to make payment therof to the petitioner as haveing right therto in maner abovewritten accorrding to the saids Lords dayly practise and order observed in the like cases, as the petitione bears The Lords of their majesties privy Councill haveing Considered this petition given in to them be Mr Thomas Mitchell with the disposition and assignation mentioned therin and produced therwith They heirby Allow to the petitioner The stipend of the above kirk of Killmaronick for the haill cropt and year of god Jaj vjc nyntie two, And Ordaines him to be readiely answered obeyed and payed therof be the heritors, fewars Wodsetters and others Lyable in payment of the Same And Ordaines letters of horning at his instance against them for that effect he produceing a decreet of Localitie and incaise ther be non Ordaines these Lyable to make payment to the petitioner of their respective proportiones of the said stipend according as they shall be Decerned be the Judge ordinary In Respect3 The said Mr Thomas Mitchell4 before extracting heirof has sworne and signed the oath of alledgance and signed the assurance prescryved by act of Parliament to their majesties King William and Queen Mary.
