Act of Banishment Captaine Patoune

The Lords of their Majesties privie Councell Having heard the report of the Committie appoynted to examine James Patoune Comonly called Captain Patoune and now prisoner in the tolbooth of Edinburgh who was seized and Committed for alleadged Correspondence against the Government And understanding that ther being papers found upon the said James Patoune Ther was a Letter amongst them of a suspicious Import Containing both false neues and some misticall names and phrases which names and phrases The said James Patoune refuised to explaine as also to declare upon oath who gave him the said Letter And the Lords Having Considered the Letter in their oune presence and Caused bring the said James Patoune from the tolbooth to the barr They ther sheued him the said Letter and againe Interrogat him about the forsaid disguised names and phrases Requyring him to declare upon oath what he knew of the meaning therof and who delyvered the said Letter to him Att least that he should Give his oath whither he knew the persone that delyvered to him the said Letter or not The said James Patoune refuised to Give his oath upon his said knowledge wherupon The saids Lords ordored the Act of parliament Jaj vic and seventie Against such who shall refuise to depone Against delinquents To be redd In his hearing By which Act all were obleidged to declare and depone their knowledge of any Crymes against the publict Laues and peace of the kingdome and of all the particulars relating therto under the paine of fyning and closs Imprisonment or banishment to their Majesties plantationes in the West Indies or elsewher as their Majesties Councell shall think fitt And then Having Againe Interrogat him if he uould declare his knouledge of the premisses upon oath as said is He still Contumaccously refuised to Give his oath For which his Contumacie The saids Lords of privie Councell Have Banished and Heirby Banishes the said James Patoune furth of their Majesties dominiones And ordaines him to be transported to any of their Majesties plantationes in America And in the mean tyme ordains him to be Carryed closs prisoner to the tolbooth of Edinburgh and from the tolbooth of Edinburgh to the Castle of Dumbrittaine And ordaines the Governour of the said Castle and in his absence the nixt Commanding officer ther To Receave the said James Patoune into the said Castle and detaine him closs prisoner therin untill occasione offer That he may be putt on board any ship Going for these plantationes And Recommends to Sir Thomas Livingstoune Commander in cheiff of their Majesties forces uithin this kingdome To Cause Convoy the said James Patoune under a sufficient Guaird from the tolbooth of Edinburgh Closs prisoner to the said Castle of Dumbrittaine Betuixt and the seventeenth day of January nixt to Come And not to suffer any persone to speake or Converss uith him by the way And ordaines the Magistrats of Edinburgh and Keeper of their tolbooth To detaine him closs prisoner therin till he be delyvered to the said Guaird.
