Act Mr Alexander Dalgarno
Anent a Petitione given in to the Lords of their Majesties privy Councill be Mr Androw Dalgarno called to be minister of Tyrie Shewing That quheras the saids Lords in the Competition betwixt the petitioner and Mr Alexander Jamisone anent the vaccand stipends of the Church of Tyrie Did most Justly grant Comission to the Earles of Erroll or Kintoir to take tryall of both their Lives and conversationes etc And to report the Same to the saids Lords And the petitioner haveing not only accquiesced to so Just and reasonable a Sentance Bot knowing that his title to the Church and his intrest in the parishioners was far preferable to that of Mr Jamesones Did most patiently wat the Earles of Erroll or Kintoir their appointement For puting the said Commission in executione Bot Mr Jamesone haveing made new applicatione to the saids Lords Andin the interim ther being a pretended report from the Earle of Kintoir Delivered to Mr David Moncreiff and presented by him to the saids Lords who did therupon preferr Mr Jamesone to the vaccand stipend of the said Church Cropt Jaj vjc nyntie two and preceidings which report Is now found to be a most Impudent and villaneous Forgery And besyde that the said2 Petitioner has the only Just and legall title to the said stipends he has bestowed and given out a Considerable part therof for repairatione of the Church of Tyrie So that albeit Mr Jameson hade been preferred upon a true and Just report no doubt the saids Lords would have burdeened his preferencanie with what was so Justly expended And Therfore Humbly Craveing the saids Lords to Consider the premisses and not only recall the act in favors of Mr Jamesone, Bot aither preferr the petitioner as haveing the only undoubted right therto, Or Recomend to the Clerks to writt to the Earles of Erroll or Kintoir to take tryall in the termes of the saids Lords former interloquitor which the petitioner should humbly accquiesce to as the petition bears The Lords of ther Majesties privy Councill haveing Considered a petition given in to them to be Mr Alexander Dalgarno called to be minister of Tyrie with the pretended letter by way of Report from the Earle of Kintoir mentioned in the petition Togither with a letter written by the Earle of Kintoir to William Black advocat Declaireing the pretended letter or report to be a notorious and base forgery The Lords of privy Councill Doe heirby sist all execution upon the act of councill granted in favors of Mr Alexander Jamesone anent the vaccand stipends of the said Kirk of Tyrie and Discharges the persones Lyable to make payment of any part of the said stipend be vertue therof Untill farder order of Councill And Recomends to and Requyres John Earle of Erroll Lord high Constable of Scotland Shireff principall of the Shyre of Aberdeen, And gives order and warrand to Androw Frazer of Kinmundie shireff depute of the said shyre to cause search for seiz upon and apprehend the persone of the said Mr Alexander Jamesone and Cause Convoy him prisoner under a sufficient guard to the city of Edinburgh and deliver him to the magistrats therof whom the saids Lords Does heirby Appoint to Comitt and detaine the said Mr Alexander Jamesone prisoner within their Tolbooth till farder Order of Councill Unles the said Mr Alexander shall give bond with sufficient Caution to the saids shireff principall or depute under the penalty of ane Hundred pund Sterling that he shall appear before the saids Lords of privy Councill upon the threteinth day of Aprill nixt And in caise they meet not that day upon the nixt Councill day Imediatly therafter and answers to what shall be laid to his charge anent the forgeing the said false letter or report And appoints the bond when taken to be transmitted to the Clerks of Councill betwixt and the said thretein day of Aprill nixt.
