Anent a Petition given in to the Lords of their majesties privy Councill be Mr Hew Nisbett late incumbent of the parishin of Kirkgunzeon within the presbytrie of Dumfrees Shewing That the petitioner haveing exerced the function of the Ministrie within the said parish these twentie years bygone to the satisfaction of the wholl parishioners and did yet reside therin with his familly as the testificat granted be them in his favors therwith produced would testifie quherin they shew unto the said2 Petitioner and his familly ther indigent and distressed condition Recomending the3 Consideratione therof to the saids Lords, Declaireing their willingness to pay to the petitioner what it should4 please the saids Lords to authorize them of the bypast vaccand stypend, And Declares that the petitioner hade no predessessor liveing nor any Successor nor meeting house within the parishin And seing the petitioner was most willing to give all obedience to the present government under their majesties king William and Queen Mary as also haveing the concurrance of the petitioners noble patron the Earle of Nitsdale with the Consent of the Countes his mother Declareing their willinges to pay their by past vaccand stipend of the said parish unto the petitioner And the stipend of the said parish being very small and inconsiderable not exceiding six hundred merks yearly And ther being resting in the heritors and possessors hands the stipend for the year Jaj vjc nyntie5 one and nyntie two And therfore Humbly Craveing the saids Lords would allow and give warrand for payment of the said two years vaccant stipend to the petitioner and to order the heritors and others Lyable to make payment therof according to use and wont as the Petition bears, The Lords of their majesties privy Councill haveing Considered this petition given in to them be the above Mr Heugh Nisbet with the Certificat of the parishioners and Consent of the Patron and his mother mentioned therin and produced therwith They heirby Allow to the petitioner the stipend of the above kirk of Kirkgunzean for the haill cropts and years of god Jaj vjc nyntie one and Jaj vjc nyntie two, And Ordaines him to be readiely answered obeyed and payed therof be the heritors fewars Wodsetters and others Lyable in payment of the same And ordaines letters of horning under the Signet of Councill against them for that effect upon productione of a Decreet of Locality And in caise their be non ordaines these Lyable to make payment to the petitioner of their respective proportiones of the saids two years Stipend according as they shall be Decerned be the Judge ordinary The said Mr Heugh Nisbet allwayes giveing bond and finding Suficient Cautione acted in the books of privy Councill That he shall deduce and allow of the first and readiest of the money therof (if need bees) to be Supper-added to the vaccant stipend Jaj vjc Eightie nyne Which is allowed for pious uses To Witt for repaireing of the Church, quire, mass and gleib wherwith the patrones consent is burdeined, And also swearing and signeing the oath of alledgance and signeing the assurance prescribed by act of parliament to their majesties King William and Queen Mary, And that before any one of the Lords of Privy Councill.
