Order anent Daniall Nicolsone and others
The Lords of their Majesties privy Councill being informed by Sir James Stewart ther Majesties advocat That upon information given him by John Eliot That Margrat2 Lands relict of Alexander Hamiltone of Coultcoat one of the macers before the Lords of Councill and Session, and Jean Lands Spouse to Daniall Nicolsone writter in Edinburgh have given ane recept under ther hands subscribed before Mr Joseph Clelland late minister at Dalserfe and one Robert Wishart as witnesses of poyson for the person of the said Daniall The Lord advocat gave order to the Magistrats of Edinburgh to seaze the said Margrat and Jean Lands and to search them, and the trunks, Chists boxes, or others in their houses for the said poysion, And to seaz upon the same if found, And that the baillie who searched Does report he can find no poyson on the persones or in the houses of the saids Margrat and Jean Lands Bot has put them under Caution in the books of privy Councill to answer when called for, And that the Lord Advocat has since examined both the saids Woemen showen that the recept alleadged subscribed be them And that they deny with solemn attestationes that the subscryptiones are their hands wryting, or that they ever knew or spock with the said John Eliot or any of the saids witnesses, Except Jean Lands sayes she knew Mr Cleilland to have been her husbands Client Bot did not speak with him these Eightein moneths And that Robert Wishart one of the witnesses being examined has Confesse to the Lord advocat that he sid dsubscryve witnes with Mr Cleilland to the forsaid paper at desyre of the said John Eliot, Who did take them off the street and desyred them to subscryve, bot that neither of them did See the said Margrat or Jean Lands subscryve the same ther names being at the paper when John Eliot produced it to them, And tha the Lord advocat haveing called for Eliot and Mr Cleilland, both of them are withdrawen The saids Lords of their Majesties privy Councill Doe heirby approve of what the Lord advocat and the baillies of Edinburgh have done in this matter, And Recomends to the Lord advocat to cause search for and secure in prison the persones of the said Daniall Nicolsone John Eliot Mr Joseph Cleilland and Robert Wishart and to examine them furder in this matter and make report to the Councill And appoints the Clerks of Councill in whose hands is the bond of Cautionrie subscribed be the saids Margrat and Jean Lands as principalls, and Mr William Calderwood advocat and David Callander writter as Cautioners to give up the said bond.
