Act for open prisone and taking off the Irons of James Broune

Anent the petitione given in to the Lords of their Majesties privie Councell Be Captaine John Broune present prisoner in the tolbooth of Edinburgh sheuing That wher the petitioner Having been detained a long tyme prisoner in the tolbooth of Edinburgh after his being taken prisoner at Cromdell upon applicatione to their Lordships Representing the bad conditione he uas in both as to his health and otherwayes Having nothing to mantaine himself upon Their Lordships were pleased to ordor him his Liberatione upon his Finding bond to appear when called And the petitioner Having been called before their Lordships he uas upon some Inconsiderat and rash expressiones sent prisoner to the tolbooth and appoynted to ly in the Irons during their Lordships pleasure And seing that the petitioner is very sorry that he should have Given their Lordships any offence by his rash and Inconsiderat expressiones And that by his Imprisonment uith the Irons on his Leggs they are so suelled and his health soe Impaired that It is not possible for him longer to Continow In this conditione uithout a seen and manifest hazard of his Life And therfore Humblie Craving their Lordships to take the premisses to their Consideratione And to ordaine the petitioner to be sett at Liberty upon his finding Cautione to appear when called as the said petitione Bears The saids Lords of their Majesties privy Councell Having Considered this petitione given Into them Be the said Captaine Broune They Heirby Give ordor and uarrand to the Magistrats of Edinburgh and Keeper of their tolbooth To cause take off the Irons from off the petitioner And to allow him the benefite of open prisone The saids Magistrats and Keeper being alwayes ansuerable for his safe custody
