Act
Act For revalueing of the shyre of Forfarr
Anent a Petition given in to the Lords of ther majesties privy Councill be David Erskine of Dun and John Fullartoune of Kinaber Commissioners for the Shyre of Forfar for themselves and in name and behalf of the remanent heritors of the said shyre who adhere to them Shewing That quher they the Commissioners for the said Shyre presented to the parliament ane act for revaluatione in name of the petitioners themselves, And the forsaid heritors Which act the Commissioner his Grace and estates of parliament were willing to have past if the throng off affairs the last day of the parliament hade not hindered the reading and voteing therof And moved them to Remitt the matter to the saids Lords, And Seing That the forsaid act does now stand remitted to their Lordships and that the contents therof are not only most Just and reasonable Bot the comon desyre almost of the wholl heritors of the shire, And that now whill severall of the heritors concerned are in toune Its fitt this bussines be dispatched without the necessitite of new citatione And Therfore Humbly Craveing the saids Lords to take the premisses to their consideration And to ordaine their said shyre to be revalued in the termes of the forsaid act by turning the same into ane act of Councill with all other orders necessary as the petition bears The Lords of their Majesties Privy Councill Haveing Considered the petition given in to the be David Erskine of Dun and John Fullertoune of Kinaber Commissioners for the Shire of Forfar for themselves and in name and behalf of the remanent Heritors of the said shyre adhereing to them with ane act and Remitt be the estates of Parliament to the privy Councill Remitting to them to consider the petitione insert in the said act anent revalueing of the said shire And authorizeing and Impowering the Councill to doe therin as they should find Just The Saids Lords of privy Councill Doe heirby Allow all the heritors of the said shyre duely qualified by takeing the oath of alledgance and assurance to meett at Forfar and revalue the former valuationes of the said shyre and to reitifie and revalue not only for themselves bot for the haill heritors concerned as they shall find cause, And the saids Lords Doe heirby Nominat and appoint Patrick Earle of Strathmore to be conveener of the above heritors and valuators with power to his Lordship to apoint the first dyet of their meeting, And to the saids heritors and valuators to Choise their oun precess And to meet therafter at severall dyets as they themselves shall appoint And in caice they faill to meet at the saids dyets which shall be appointed be them, Then the saids Lords authorize the said Earle to appoint any other dyet and to call and Conveen the saids heritors and valuators to meet theron, And authorizes and Impowers the saids valuators to call all parties haveing intrest And to take all maner of probation by witneses, writt, or oath of partie as they shall find requisit and to expedd the said Revaluatione with all Dilligence and to Setle and give out the roll therof subscryved with their hands and by their Clerk as the Just valuatione of the said shyre and rule of payment accordingly in all time comeing, And that all Collectors of the supply or of any other publict burdein payable out of the said Shyre by valuation may exact and uplift the same by the forsaid new valuatione and roll therof to be established as said is, And when once established and no otherwayes provydeing allwayes the saids valuators keep up the old totall of the said shyre and no wayes diminish the same in this new valuation or revluation and appoints any five of the saids valuators to be a quorum certifieing such as shall not Compeir to give their oathes when requyred they shall be holden as confest, And Declairs the forsaid roll of valuation or revaluation to stand good against them whither they Compeir or not And Authorizes the saids valuators to appoint Committies of their oun number who shall make report to them one or two of the Commissioners to the parliametn of the said shire being allwayes one of the saids Committies, And generally to doe all and every thing Requisit and usuall in such caices And the saids Lords Doe heirby Declair That all payments of Cess and other publict burdeins which shall be made medio tempore within the said shyre are to be conforme to the said valuatione Untill this new valuatione or revaluation be perfyted and Compleited.
