Act Mr John Auchterlony
Anent a Petition given in to the Lords of their Majesties privy Councill be Mr John Auchterlony eldest Lawfull sone to the deceast Mr David Auchterlony minister at Forden Shewing That quher ever since the decrease of his said father which was in the end of February Jaj vjc nyntie one years he hade at the earnest and unanimous desyre of the haill members of the sessione of Fordon and out of special love2 to that cure faithfully served the samen by preaching praying visiting the sick and administrating the sacrament both of Baptisme and the Lords Super, wherfore upon the petitioners applicatione to the saids Lords in January last by past, The saids Lords ware pleased to conferr upon the petitioner the half years stipend then due and authorize and Impower the petitioner to uplift the samen by their act dated at Edinburgh the fourtein day of January Jaj vjc nyntie two years And seing alse weell since as before that tyme he hade served the said cure and suplied the vaccancy with gods assistance to the contentment and satisfaction of the haill parishoners And conform to his dutie have obeyed the lawes in praying expresly for their majesties King William and Queen Mary and reading all acts and proclamationes of Councill alse weell relative to thanksgiveing as to fasts that came to his hands which would appear to the saids Lords by a3 testificate subscribed by the heritors and elders of the said parishin written by their session Clerk and sent allong with the petitioner for that effect Morover it hade pleased the almightie god to to4 bless him with the Love and favor of his hearers that he hade gotten a Call from to be their ministers subscribed be the haill elders and heritors of the paroch And seing he hade served the Cure and supplied the vaccancy these twelue moneths by gone alse weell as before and have a Call to be their minister and was content conforme to the saids Lords act to take the Oath of alledgance presently if desyred Lykewayes Seing ther is no presbytrie yet established in that shyre And Therfore Humbly Craveing the saids Lords to allow the petitioner the bygone years stipend and would authorize and Impower him to uplift the samen for that year and5 in tyme comeing (6seing he has a Call aiy and whill he be orderly and legally admitted minister of the said kirk, Conforme to the present government of the Church in this kingdome as the petitione bears, The Lords of their Majesties privy Councill Haveing Considered this petitione given in to them be the above Mr John Auchterlony with the former act of Councill, And the testificat of the heritors and elders of the above kirk mentioned in and produced with the said petition, They heirby Remitt this petition to the Lords of their majesties thesaurer in caise the above kirk of Forgane be of ther majesties patronage And Recomends to their Lordships to grant the desyre therof for the year Jaj vjc nyntie two And incaise the same be not of their Majesties patronage They heirby allow the petitioner the Stipend of the said Kirk of Forgane for the haill cropt and year of god Jaj vjc nyntie two, He first produceing the Patrones consent to the Clerks of privy Councill, And also swearing and signeing the oath of alledgance and signeing the assurance appointed by act of Parliament before extracting heirof And Ordaines him to be readily answered obeyed and payed therof be the heritors fewars wodsetters and others Lyable in payment of the same, And ordaines letters of horning under the signet of Councill against them for that effect, The petitioner allwayes produceing a Decreet of Localitie, And in caise ther be non Ordaines these Lyable to make payment to him of their respective proportiones of the said years stipend according as they shall be Decerned by the Judge ordinary.
