Act Mr Samuell Spalding minister

Anent a Petition given in to the Lords of ther Majesties privy Councill be Mr Samuell Spalding minister at Partain Shewing That the kirk of Partain hade been vaccand thir four years by past since the decease of William Cunninghame of Enterkine last minister their, And that albeit the petitioner was not ordained minister of the said parosh of Partoune till of late yet by the Call of the said parish and appointment of the presbytrie he preached and used all the other parts of his ministeriall functions within the said parish since May Jaj vjc nyntie one years as appeared by ane call from the parish and ane act of the presbytrie therwith to show to the saids Lords Lykeas Robert Glendining of Partoun patron of the vaccand stipend therof Considering that he hade used all the parts of his ministeriall function within the said parish since may Jaj vjc nyntie one hath by his gift of the date the sixteinth day of January Jaj vjc nyntie thrie years gifted to the petitioner the stipend of the said parish and benefite of the gleib and manss of the cropt and year of god Jaj vjc nyntyie two years as appeared by the gift therwith produced, Be vertue of all which the petitioner hath good and undoubted right to the forsaid years Stipend and benefite of the mans and gleib, And Therfore Humbly Craveing the saids Lords to grant warrand for raiseing of letters of horning and poynding against those Lyable for payment of the forsaid years Stipend of the said paroch and years benefite of the manss and gleib upon production of the Decreet of Locallity of the said parish as the petition bears The Lords of their majesties privy Councill haveing this petition given in to them be the above Mr Samuell Spaldin with the call testificat of the Presbytrie and consent of the patron mentioned therin and produced therwith, They heirby allow to the petitioner the steypend of the above kirk of Partan with the benefit of the manss and gleib for the haill cropt and year of god Jaj vjc nyntie two, And Ordaines him to be readiely answered obeyed and payed therof be the heritors fewars wodsetters and others Lyable in payment of the same And Ordaines letters of horning under the signet of Councill against them for that effect He produceing a Decreet of Locallitie, And in caice ther be non Ordaines these Lyable to make payment to the petitioner of their respective proportiones of the said years stipend and rent of the manss and Gleib According The petitioner all wayes before extracting heirof swearing and signeing the oath of alledgance and signeing the assurance prescribed be act of Parliament to their majesties King William and Queen Mary And that in presence of any one of the Lords of Privy Councill.
