Liberatione The master of Balmerinoch

Anent the petitione Given in to the Lords of their Majesties privie Councell Be John Master of Ballmerinoch Sheuing That the Master of Ballmerinoch being Committed prisoner to the Castle of Edinburgh in the month of June last For not Finding Cautione to pay ane years valued rent Conforme to their Lordships sentence Hes Continoued in the said prisone ever since now by the space of ten weeks wherby both his health Is much Impaired and his privat affairs Intirely neglected And seing the said petitioner hes alwayes hitherto Lived quietly and peacably And being now desyrous for re-establishing his health and putting his affairs againe into some ordor to be at Liberty Is content if their Lordships shall think fitt to Find Cautione not only to find Cautione to live peacably in tyme Coming But also to Appear when called for And therfore Humbly Craving their Lordships to Consider the prejudice the petitioner hes already sustained both in Regaird of his health and bussiness and the Great Inconveniency of a Longer Imprisonment And to ordaine him to be sett at Liberty The petitioner being alwayes uilling (if it shall be thought necessary) to find Cautione in the tearms aforsaid as the said petitione Bears The saids Lords of their Majesties privie Councell Having Considered this petitione given in to them Be the above Master of Balmerinoch uith the testificat of the petitioners Indispositione produced theruith They Hierby Recommend to the Earle of Leven Governour of the Castle of Edinburgh And in his absence Gives ordor and uarrand to the Deputy Governour or nixt Commanding officer ther to sett the petitioner at Libertie furth therof And Confynes him to the toune of Edinburgh and suburbs therof In respect he hath Given bond and found sufficient Cautione acted in the books of privy Councell That he shall keep his Confynment and not goe uithout the bounds of the same And that in the mean tyme He shall Live peacably under and uith all submissione to the present Government of their Majesties King William and Queen Mary And that he shall not Act Consult nor Contryve any thing in prejudice therof nor Converss or Correspond uith rebells And that he shall appear when called for under the penaltie of five Hundred pounds sterline In case he shall transgress in any part of the premisses
