Act Anent The Countess of Dunfermling

Anent the petitione given In to the Lords of their Majesties privie Councell Be Jean Countes of Dunfermling sheuing That the petitioner being provyded by her Contract of marriage to six thousand merks yearly or sixtie Chalder of victuall free of all burdens out of her husbands estate And Having gotten nothing therof these four years bygone wherby she was putt to Great Straits and necessity to borrow and Contract debts for mantinence of her and her daughter and familie and is now reduced to a hard conditione for the future The petitioner did therfore petitione the saids Lords of their Majesties privie Councell and Lords of Thesaury For ane aliment to her and her daughter and family out of her husbands estate for bygones and in tyme coming Conforme to her Contract of marriage but the same was refuised to her Because she had not her Contract of marriage to produce for Instructing her said provisione And seing it cannot be supposed that it could be Less And that Mr John Nisbett wryter to the signet who wrote the said Contract of marriage Hes now produced the scroll therof And is ready to depone upon the verity of the same And therfore Humbly Craving his Grace and their Lordships will be pleased to Grant to the petitioner ane Aliment for bygones and in tyme Coming Conforme to her said Contract of marriage out of her husbands estate or otherwayes to Grant a pass to her and her daughter and servants to goe to France to take share uith her husband and be mantained ther as the said petitione bears The Saids Lords of their Majesties privie Councell Having Considered this petitione given in to them Be the said Countess of Dunfermling uith a scroll of her Contract of marriage mentioned therin and produced therwith They allow the said Countess ane aliment of Fourty chalders victuall yearly out of her husbands estate Conforme as the Lords Commissioners of their Majesties Thesaurie shall appoynte the Locality of the same The petitioner alwayes paying the publict burdens of the Lands out of which her said aliment is to be uplifted And that for the Cropt Jaj vic nyntie tuo sincesyne and in tyme coming And ordaines all executione by decreits and Letters of horning to pass at her Instance for the said Fourtie chalders victuall Against the tennents and possessors of the saids Lands To be allocat by the saids Lords of Thesaury
And that according to the proportione and kynds of victuall payable be the saids respective tennents and possessors therof And ordaines the horning to pass heiron on fifteen dayes and others in forme as effeirs
