Recomendation anent Doctor Oliphants bond

Anent the petitione Given in to the Lords of there majesties privie Councill be Charles Oliphant Doctor of Medicine and Charles Oliphant of Langtoun his father one of the Clerks of Sessione Shewing That where The petitioner the said Charles Oliphant younger some moneths since being occasionally with others In company with Mr Dickson doctor of phisick There happend tuixt them as the unhappie consequence of drinking some difference And which next day upon ane accidentall rencounter did occasione ane Scuffle betuixt them For which the petitioner by warrand of there Lordships wes Imprisoned in the tolbooth of Edinburgh for some dayes And wes Lykewayes appoynted to give bond to the Generall receiver for Ane Hundreth pound sterling Wherein the petitioner the said Charles Oliphant elder wes cautioner And this being the particular the petitioners presently Lye under In relatione to this bond It is Humbly offered to there Lordships consideratione In behalf of the said Charles Oliphant younger And besydes he is but ane youth not much past majority And in all the former tract of his Lyfe hes Endeavoured to Live as ane peaceable subject This being the first quarrell that ever he hade in his Lyfe So hes no visible fortune in the world where upon to Rune the hazard of Lyeing under the obligatione for such ane Considerable fyne to him And besydes what happened on this occasione wes meerly accidentall and out of foolish humor and passion without any previous designe whatsomever to give in the Least any offence to authority And as to the petitioner the said Charles Oliphant elder It is very well knowen that the Supplicant ane great Charge of a numerous Family And hes bestowed what he is able on his said sone in his educatione whereby It will prove very greivous to the petitioner If upon this misfortunat offence of his sones The petitioner shall rune the hazard of paying this soume or any pairt thereof as Cautioner in the said bond which hes moved the petitioners Joyntly to make the said applicatione to there Lordships in ane case so Circumstantiall towards the petitioners being free of the said bond And of any fear or hazard as to the paying of any of the Soumes therein contained And therefore Humbly craveing That Sieing the granting of the said bond by the petitioner the said Charles Oliphant younger wes in obedience to there Lordships order who is resolved for the future as ever hitherto (the former single instance being excepted) to Live quyetly and peaceably under authority And as to the petitioner the said Charles Oliphant elder his becomeing Cautioner in the said bound wes out of his parentall Love to his sone to Liberate him out of prisone And upon ane confidence he hes of the saids Lords there goodnes and bountie with regaird to his tender years To pass by such ane rash and foolish act That therefor There Lordships upon all these Considerationes aither by themselves or by there recomendation to the Lords of Theasury In what way There Lordships shall2 think fitt will be graciously pleased to discharge any such fyne or diligence upon the said bond And will appoint the same to be given up be Sir Patrick Murray in whose Name The said bond wes granted being Cash keeper for the tyme which will be ane act suteable to there Lordships honour and bounty And put ane inexpressible obligatione upon the petitioners who shall use there outmost endeavours for the future to Live as becomes dutyfull and peaceable subjects and under ane due sence of there Lordships favour and kyndnes all the dayes of there Lyfe As the said petition bears The Saids Lords of there Majesties privie Councill haveing Considered this petition given in to them be the above Charles Oliphant They hereby recomend to the Lords Commissioners of there majesties theasury to superceed execution upon the above bond for some tyme And in the mean while to wreitt favourably to the Kings majesty in this effair that the bond may be given up But appoints the Doctor to continow under baill for his peaceable3 behaviour
