Anent the petitione given in to the Lords of his majesties privie Counsell Be Sir John Ereskine of Alva Shewing That wher the petitioner was Duely and Lawfullie Served and in Speciall to the deceast Sir Charles Ereskine of Alva his father befor the macers in the moneth of Febrwary Last in the Lands of Cambuskenneth and others contained in his service Conforme to the Late act of parliament cum benificio in ventarii And upon his Service and retoure obtained ane precept furth of the Chancellarie direct to the Shirreff of Clackmannand and his deputies for infesting him in the Lands and others foirsaids which precept could take no effect in respect ther was no Shirreff in that Shyre nether would […] Rollo of Woddsyde who had ane Commissione to exerce that office accept of the Same Wherby the petitione is extreamly prejudged And will be Still more wnles ther Lordships provide remeid And therfore humbly craveing to the effect eftermentioned As the said petitione bears The Saids Lords of his majesties privie Counsell haveing considered the above petitione they heirby nominat appoint and awthorize Leivetennent Collonell John Ereskine deputy governour of the Castle of the Stirleing to be Shirreff of the Shirreffdome of Clackmanan in that part for this speciall effect to infeft the said Sir John Areskin of Alva the petitioner in the Lands and others abovementioned Contained in his precept and retoure

Anent the petitione given in to the Lords of his majesties privie Cownsell be Jean Ruthven Spouse to Mr Ruthven ane native Scottish gentlemen Shewing that wher the petitioner and husband with thrie childrein bowndeing for Belfast in the kingdome of Ireland from Holland with ane intentione to abyde ther five weeks sance or therby were wnfortwnately taken with the Frenches within five or six mylls of Donnichedie And Lost all the Subsistance they had with them upon what purpose or intentione the petitioner knous not they took the petitioners husband with them And Sett the petitioner and her thrie childrein on Shoare upon the accompt as the petitioner Supposed of her childreins makeing a great noise and clamour near to Donnachedie efter they had taken all the petitioners had and She remained ther Some few dayes upon the charitie and good will of good christeans and with all advanced the petitioner money for her transportatione to Scottland All this tyme her husband was captive with the Frenches and She hes gotten no accompt of his Liberatione So that the petitioner was necessitat to come from Ireland to Scottland expecting to Sie him or atleast to hear from him But nether hes She Sein nor heard from him Since Soe that now the petitioner being frustrat of her expectatione She is necessitat with ane sorrowfull heart to goe from hence with her thrie poor childrein to Londone and from thence to Holland the place of her nativitie Supposeing that be the road She might gett more informatione of his Liberatione And in respect of her great necessitie and Loss She is trysted with And therfore Humbly craveing to the effect eftermentioned As the said petitione bears Which petitione being this day red and considered be the Saids Lords of privie Counsell They heirby recomend Sereowsely to the Lords Commissioners of his majesties thesaurie to cause pay to the petitioner Such a Soume as they Shall find expedient to transport her and her childrein owt of the kingdome in respect of ther present necessitie and want and circumstances of her conditione

Anent the petitione given in to the Lords of his majesties privie Counsell Be George Earle of Southerland Shewing That wher by ther Lordships act of the date the eight of Augwst Jaj vic nyntie five yeirs The Two Thowsand punds appointed by ther Lordships to be payed to the petitioners doughter the deceast Viscount of Arbuthnet for alimenting her childrein the said yeir Jaj vic nyntie five was ordained to be payed to the petitioner as her executor and keeper of the childrein in maner mentioned in the said act herwith prodwced As Likewayes ther Lordships act of the fourth of Febrwary Jaj vic nyntie Six, ther was eight Hundereth merks modified to be payed to the petitioner for the present Viscounts bed and board allenarly As the said wther act also prodwced bears. Notwithstanding wherof Alexander Arbwthnot tutor refwsed to pay five Hundereth merks yet resting of the Thrie thousand merks As alsoe he refwses to make payment or grant any allowance for the present Viscounts cloaths School fies and servants waiges And of other accompts and necessars furnished to him besydes his bed and board which for tyme past will amount to the Soume of Four Hundereth pwnd Besydes the said Five hundered Merks And owght aither to be modified or otherwayes setled for the tyme to come That the petitioner may not be pwtt to any actione for everie Litle necessarie advance that Shall be made for the Viscount As Likewayes the said twtor ought to deliver to the petitioner the said Viscownt his chamber fwrniture bed table etc which he wrongowsely keeps up And therfor humblie craveing ther Lordships in prosecution of what they have alreadie Done to ordaine the said tutor to pay to the petitioner the said five hundereth merks resting as said is As also the foirsaids other Soumes advanced of necessars for The Viscount As Likewayes to delyver up to the petitioner the foirsaid chamber furniture And withall aither to modifie or sett Downe Some other rwle wherby the said Viscount his other necessaries besyde without furder process As the said petitione bears Which petitione being this day red and considered be the saids Lords of privie Counsell And ansuers therto be way of petitione for the tutor of Arbuthnot they allow the Earle to insist for payment of the five Hundereth merks upon the former acts of Counsell And recomends to the Lords of Counsell And recomends to the Lords of Counsell and Sessione to determine in and discuss the haill remanent points contained in the said petitione and ansuers both as to bygone necessars and in tyme comeing And that Summarly without necessitie of abideing the ordinarie Course of the roll

Act of exoneration Anent the Mint

The Lords of his Majesties privie Councill having this day Considered the sederunts and proceedings of severall Committees appointed Anent his Majesties Mint which have mett since the seventeenth day of September Jaj vic nyntie Four years till the Eleventh day of August Jaj vic nyntie six Conforme to the Acts of parliament Jaj vic Eightie sex and Jaj vic nyntie five To Take tryall of the Mint and the fynes of the severall species of Current Coyne which have passed his Majesties Irons During the space abovementioned And the Report of the said Committie Whereof the tenor Folloues Report of the Committie Anent the Mint in its severall sederunts begun the seventen of December Jaj vic nyntie four and Continuing to the Eleventh of Agust Jaj vic nyntie six years. Edinburgh 17th December 1694 Sederunt att the Mint house The Earls of Annandale president of the Councell for the tyme, The Earls of Southerland Cassillis and Leven The Lord Carmichaell and Lord Justice Clerk – Ther being also present The Generall Master Wairden Essay Master and other officers of the Mint with the Deacon of the Goldsmiths and James Cockburn Goldsmith in Edinburgh. The Act of parliament of the Fourteenth of June Jaj vic Eightie six Anent the Mint was read and the pixis opened And the Committee having Called for the Record of the Mint, Compared therwith the Journalls of Essay as reported by the Essay Master And Beginning with the first quarter of the first year Viz From the Fifteenth of November Jaj vic Nyntie to the Fifteenth of February Jaj vic nyntie one They Found the Nynteenth Journall to be by the Report one Graine of Fynes more then the allouance in the Act of parliament tho sett doun in the Record only Eleven deniers three Grains which is the Just standard with the Remeid so that the Essay masters report Differs in a Graine from the record And this Journall Being afteruards upon the Eight of March Jaj vic nyntie five tried by the then Sederunt as to the Fynnes It was found to be Eleven deniers four Grains and a quarter of a Graine of Fynness which is one graine and a quarter above the Standard and Remeid sett doun in the Record and a quarter of a Graine above the essay masters report But the officers of the mint Informed the Committie that ther was a particular Act of Counsell allowing this Journall to be Given out And this act they are to produce and which they Immediately produced dated the tuenty ninth of January Jaj vic nyntie one As to all the rest of the Journalls of this first quarter The Essay masters report of Fynness did aggree with the Book and were according to the allowance of the act of parliament for standard and Remeeds but were not then tried The second quarter from the Fifteenth of February to the Fifteenth of May Jaj vic nyntie one The Committie Find the Essay masters report of fynness and the Record to aggree as to the all the Journalls And that they are according to the allowance of the Act of parliament for Standard and Remeeds Except the thirettieth Journall which by the Essay masters report is one Graine fynner then the allouance in the Act of parliament tho it be marked in the Record to be only Eleven deniers three Grains which is a Graine Less But none of their Journalls were then tried The third quarter from the Fifteenth of May to the Fifteenth of August Jaj vic nyntie one The Essay masters report of Fynness Agrees with the Record And they are Conform to the Act of parliament except the threttie nyne Fourtie one and Fourtie tuo Journalls whereof the Essay masters report is one Graine above the allouance of the Act of parliament and what is sett doune in the Record But none of these Journalls then tried The Fourth quarter from the Fifteenth of Agust to the Fifteenth of November Jaj vic nyntie one All the Journalls right as above except the Fiftie and Fiftie three Journall whereof the Report is one Graine above the allowance in the Act of parliament and what is sett doun in the Record But none of these Journalls were then tried The second year first quarter from the fifteenth of November Jaj vic nyntie one to the fifteenth of February Jaj vic nyntie tuo The Essay masters report of fynnes of all the Journalls agrees with the Record And they are Conform to the Act of parliament And so of the second quarter from the Fifteenth of February to the Fifteenth of May Jaj vic nyntie tuo Except the seventie one Journall which both by the report and Record is Eleven deniers four Grains which is one Denier above standart and Remeid But the Record in the value of the Remeids setts down only the value of one Graine And so the King is not overcharged with the Grain above the Remeid But none of these Journalls then tried: The Third quarter from the fifteenth of May to the fifteenth of Agust Jaj vic nyntie tuo And from the fifteenth of Agust to the fifteenth of November the same year The Essay masters report of Fynnes agrees with the Record And all the Journalls are Conforme to the Act of parliament But none of them were then tried The Third year first quarter from the Fifteenth of November Jaj vic nyntie three And the second quarter from the fifteenth of February to the fifteenth of May Jaj vic nyntie three And Fourth quarter from the fifteenth of Agust to the fifteenth of November Jaj vic nyntie three The Essay masters report of fynness aggrees with the Record And all the Journalls are Conform to the Act of parliament But none of them were then tried The Fourth year first quarter from the Fifteenth of November Jaj vic nyntie three to the fifteenth of February Jaj vic nyntie four And so furth for the second third and fourth quarters to the Fifteenth of November Jaj vic nyntie four the Essay masters report as to the fynnes aggrees with the Record and all the Journalls Conforme to the Act of parliament But none of them tryed To Remember that all thir Journalls except what was afteruards Seperatly tryed were melted into one lignet and so tried in the sederunt Agust Jaj vic nyntie Six As Lykewayes that the Clerk of the Mint Informes tho the Record doe differ from the Essay masters report yet it is Conform to the warrand for recording that he received under the Essay masters hands Item the Committie tried the weight of the fourtie shilling and ten shilling pounds of the Journalls of the four whole quarters of the first year from the Fifteenth of November Jaj vic nyntie to the Fifteenth of November Jaj vic nyntie one And of the first quarter of the second year from the fifteenth of November Jaj vic nyntie one to the fifteenth of February Jaj vic nyntie tuo And from them aggreable to the standart of weight with the Remeids appointed by the Act of parliament. parliament as to the standard and Remeids therein determined Except as to fynnes the nynteenth Journall of the first quarter of the first year dated the tuelvth of February Jaj vic nyntie one which was found upon tryall one Graine and a quarter above the Remeids and standart for Giving out whereof a particular Act of Councell is produced And the threttie Journall of the second quarter the said tract of tyme And all in a matter wherein it is almost Impossible that a Just exactness can alwayes be obtained It is the Committies opinion That the Generall Master and whole officers of the Mint above mentioned for the years quarters and space above sett doune be exonered and that they should have ane Act of exoneration and also of approbation granted them by the Lords of Councill for their Just standard with the Remeid so that the Essay masters report Differs in a Graine from the record And this Journall Being afteruards upon the Eight of March Jaj vic nyntie five tried by the then Edinburgh the Threttie one of December Jaj vic Nyntie four Sederunt at the Mint house The Earle of Annandale preses The Earls of Southerland Cassills Leven and Forfar The Lords Carmichaell and Hattoune The Committie upon tryall of the piles of weights Found the Mints pile of weights to be more then the Thesauries And the Dean of Gilds pile more then the Mints and Having tried the ponds of the five shilling starling the tuenty shilling Scotts and the five shilling Scotts peices by the Dean of Gilds pile of weights They Found tuo pounds of the five shilling starling peeces and one pond of the tuenty shilling Scotts peeces and one for the five shilling Scotts peeces all exact of the weight appointed by the Act of parliament And having tried the weight of the five shilling sterling peeces In the severall Journalls mentioned in the former sederunts They Find the Essay of the Eightie seven Journall Fourth Quarter second year viz from the Fifteenth of Agust to the fifteenth of November Jaj vic nyntie tuo halfe a Grain above the Remeids alloued by the Act of parliament And having also tryed the weight of the tuenty shilling Scotts and five shilling Scotts peices in the Journalls where they are mentioned in the former sederunts They Find them Conform to the Act of parliament within the Remeids therein alloued Item in the third quarter Fourth year Viz from the Fifteenth of May to the fifteenth of Agust Jaj vic nyntie four They Find the tuenty shilling Scotts and five shilling Scotts peices of the Journall one hundred and threttie five and one hundred and threttie six halfe a Grain weight above the weight of the Act of parliament and the Remeids therein alloued Item the Essay peice of Fynnes of the threttie fourth Journall dated the Eighteenth of Aprile Jaj vic nyntie one which is in the Second quarter of the first year Being tryed by the Committie was found to be halfe a Grain fynner then the precise standart of the Act of parliament but halfe a Grain less then the remeid The standart of the Act being Eleven denier tuo Grains and the remeid one Graine under or above To Remember that in the principall Record this Journall is marked to be Eleven denier and tuo Grains and nothing over Edinburgh Sixth March Jaj vic nyntie five The Councill having mett this day at the Mint house They made the remitt to the parliament whereupon the seventeenth Act of the parliament Jaj vic nyntie five ensheued And the deacon of the Goldsmiths and James Cockburne Goldsmith being present They tryed the essay of fynnes of the Nyntie five Journall of the sixtie fourtie and ten shilling Scotts peices dated the threttie of November Jaj vic nyntie tuo in the first quarter of the third year viz from the Fifteenth of November Jaj vic nyntie tuo to the fifteenth of February Jaj vic nyntie three And they found it to be Eleven deniers one Graine and a fourtie part of a Graine finnes which is three Fourths of a Graine belou standart But within the Graine of Remeid To remember that this Journall is marked in the record to be one Graine worse then the standart Edinburgh the Eight of March Jaj vic nyntie five Sederunt at the Mint house The Earls of Mortoune and Forfar Viscount of Tarbat and Lord Funtanhall The Committie tried the essay of finnes of the fourtie shilling peice of the nynteenth Journall dated the tuelth of February Jaj vic nyntie one being in the first quarter of the first year And finds the same to be Eleven deniers four Graines and a quarter of a Graine of finnes which is tuo Grains and a quarter of a Graine better then the standart and one Graine and a quarter of a Graine above the remeid But the Committie was told that this Journall was allowed to be Given out by act of Councill And the Act of Councill was produced dated as above To remember That in the record this Journall is marked to be only Graine better then standart which is the remeid But the Essay masters report Bears it to be tuo Grains better. The tuo Journalls viz the thretteenth journall the nynth of September Jaj vic nyntie five and the fourteenth Journall the tuelvth of September Jaj vic nyntie five Both fourtie shilling peices were taken out to be tryed as to the finnes And the said thretteenth Journall which was reported by the Essay master to be Eleven Deniers tuo Grains and a halfe fynnes was Found to be Eleven deniers tuo Grains and some more so better than standart But within the remeids And the fourteenth Journall foresaid reported by the Essay master to be Eleven deniers and one Graine was Found upon tryall to be Eleven deniers one Graine and some more And so tho not full standart within the remeids Item the tuo Signetts abovementioned taken out to be tryed And the first Signet from the fifteenth of November Jaj vic nyntie to the fifth of december Jaj vic nyntie four was essayed and found to be full standart and some more but within the remeids And the second Signet of the Essayes from the third of Agust Jaj vic nyntie five to the fourth of May Jaj vic nyntie six being also tryed as to the fynnes was Found to be Eleven Deniers one Graine and a quarter and so three quarters of a graine below standart but within the Remeids This being the particular accompt of the dilligence of the Committies from tyme to tymne in the premisses And they having Found all the Journalls essayed by them aither separatly or melted doun in Signets Conform to the Acts of parliament Jaj vic Eightie six and Jaj vic nyntie five both as to the weight and fynnes In manner abovementioned to be Conform to the Act of parliament as to the standard and Remeids therein determined Except as to fynnes the nynteenth Journall of the first quarter of the first year dated the tuelvth of February Jaj vic nyntie one which was found upon tryall one Graine and a quarter above the Remeids and standart for Giving out whereof a particular Act of Councell is produced And the threttie Journall of the second quarter the said year And threttie nyne Fourtie one and fourtie tuo Journalls of the third quarter the said year and Fiftie and fiftie three Journalls fourth quarter said year And the seventy one Journall of the first quarter of the second year which seven Journalls All before Lord John Hamilton was Generall by the Essay masters report appeared to be about a Grain above Standart and the remeid but were not tryed separatly or otherwise then when melted doun in Signets which was found to be Conforme to the Act of parliament as above and except as to the weight the Eightie seven Journall in this fourth quarter of the second year and one hundred and threttie five and ane hundreth and threttie six Journalls in the third quarter of the fourth year which three Journalls were found to be each of them halfe a Graine above the standard of weight and Remeids alloued by the Act of parliament Which Errors being but small and all over on the safe syde that is above standard and Remeids And very few in so Long a tract of tyme And all in a matter wherein it is almost Impossible that a Just exactness can alwayes be obtained It is the Committies opinion That the Generall Master and whole officers of the Mint above mentioned for the years quarters and space above sett doune be exonered and that they should have ane Act of exoneration and also of approbation granted them by the Lords of Councill for their full securitie This report made by his Majesties Advocat by order of the Committie that sate the Eleventh of Agust Jaj vic nyntie six which being Compared with the Minuts at Sight of the Lord Ruthven Conform to ane order of privie Councill was Found to aggree Sic Subscribitur Ruthven James Steuart The saids Lords of his Majesties privie Councill Doe heirby approve of the Committies above Report And of the Generall and Master and other officers in his Majesties mint house their actings and proceedings in their respective stations and offices from the fifteenth day of November Jaj vic nyntie years to the fourth day of May Jaj vic nyntie six Being the whole tyme revised tryed and examined by the forsaid Committie And Finds that they have acted honestly and faithfullie in their severall stations And therefore the saids Lords have exonerated and discharged And heirby Exonerate and Discharge the said Generall Master and haill other officers of his Majesties Mint house of their tryalls in their respective offices and stations for the years quarters and spaces sett doun in the said report from the said fifteenth of November Jaj vic nyntie years to the fourth day of May Jaj vic nyntie six And declares them free from being Called in question and fullie Indemnified therfor in any tyme coming.
