Act For a Collectione to build a bridge at Neither Queech

Anent a Petition given in to the Lords of their Majesties privy Councill be John Lord Burleigh James Rankin of Colden Patrick Robertsone of Smiddiehill Shireff depute of Kinross and Robert Duncan baillie of Kinross Commissioners of Supplie and Justices of peace within the shyre of Kinross Shewing That wheras the road throw Kinross shyre is one of the greatest passes for travellers within this kingdome and that passingers are often stopt and in danger of ther Lifes by the want of a bridge over the watter of Neither Quiech at the toune end of Kinross Which Requyres a bridge of no less then thrie great bowes of a Charge so far beyond the power of so small a 2Shyre even with the assistance of what can be spaired of the years vaccand stipend of Kinross Which the patron has granted towards that and other publict Charitable and usefull works that it will not be possible to make and finish the same without the said Lords would be pleased to grant warrand for a free and volunter Contributione at the Church doors of Pearth Fyfe, and the City of Edinburgh who are most concerned in trafeeque and passingers that frequent and pass the said Road And Therfore humbly Craveing the saids Lords to Grant a warrand for that effect to be Collected speedily that the said bridge may be finished this Seasone which is Comenced and much therto allready provyded and to authorize James Kennoway late baillie in Kinross to uplift the samen to be payed out by him for matterialls and workmanship at the sight and by direction of Sir William Bruce and the baillie of the said toune who doe receid very near to the place wher the bridge is designed to be built and have undertaken the directione and Oversight therof as the petitione bears The Lords of their Majesties privy Councill haveing Considered this petitione given in to them be John Lord Burleigh James Rankine of Colden Patrak Robertsone of Smiddiehill and other Commissioners of Supply and Justices of peace within the Shyre of Kinross They hereby allow a voluntar Contrabutione within the shyres of Fyfe Pearth and Kinross and within the toune of Edinburgh for makeing a bridge over the watter of Nather Queich 3at the toune end of Kinross Upon Sabath the twelth day of August nixt to come and appoints the said Collectiones to be payed in to the above James Kennoway late baillie in Kinross whom they hereby nominat and appoint to be factor for uplifting of the sae In respect4 The said factor 5 hes before extracting heirof Granted bond and found suficient Cautione acted in the bookes of privy Councill That the Collectiones to be delivered in to him shall be applyed to the use forsaid at the sight of the persones abovenamed and Recomends to the ministers of the severall shyres within the respective bounds forsaid to make intimation publictly out of their pulpits of this act upon the Sabbath day Imediatly preceiding the day above appointed for makeing the saids Collectiones And ordaines these presents to be printed.

Procedure

Anent the Roup of the Polemoney

The Councill haveing Considered at length upon the polemoney and it haveing gone to the vote whither adhere to the former vote or noe Wherby the Polmoney was to be sett in ferme by way of publict roup It was Caried adhere, And that the pole money be by way of roup, And it haveing gone to them vote if the roup should be before the first of August or after the first of October It was Carried that the same should be before the first of August and therafter the twentie fourth day of Jully was voted to be the preceiss day of the roup and by two severall votes It was caried that the roup should be before the Lords of Exchaquer and the conditione of the roup to be made up be their Lordships, And in the mean time Recomends to my Lord Advocat to draw the proclamationes as formerly appointed and intimateing the roup.

The Lords of their majesties privie Councell Considering That the pole money offered by the nynth act of the fourth session of this Currant parliament may be most effectuallie Levyed and raised by uay of publict Roup Doe Therfore heirby Recommend to the Lords of their Majesties Thesaury and Exchequer to make a publict Roup of the said pole money uithin the Exchequer house at Edinburgh upon the tuenty fourth day of July Instant betuixt three and five hours in the Afternoon And to adjust and make up the articles and Conditions of the said Roup To the effect they may be seen in the hands of Sir Thomas Muncreiff of that ilk one of the saids Lords their Clerks by all persons Concerned before the tyme of making the roupe

Act The Kirk session of Stirling Against The magistrats therof

Anent the petitione Given in to the Lords of their majesties privie Councell by Mr Robert Rule minister and remanent members of the Kirk session of Stirline Sheuing That wher there being now a Legall Eldership Constitut in the paroch of Stirling and the united presbytries of Stirling and Dumblane Having therupon appointed some of their number to requyre the magistrats Late Kirk thesaurer session Clerk and other havers of the session books Registers mortifications poors money and box mortcloths and other utencills of the paroch to delyver up the same to the petitioners or any they should Impoure for that effect and the same Having been accordingly requyred by the presbytries Commissioners from John Dick present provost of Stirling nevertheless He and other Havers refuise postpone and delay soe to doe all which appeared by ane Instrument produced uith the said petitione And therfore humbly Craving their Lordships may be pleased to Grant warrand to the Clerks of privie Councell to direct Letters of horning at the petitioners instance against the present magistrats Late kirk Thesaurer and other Havers of the sessione books registers and mortifications poors money and box mortcloaths and other utencells of the said kirk and paroch to delyver up the same to the petitioners as the said petitione bears which petition being read in presence of the saids Lords They Recommended to a Committie of their oune number to Consider the same and Ansuers given in therto for the Magistrats of Stirling and to Call for and Endeavour to setle and aggree the parties And In case of Difficultie to report and the said Committie Having accordingly mett and having heard the bill and ansuers and Considered the papers produced for aither partie and having Called for and heard both parties in their presence They Gave in their report in the termes follouing viz That it is their opinione primo That the Registers poors money and poors box uith the utencells of the Church Craved by Mr Rule and his kirk session ought of Common right to be Given up and delyvered 2 to them by the magistrats of Stirling But Lykeuise the magistrats doe alleadge That by Immemoriall Custome The magistrats and toune Counsell of Stirling have had the Constant Custody and keeping of the poors money and poors Box which is denyed by the petitioners that therfore a short day should be assigned to both parties to prove hinc Inde their respective possessions and that for that effect the magistrats should instantly give up to the minister and kirk session the whole session books and registers now in their hands For Instructing the Custome and use in the said caise and that the magistrats doe also make patent the toune books and registers to the said minister and kirk session That both parties may have such extracts furth of the same as may be usefull for Clearing the forsaid Custome and Lastly that the saids magistrats be Certified that unles they prove their forsaid Immemoriall Custome and possession betuixt and the day forsaid The Lords of Councell will Grant the desyre of the forsaid petitione uithout furder delay as the said report bears which report being Considered by the saids Lords and they being well and rypely advysed theruith They by their Interloquitor of the tuenty one day of June Last approved of the said report and Assigned a day to both parties for proving their respective possessione as in the report and ordained Letters of dilligence to be direct at aither parties instance both against uitnesses and havers of wrytes and Lykeuise ordained Letters of horning at the petitioners instance against the saids magistrats upon tuenty four hours warning For delyvering up instantly to the petitioners the minister and kirk session The haill session books and registers now In their hands For Instructing the Custome and use in the above cause And alse for making patent to the petitioners the touns books and registers that both parties might have such extracts furth of the same as might be usefull For Clearing the above Custome Conforme wherunto both parties adduced diverse and sundrie famous uitnesses who Having made faith In presence of the Councell uere remitted to a Committie to be examined and being examined by the said Committie Deponed and Declared as their oaths and depositiones extant In proces bears And the said Lords of their Majesties privie Counsell Having Considered the Depositiones of uitnesses adduced by aither partie They Find it not proven that the magistrats of Stirling Have been in possessione of the poors money poors box bonds and Kirk mortcloaths But Finds it proven that the same have been in the possession of the kirk session or their Thesaurer And Therfore ordaines the magistrats of Stirling and others In whose hands the poors box poors money bonds and kirk mortcloaths are to exhibite and delyver up the same to the present kirk session or their Thesaurer And ordaines Letters of horning on six dayes to be direct heiron at the instance of the kirk session or Thesaurer against the magistrats and other havers all to be particularly named and designed in the Horning and others upon the premisses In forme as effeirs

Act Nicolas Dupine

Anent the petitione given in to the Lords of their Majesties privie Councell By Nicolas Dupine Esquire Late Governour of the paper and Linnen manufactory in the kingdome of England and Ireland and Dennis Manes Esquire one of the Late managers of some of the paper mills in England Sheuing That the petitioner Nicolas Dupine Hath for these severall years by past been at Great paines Costs and charges to obtaine severall charters of Incorporatione and patents for establishing the whyte wryting and printing paper and Linnen manufactures in the Kingdome of England and Ireland (2as by the saids patent inrolled in the high Courts of Chancery of both Kingdoms may appear wherin great Companies Have Joyned and severall Considerable stocks of money been raised And many Thousands of poor recommendation actuallie Imployed (as by severall Great Generall sales of Linnen and paper sold at London may appear) And the petitioners Having for these severall years past studied and arryved to the airt of making all sorts of fyne paper moulds as good or better as any made beyond seas and at a farr cheaper rate In so much that one man can make and finish moe moulds In one week then any other workman in other nations Can finish in tuo months tyme And wheras Large timber is scarce in this Kingdome The petitioners have airts to make the Greatest mortar and vessell for making of paper uithout timber And the petitioners have provyded severall Ingenious outlandish workmen to work and teach their airt in this Kingdome altho as the petitioner is Informed some persons Have attempted to work good wryting paper to furnish this kingdome yet they Could not effect the same In Consideration of the premisses and that severall of the nobility Gentrie merchants and others of this kingdom then at London did Encourage and accordingly gave the petitioner Nicolas Dupine severall Letters of Recommendatione to severall noblemen merchants and others in Scotland The better to help and Enable him to Erect and Carry on the Lyke paper manufactory in this Kingdome And therfore Humblie Craving to the effect underwryten as the said petition bears The Saids Lords of their majesties privie Councell Having Considered the above petition They heirby Grant protectione and Libertie to the petitioners to sett up paper mills in this Kingdome uithout hindering any other persons who are already sett up and alloues the petitioners to putt the Coat of armes of this Kingdome upon the paper which shall be made by them at these mills
