Warrant

Warrand For Citing Chiftains of Clanns And anent a bond to be given by them

Report of the Committie for the Highland Clanns and the haill kingdome and anent the Chiftains to be Cited before the Councell with a List of these Chiftains Contained in the Committies report and another List wryten by Sir Gilbert Eliot one of the Clerks of Counsell Togither with the tenor of the bond to be signed by the saids Chiftains read And the Councell approves of the bond And ordaines all the Chiftains in the saids Lists and their Lowland Cautioners to be found by them to signe and subscrive the same And ordaines Letters to be direct under the signet of Councill at the instance of Sir James Steuart his Majesties Advocat For Citing all the persons in the saids Lists to appear before the Councell upon the first second and third thursdayes of June nixt to Come a third part of them to each of the saids three dayes to subscribe the said bond and to bring a sufficient Lowland man allong with each of them to subscryve Cautioner for them with Certification to each persone who failzies to Compear and bring a sufficient Lowland Cautioner allongst with them that they shall be declared fugitive and Denunced to the horne And the Letters are to Containe ane Expres warrand that the Citation given to each of the saids persons shall be a sufficient protection to them from Civill debts after the Tuenty Tuentie fifth and Threttie dayes of May to their Compearance and for ten dayes therafter

Warrand for Committing Elderslie and forfaulting Craigies bond

Sir William Wallace of Cragie and Mr Thomas Wallace of Elderslie For both whom William Biggar of Uolmet is Cautioner Having been Charged upon their bonds to have appeared before the Lords of his Majesties privie Councell Compeared The said Mr Thomas Wallace and the said William Biggar of Uolmet and a testificat being formerly produced for Sir William Wallace and another upon soull and Conscience Declaring that what is in the first testificat is truth The saids Lords of his Majesties privy Councell In respect the said Mr Thomas Wallace hath been in France since the year Jaj vjc nyntie three Committed him to a macer to Carry him prisoner to the tolbooth of Edinburgh And alloues the Clerks of Councell to delyver the bond granted by the said Mr Thomas Wallace and his said Cautioner for his peacable behaviour and appearance when called for dated the tuenty fifth day of January Jaj vjc nyntie six years And Have forfaulted and heirby forfaults the penaltie of one Thousand pounds sterline Contained in a bond granted by the said Sir William Wallace as principall and the said William Biggar of Wolmet as Cautioner dated the tuenty fourth day of January and Eighteenth day of February Last bypast And Decerns and ordaines the principall and Cautioner forsaid to make payment to George Baillie of Jarvisuood Generall Receaver of his majesties Croun rents of the said soume of one thousand pounds sterling of penaltie And ordaines Letters of horning and poynding on six dayes and others needfull under the signet of Councill to pass heiron in forme as effeirs with this Condition alwayes That if the said Sir William Wallace shall upon the fourteenth day of Apryle instant aither appear himself personallie before the saids Lords of privie Councell or produce to their Lordships a testificatt under the hand of a phisitian upon soull and Conscience of the said Sir William Wallace his present Indispositione That then the saids Lords will furder Consider his case And Discharges the extracting of this Interloquitor untill the said Fourteenth day of Apryle instant be elapsed

The Lords of his Majesties privie Councell Having Considered the report made to their Lordships by Sir James Steuart his Majesties advocat anent the Ministers Imprisoned in the tolbooth of Edinburgh The saids Lords of his Majesties privy Councell Doe heirby Discharge Mr James Adamson Late Minister at Bedrule to preach or exercise any pairt of his ministeriall function uithin this Kingdome And Gives order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett the said Mr James at Libertie furth therof In respect that he hath inacted himself in the books of privie Councell That he shall Depart furth of the toune of Edinburgh Liberties and suburbs therof betuixt and the first day of May nixt to Come And shall not returne uithin the same, without his Majesties or the Councells warrand for that effect And that under the paine of being banished furth of this kingdome And the saids Lords Doe heirby Discharge Mr Charles Kay Late Minister at Leith to preach or exercise any part of his Ministeriall functione under the paine of being banished furth of this kingdome if he faill And discharges Mr. John Park Late Minister att Carriden, to preach or exercise any part of his ministeriall functione uithin the toune of Edinburgh or suburbs therof And if at any tyme hereafter he shall preach in the forsaids bounds The saids Lords authorizes and Impoures the Magistrats of Edinburgh to banish him furth of the said toune and Liberties of the same And the saids Lords banishes Mr James Chalmers Late minister at Kilpatrick in Annandale furth of this kingdome And discharges him to preach or exercise any part of his ministeriall function uithin the same And Gives order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett the said Mr James Chalmers at Libertie furth therof In order to his banishment In respect He hath Inacted himself in the books of privie Councell That he shall Depart furth of this kingdome betuixt and the fifteenth day of May nixt to Come and never returne uithin the samen uithout his Majesties or the Councels orders to that effect And Discharges Mr William Abercrombie Late Minister at Mayboill to preach or exercise any part of his Ministeriall functione uithin this kingdome under the paine of being banished furth of the same And Gives order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett at Liberty furth therof Mr. Charles Kay Mr John Park Mr William Abercrumbie and Mr Alexander Malcolme Late minister at Edinburgh Mr Robert Lockhart Late minister at Kilbryde and Mr David Freebairn Late Minister at Dinning in Perthshire For which this shall be a sufficient warrand to all Concerned

The Following Commission In favoures of Mr Frances Montgomery being read was ordered to be recorded wherof the tenor folloues
sic suprascribitur William Rex
William by the Grace of god King of Scotland England France and Ireland defender of the faith etc To our Truistie and uell beloved Councelor Mr Frances Montgomery Greeting We reposing trust and Confidence in your fidelity Courage and good Conduct Have nominated Constituted and appointed And by these presents doe nominat Constitut and appoint yow to be Governour of our Castle of Dumbartone and also Captain of the Company of foot in garrisone therin In place of Major […] Buntyne formerly Governour therof Giving heirby unto yow full pouer and authority to Command our said Castle And to Arme trayne exercise Lead and Conduct our said Company for our service in all things belonging to the trust and Command aforsaid and to Enjoy all other privileges and emoluments formerly belonging to the Governours of our said Castle And we doe heirby requyre all the officers and souldiers in our said garrisone to obey yow in all things for our service as their Governour and Captaine And yourself Lykewise to observe and follow all such orders, directions and Commands as yow shall from tyme to tyme receave from us In pursuance of the speciall trust heirby reposed in yow Given under our royall hand and signet at our Court at Kensingtoune the 26 day of march 1696 and of our reigne the seventh year By his Majesties Command sic subscribitur James Ogilvie
