Warrand for Delivering Thomas Joyner To Captain Ross.

The Lords of their majesties privy Councill haveing Considered a petition given in to a Comittie of their oun number anent pressed men be Thomas Joyner Taylor with the Report of the said Committie Bearing that it is proven that Joyner did voluntarly take on with Captaine Ross and that on Daniall Grant endeavored to rescue him with violence They Ordaine the baillies of the Cannogate and keeper of their Tolbooth to deliver the said Thomas Joyner to the said Captaine Ross to be by him Imployed as a Souldier and leaves the said Daniall Grant to the magistrats of Edinburgh to be by them punished as they shall find Just.

Recomendatione anent John Ferrier

Anent a Petition given in to the Lords of ther majesties privy Councill be John Ferier in West Feild and John and William Ferier his two sones Shewing That quher the said petitioners were yesterday morning by break of day being the fiftein of Aprill instant seazed in ther beds at Westfeild by a parte of my Lord Jedburghs Dragoons by warrand from Major Burnet Major to the said Regiment for recruits to Ensigne William Sandilands in Coll Lauders regiment upon the pretence of being deserters of ther majesties service most wrongeously Considering that the said John Ferier elder and his sone John Ferier younger hath been in the Continued possession for severall years bygone of ane Roome presently laboured by them for which they pay a Considerable rent of Eight or nyne hundreth merks yearly to the Laird of Cleghorn ther master, And the said William Ferier is present servitor to Mr John Frank advocat and has been with him ever since he came from Schoolls And being Informed that the saids persones are shiped at Borowstounes of keeped in prison in order to be transported to Flanders And Therfore Humbly Craveing the saids Lords to grant warrand to liberat the fornamed persones, or to Cause bring them in to be examined if they was ever in their majesties service that upon due tryall therof they may be Discharged as the petitione bears The Lords of their Majesties privy Councill haveing Considered this petition given in to them be the above John Ferier and his two sones They heirby Recomend to Sir Thomas Livingstoune Comander in Cheif of their majesties forces within this kingdome to examine and take tryall of the above Complaint and to doe Justice therin and in the mean time to give order and take Course that the petitioners be keeped within any suficient prison and not be determined And that if they be shiped they may be brought a Shoar and Committed to prison dureing the space and to the effect forsaid and that Sir Thomas Call for the above Major Burnett and Ensigne Sandilands and examine them in the said matter.

Anent a Petition given in to the Lords of their majesties privy Councill be John Miller merchant in Edinburgh Shewing That quher the petitioner being on saturday last the fourtein of Aprill about his necessary affairs Captain Ingles and Cornett Caunt with a partie of Dragoons came to the petitioners quarters at Ratho and betwixt the hours of ten and Eleven at night seized and the took the petitioners person and violently caried him away to the Tolbooth of the Canogate on sunday last being the fiftein Current and ther detaines him prisoner albeit he never Caried armes as is notourly knowen to the nighbours in Edinburgh who can attest the same on the petitioners accompt In Respect quherof It wes Earnestly desyred that their Lordships would either appoint the petitioner to be set at libertie or ordaine the said Captaine Inglis and Cornet Caunt and the petitioner to be heard before the saids Lords or A Comittie or Remitted to the magistrats of Edinburgh to take tryall in the said matter as the petition bears The Lords of their majesties privy Councill haveing heard this petition given in to them be the above John Miller read in their presence they heirby Remitt to the magistrats of Edinburgh to examine and take tryall of the matter aboverepresented with power to them to decyde and determine therin and also anent the pressing of […] Kennydy Liveing in the Lord Advocats closs in Edinburgh according as they shall find Just Conforme to the Lawes acts and proclamationes of privy Councill

The Lords of their Majesties privy Councill Considering that John Watsone in Kilforgie who was shiped aboard James Ninoes ship as one of the Levies to be transported for Flanders is now prisoner in the Tolbooth of Edinburgh They heirby Recomend to Sir Thomas Liveingstoune Comander in Cheif of their majesties forces within this kingdome to cause ship any of the Levies aboard the said ship in place of the said John, And Declairs incase the said John shall be found to be legally put out then he shall be put in the place of the person whom Sir Thomas shall order to be shiped in his place, And in case It shall be found that the said John is not legally put out then the Councill will ordaine […] Mercer of Melgins one of the heritors of Pearth shire by whom the said John is put out to furnish and deliver another suficient man in his stead for their Majesties service in the termes of acts and proclamationes of Councill

Anent a Memoriall given in be Mr William Erskine Livt Governor of the Castle of Blackness to the Lords of their majesties privy Councill Representing that the saids Lords was pleased to order him to goe and receive in the seamen the last year Conforme to the act of parliament made ther2 anent ther being but a very short time quhich made the bussines more expencive and troublsome he being oblidged to grant Comissiones to severalls and did oblidge himself to pay them salleries besydes the sixpence a day after they were received and he payed severalls of them so farr as the hundred punds sterling he received from the Lords of thesaurie would amount to ther being a great deall of the said hundred punds sterling given out at sixpence a day to those who came from the north and other places And Craveing the saids Lords to Recomend to the Lords of thesaurie to give up his obligation for the former hundred punds sterling and to allow him what farder they should think fitt for his great paines The Lords of their majesties privy Councill haveing heard this petition given in to them be the above Mr William Erskine read in ther presence They Recomend to the Lords Commissioners of their majesties thesaurie to Consider the above petition and Grant the Desyre therof as they shall find Just.
