The Lords of their majesties privy Councill Doe heirby Give order and Warrand to the magistrats of Edinburgh and keeper of their Tolbooth To sett at libertie furth therof John Watson in Culforgie presently prisoner therin In Respect he has given bond and found suficient Caution acted in the books of privy Councill that he shall appear befor the Lords of their Majesties privy Councill when Called for under the penaltie of ane hundred punds scots by and attour the performance of the premisses.

Anent a Petition given in to the Lords of their Majesties privy Councill be Livetenant Collonell Shipie Hill Shewing That upon the Complaint of Peeter Baveradge tenant in Cullforgie, William Arnot and John Watson to their Lordships against the persones of Corporall Duncan and Androw Aiken in Captain Burnetts troop and Daniall Frazer and James Telferr in the Lord Beilhavens Troop about some insolencies Committed by one Georg Oliphant sometimes in Orchard mylne the said Dragoons are brought prisoners to the Abbay Guard by Sir Thomas Liveingstounes order And Therfore Humbly Craveing the saids Lords That the said Dragoons may be Imediatly tryed and either Condemned or assoylzied since by their long Lying into prison their horsses will be intirely ruined as the petition bears The Lords of their Majesties privy Councill Haveing Considered the above petition given in to them be the above Livt Coll Shipie Hill They heirby Give order and warrand to the magistrats of Burghs masters of prisones or officers in whose Custody the above Dragoons are to sett them at libertie they first giveing bond and finding the petitioner Cautioner for them That they Shall appear before the Councill and answers to any Lybell quhich shall be raised against them in the above matter and that whensoever they shall be cited or called ther to each of them under the penaltie of ane Hundred punds Scots money a peace and Ordaines the above persones Complaineing upon the saids Dragoons to raise a lybell and insist against them to the first day of May nixt, and the bond of Cautionrie to be granted by the petitioner to bear expressly that he shall produce them before the Councill the said day And that they shall attend the dyets of the said process.

Act

Act Mr Hew Dalrymple for delivering some wrytes of the Countes of Errolls.

The Lords of their Majesties privy Councill Considering that by their act of the date the Eight day of February last They upon a petition presented to them for the Earle of Seaforth Did Authorize Sir Robert Hamilton in England to deliver up the papers left in his hands be the deceast Countes of Erroll to the secretary of state to be sealled up and sent to the Clerks of privy Councill, Which wrytes are delivered up be Sir Robert and sent by the secretary in a box or sealled Cover to Mr Hew Dalrymple advocat The saids Lords Doe heirby authorize and Requyre the said Mr Hew Dalrymple to exhibit and deliver the above wrytes or papers to the Clerks of privy Councill at sight of Sir James Steward their Majesties advocat to whom they Recomend to see the opening of the box or Cover quherin the wrytes are and breaking up the sealls therof, And appoints the Clerks of Councill to Inventar the wrytes and give inspection of the wrytes in their oun hands or Copies of the Inventar to all persones pretending intrest who shall desyre or requyre the same And Ordaines the wrytes to lye in the hands of their saids Clerks untill farder order.

Anent a Petition given in to the Lords of their majesties privy Councill bee Mr John Arthur present minister at the Church of Elie within the Shirefdome of Fyfe for himself and in name of the elders of the kirk sessione and other parishioners of the said parish Shewing That Mr Alexander Wilsone the former incumbent being deprived by the saids Lords in anno Jaj vjc Eightie nyne, And the said Church of the Elie Declared vaccand the same Continued so untill the petitioners entrie quherby ther are two years and half a years vaccand stipend due viz Jaj vjc nyntie Jaj vjc nyntie one and half of Jaj vjc nyntie two years and Seing that not only the said Church and Manse are altogither ruinous so that the petitioner Can neither live in the one nor preach in the Other, as alsoe the Church yeard dykes are so demolished and the ground therof being only Sand divers of the Graves are blowen up and the very Coffins seen, And the said stipend being on of the meanest within the said parish Lyable to pay the stipend but that of Ardross It would take the said wholl vaccand stipend to repair the said Church manse and Church yeard dykes And Seing the samen cannot be better applyed then Towards this so pious Charitable and necessar a work within the said parish it self And the saids lands of Ardross being now in the Creditors hands a part quherof are at a Considerable Distance whose subscriptiones could not at present be procured yet all of them when spocken to by the minister Declared their willingnes to have the said vaccand stipend abovementioned applyed for the repairation forsaid and desyred the said minister and Kirk session to supplicat the saids Lords for a grant of the said vaccand stipend to the ends abovewritten as the saids Lords have done frequently in the like case And Therfore humbly Craveing the saids Lords upon Consideration of the premisses to allow the said two years and ane halfs stipend to the said parishin of Elie to be applyed towards the repairation of the Church manse and Church yeard Dykes of the Ellie And to grant warrand to James Baillie merchant in the Ellie to Collect and ingather the said vaccand stipend from these Lyable in payment that it may be applyed to the ends aforsaid, And also to ordaine letters of horning to be direct at the said Collectors instance for the same as the petition bears The Lords of their majesties privy Councill haveing Considered the above petition given in to them be Mr John Arthur, And the Councill Considering that ther is at present no particular patron of the above parish of Elie, The estate of the Lairds of Ardness who were formerly patrones therof being Divyded amongst a great many Creditors They heirby allow the vaccand stipend of the said kirk of Ellie for the saids haill years and cropts Jaj vjc nyntie and Jaj vjc nyntie one, and the half of the year and Cropt Jaj vjc nyntie two To be Imployed for repairing the said kirk, kirk yeard dyke, and ministers manse, And nominats and appoints James Baillie merchant in Ellie to be factor for uplifting therof And Ordaines him to be readily answered obeyed and payed therof be the heritors fewars lyfrentars wodsetters and others Lyable in payment therof And Ordaines letters of horning to be direct at the said factors instance under the Signet of Councill against them for that effect He produceing a decreet of Locallity and incase ther be non ordaines these Lyable to make payment to the said factor of their respective proportiones of the said two years and ane half years stipend according as they shall be Decerned by the Judge ordinary In Respect the said factor has given bond and found suficient Cautione acted in the books of privy Councill that he shall apply the said stipends for the ends and usses abovementioned.

Anent a Petition given in to the Lords of their majesties privy Councill be William Morisone of Prestongrange patron of the parish kirk of Saltpreston, Sir James Oswald of Fingletoune and other heritors of the said parish Shewing That quher by severall acts of parliament the vaccand stipends of Churches belonging to Lawick patrons are allowed to be Disposed of for pious uses within the said parishines by the saids Patrones, And that the said Church of Saltprestone has been vaccant for the cropts and years Jaj vjc nyntie two and Jaj vjc nyntie thrie And the petitioner Prestongrange undoubted patron of the said parish haveing of Consent of the heritors therof agreed and Condescended upon Lawfull pious uses within the said parish Wherupon the vaccand stipends for the saids years are to be Imployed so that necessar it is for raiseing and uplifting therof that the petitioners should have letters of horning and other dilligence direct at their oun instance or at the instance of a factor to be appointed by the said patron against the heritors lyfrentars and others Lyable in payment of the said stipends for the saids two years by past for payment of their severall proportiones to the petitioner or their said factor to be Imployed upon the pious uses forsaids And Therfore humbly Craveing the saids Lords would be pleased, In Consideratione of the premisses to grant letters of horning and other dilligence at the petitioners instance as patron or at the instance of the factor to be appointed by him against the heritors Lyfrenters and others Lyable in payment of the said two years stipend each of them for their oun parts conforme to a decreet of Localitie theranent and to allow the petitioner to nominat any fitt persone he shall think meett for receiving the said vaccand stipend to be applyed for pious uses a foresaid as the petition bears The Lords of their majesties privy Councill haveing Considered the above petition given in to them be the above William Morisone James Oswald and other heritors of the above parish They heirby allow the vaccand stipend of the above Kirk of Saltpreston for the years Jaj vjc nyntie two and nyntie thrie to be Imployed for the severall pious uses within the parish agreed and Condescended upon by the said Laird of Prestongrange patron of Consent of the heritors And Ordaines the heritors Lyfrentars wodsetters fewars and others Lyable in payment to make payment of the samen to the said Laird of Prestongrange patron forsaid or any other person whom he shall appoint to be factor for uplifting therof And Ordaines letters of horning under the signet of Councill to be direct heiron at the instance of the said patron or factor forsaid to be appointed by him Conforme to the Decreet of Localitie to be produced by them, And in case ther be non Ordaines these Lyable to make payment to the said patron or his factor of their respective proportiones of the said two years stipend according as they shall be Decered be the Judge ordinary.

Anent a Petition given in to the Lords of their Majesties privy Councill be James Mc2brea3 prisoner aboard the Elizabeth 4 of Borowstouness Robert Steidman master Shewing That quher the petitioner was seized upon at Drumlanrig to be ane Souldier in the present Levie upon his being presented at first the petitioner was dismist because of the petitioners profession of being one of the people Called Quakers But afterwards on a Suspitione that the petitioner was not one really but Desembled the petitioner was retaken and now pressed and put aboard, as to which the petitioner shall only say that he is not to debate his principalls but it is the knowen principle of the people now he Joyns with that they nether will nor can in Conscience fight with any of mankind, And that the petitioner is really of the forsaid profession is nottour and he is Content that it be tryed by any method possible And Therfore since the petitioners principalls and Conscience doe invincibly obstruct the petitioner that he cannot serve as a souldier But if sent away must be only useless and miserable he hoped the saids Lords would not refuse him the indulgance and Compassion given and allowed to the petitioners in England wher it is knowen that both as to swearing and Fighting they are exempted and it need not be apprehended that this may be a bad example for ther are but few of this mind in Scotland And if 5 ther6 were more it would be telling the world, And that even all mankind were of it since then warr and Fighting should be at ane end, But the only thing the petitioner conceaves to be adverted to is that no man make a pretence of this professione who is not reall, If this be prevented ther can be no ill Consequence in any favor the petitioner Craves But the saids Lords would shew themselves to be tender of what is Judged to Conscience and also Compassionat of a poor mans misery that cannot Otherwayes be helped And Therfore Humbly Craveing the saids Lords for Gods Saik whose Image he darr not offer to destroy and for Jesus Christs Saike whom he desyre sinceirly to Imitat That yee will hacken to this his request and order the petitioner to be set at Libertie And so the petitioner shall ever pray that the Lord might help yow in all your distresses as the petition bears The Lords of their Majesties privy Councill Haveing Considered this petition given in to them be the above James Mcbrea They heirby Recomend to the Lord high Chancelor to Speak or wryt to the duke of Queensberry for setting free the petitioner He furnishing another suficient man in his place, or what else the said Lord Chancelor shall think fitt to speak or wryte to the said Duke anent the petitioners releiff.

Act The Countes of Seaforth.

Anent a Petition given in to the Lords of their Majesties privy Councill be Issobell Countes of Seaforth Shewing That quher the petitioner is obleidged to furnish fiftein men out of the lands in the shyre of Ross and the Isles of Lewes and others belonging to her, And the Lewes and Isles Lying at a great Distance the proportion of men furnished out therof Could not by the distance of the place and Storminess of the seas come up to be delivered to the officer appointed to receive them And the petitioner used all posible means to furnish others in ther place and for that end hyred and presented fiftein men of which the officer refused nyne, Therafter the petitioner Caused present other nyne men in ther place and of which nyne he refused six so that it is not in the petitioners power to furnish other men untill they be brought from the Isles and Lewes out of which they are to be furnished And Seing the petitioner is content to present the six men being suficient at any place within this kingdome wher the saids Lords should appoint ane Competent time being allowed to the petitioner for doeing therof And Therfore humbly Craveing the saids Lords to allow the petitioner a Competent time to provyde these six men and appoint any place within the kingdome for deliverie of them to any Comander of any part of the forces the saids Lords should ordaine seing she was satisfied to transport them upon the petitioners oun hazard and expences and in the mean time to delay any procedor anent ther being deficient as the petition bears The Lords of ther majesties privy Councill haveing Considered this petition given in to them be the above Countes of Seaforth They allow the petitioner yet to provyde six suficient men in place of these refused by the officer And Ordaines the petitioner to deliver the said six men at Stirling to the Commanding officer ther for the time being And that at2 any time betwixt and the Eight day of May nixt under the paine of being Lyable to a double penalty for deficiencie besydes what is contained in the proclamationes and instructiones of Councill published theranent

Anent a Petition given in to the Lords of ther Majesties privy Councill be Sir Donald Mcdonald of Sclait Rodrick McCleod of Dunvegen Lachlan Mcfingow of Strathordale Malcome McCleod of Rathsey Rorie Mcneill of Barra Shewing That quheras by the printed instructione emitted by the saids Lords to the Commissioners of Supply within the severall shires of the kingdome anent the new Levies ther within the shyre of Innverness were ordained to have their proportione of Levies in readieness at the head burgh therof upon the first day of march last and the petitioner tho within the said shyre, yet liveing in Island so remote from the head burgh therof that most part of the time allowed for makeing the said Levies was elapsed before any intimatione therof Could come to the petitioner It was not possible for them to send their proportion of the saids Levies to the head burgh of the shyre against the said day by reasone of the great distance therof from the places of the petitioners residence And the necessitie of Crossing seas in that seasone And Therfore Humbly Craveing the saids Lords To appoint a new dyet for the petitioners delivering their proportione of Levies to any officer of his majesties forces the saids Lords should appoint to receive the same within such Competent time as the saids Lords should think fitt as the petitione bears The Lords of their majesties privy Councill haveing Considered the above petition given in to them be the above Donald McDonald of Sclait and others above Designed They heirby assigne the Eight day of may nixt to the petitioners to deliver in their proportione of the Levies at Stirling to the Comanding officer ther for the time being under the paine of being furder Lyable to a double penalty for not sending the deficients besides what is allready contained in the proclamationes and instructiones of Councill published theranent.
