Recommendation To Sir Thomas Livingstoun to Cause demolish the Bass

The Lords of their Majesties privie Councell In obedience to and prosecutione of their Majesties Commands Contained in a Letter direct to them of the date the threttieth of Apryle Last Doe heirby Recommend to Sir Thomas Livingstoune Commander in cheiff of their majesties forces uithin this Kingdome To Cause demolish all works fortifications and other buildings whatsomever upon the Bass And to remove thence the Cannon amunitione and whatever else may be serviceable else wher And Recommends to The Lords Commissioners of their Majesties Thesaury to Give order for payment of the necessary expences which may be depursed in the demolishment and to the saids Lords Commissioners to dispose of the matterialls as they shall think fitt to the best advantage of their majesties service

The follouing Letter from the Kings majestie To The Councell being read was ordered to be recorded wherof the tenor folloues

Act Anent some deficient men of Buckcleughs Lands In Drumfries or Roxburghshire

Anent the memoriall given in to the Lords of their Majesties privy Councell By Sir William Douglass Sheuing That wheras the Commissioners of Cess and supplie for the shire of Drumfreis and Nithsdale Did appoint the Dutches of Buckcleugh Lands in these shires to furnish the number of tuentie four men as their proportione of the new Levys which they refuised to doe In regaird they sayd They behooved to furnish the said proportione for the shire of Roxburgh The Dutches estate being disjoyned from the shire of Nithsdale And therfore Humbly Craving their Lordships to take the premisses into their Consideration and to appointe one of these tuo shires to furnish the said number of four and tuenty men which they are now deficient of to be delyvered to the said Collonell Douglas uith the rest of their deficiency or to order some other way for the getting of them as their Lordships shall think fitt as the said memoriall bears The Saids Lords of their majesties privy Councell Having Considered the above memoriall They heirby appoint Sir Gilbert Eliot their Clerk to wryte to the Clerk of the Commissioners of supplie in both shires of Drumfreis and Roxburgh That they send in some of their number to attend the Councell in the begining of Juny nixt for adjusting any differences betuixt these tuo shires anent the Levy to be putt out of the Dutchess of Buckcleughs Lands. The Lords of their majesties privie Councell Having Considered a petitione given in to them By Whytefield Heyter of London Citizen for himself and his pairtners uith the ansuers made therto for the Incorporatione of Skinners uithin the burgh of Edinburgh uith Concurrence of the magistrats and toune Counsell therof They Conforme to the pouer granted to them by the Acts of parliament Doe heirby authorize and allow the petitioners to Come into this Kingdome of Scotland and to sett up a manufactory for dressing and Collouring all sorts of Leather and for making of Glew And the saids Lords Doe heirby declare That the promotters masters servants and others belonging to the said manufactory shall have and freely possess and Enjoy all the rights priviledges Liberties and Immunities granted by the severall acts of parliament and particularly by the acts Jaj vic sixtie one and Jaj vic Eightie one years To the promotters masters servants and others belonging to manufactures and all matterialls and stock Imployed theron sicklyke and alse freely as if the petitioners had a particular act of parliament in their favoures provyding aluayes that the said Manufactory shall not be extended to tanning of Leather which the saids Lords declares to be noe pairt of the work of the said manufactory And Lykewise that the said manufactory shall be no monopoley And that none others shall be therby excluded but every one shall be free to doe their best in the same Airts as these of the manufactory are

The Lords of their Majesties privie Counsell Doe heirby appoint to Give up the bond granted by Ensigne David Dumbar as principall and Captain Archbald Dumbar one of the Captains in Collonell Buchans regiment as Cautioner for the said Ensigne Dumbar his peacable behaviour and appearance when called Containing the penaltie of five hundreth merks dated the tuelvth and fifteenth dayes of Agust Jaj vic nyntie tuo years which bond is presently Lying in the hands of the saids Clerks And Declares the above Cautioner to be free of his Cautionrie And that in respect the said David Dumbar is one of the persons Comprehended in the Capitulatione made anent the Bass

Act Alexander Taite for open prisone

Anent the petitione given in to the Lords of their Majesties privie Councell By Alexander Taite skipper in Leith Sheuing That wher the petitioner was Imprisoned in the tolbooth of Edinburgh upon the seventh day of Apryle last by order of their Majesties Advocat and hes ever since Continoued Closs prisoner And hes Lived all the tyme very meanly For it is publictly knouen to all the Inhabitants of Leith That he is poor and Indigent and hes nothing wherupon to mantain himself And therfore Humblie Craving their Lordships to Commisserat the petitioners Condition And Remitt him to be examined by the Lord Advocat And to order the magistrats and Keeper of the tolbooth of Edinburgh to sett him att Libertie upon his Inacting himself to Compear and ansuer when Called or other wayes to appoint ane aliment to be payed to him for his subsistance during his Imprisonment as the said petition bears The Saids Lords of their Majesties privie Councell Having Considered the above petitione They heirby Give order and warrand to the magistrats of Edinburgh and Keeper of their tolbooth To allow the petitioner the benefite of open prisone The saids magistrats and Keeper being aluayes ansuerable for his safe Custody
